AN ACT concerning 1 
 
Public Information Act – Surveillance Images – Illegal Dumping in Baltimore 2 
City 3 
 
FOR the purpose of repealing a certain provision of law requiring a custodian to deny 4 
inspection of certain surveillance images of illegal dumping in Baltimore City except 5 
under certain circumstances requiring a custodian to allow inspection of certain 6 
surveillance images of illegal dumping in Baltimore City under certain 7 
circumstances; and generally relating to the inspection of surveillance images of 8 
illegal dumping in Baltimore City.  9 
 
BY repealing and reenacting, with amendments, 10 
 Article – General Provisions 11 
Section 4–322 12 
 Annotated Code of Maryland 13 
 (2019 Replacement Volume and 2023 Supplement) 14 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 
That the Laws of Maryland read as follows: 16 
 
Article – General Provisions 17 
 
[4–322. 18 
 
 (a) In this section, “surveillance image” has the meaning stated in § 10–112 of the 19 
Criminal Law Article. 20  2 	SENATE BILL 643  
 
 
 
 (b) Except as provided in subsection (c) of this section, a custodian of a 1 
surveillance image shall deny inspection of the surveillance image. 2 
 
 (c) A custodian shall allow inspection of a surveillance image: 3 
 
 (1) as required in § 10–112 of the Criminal Law Article; 4 
 
 (2) by any person issued a citation under § 10–112 of the Criminal Law 5 
Article, or by an attorney of record for the person; or  6 
 
 (3) BY AN EMPLOYEE OR AGENT OF THE BALTIMORE CITY 7 
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT IN AN INV ESTIGATION 8 
OR A PROCEEDING UNDE R § 10–112 OF THE CRIMINAL LAW ARTICLE; OR  9 
 
 (3) (4)  by an employee or agent of the Baltimore City Department of 10 
Public Works in an investigation or a proceeding relating to the imposition of or 11 
indemnification from civil liability under § 10–112 of the Criminal Law Article.] 12 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 13 
October 1, 2024. 14
