AN ACT concerning 1 
 
Major Highway Capacity Expansion Projects – Impact Assessments and 2 
Mitigation Plans 3 
(Transportation and Climate Alignment Act of 2024) 4 
 
FOR the purpose of requiring the Department of Transportation to establish a process for 5 
performing major highway capacity expansion project impact assessments; requiring 6 
the Department of Transportation and a metropolitan planning organization to 7 
perform an impact assessment under certain circumstances; requiring the 8 
Department of Transportation to use the impact assessment to make a certain 9 
determination; requiring the Department of Transportation and a metropolitan 10 
planning organization to develop a certain mitigation plan under certain 11 
circumstances; requiring the Department of Transportation to review for approval a 12 
mitigation plan developed by a metropolitan planning organization; requiring the 13 
Department of the Environment to develop a methodology for making a certain 14 
determination; authorizing the Department of Transportation to restrict or redirect 15 
certain funding that would have been allocated to the metropolitan planning 16 
organization under certain circumstances; requiring the Department of 17 
Transportation or a metropolitan planning organization to post certain information 18 
to its website; and generally relating to major highway capacity projects. 19

That the Laws of Maryland read as follows: 8

 (a) (1) In this section the following words have the meanings indicated. 11 
 
 (7) “Overburdened community” means any census tract for which three or 12 
more of the following environmental health indicators are above the 75th percentile 13 
statewide: 14 
 
 (i) Particulate matter (PM) 2.5; 15 
 
 (ii) Ozone; 16 
 
 (iii) National Air Toxics Assessment (NATA) diesel PM; 17 
 
 (iv) NATA cancer risk; 18 
 
 (v) NATA respiratory hazard index; 19 
 
 (vi) Traffic proximity; 20 
 
 (vii) Lead paint indicator; 21 
 
 (viii) National Priorities List Superfund site proximity; 22 
 
 (ix) Risk Management Plan facility proximity; 23 
 
 (x) Hazardous waste proximity; 24 
 
 (xi) Wastewater discharge indicator; 25 
 
 (xii) Proximity to a Concentrated Animal Feeding Operation (CAFO); 26 
 
 (xiii) Percent of the population lacking broadband coverage; 27

 (8) “Underserved community” means any census tract in which, according 9 
to the most recent U.S. Census Bureau Survey: 10 
 
 (i) At least 25% of the residents qualify as low–income; 11 
 
 (ii) At least 50% of the residents identify as nonwhite; or 12 
 
 (iii) At least 15% of the residents have limited English proficiency. 13

 (a) (1) In this section the following words have the meanings indicated. 16 
 
 (2) “Capital project” means: 17 
 
 (i) Any project for which funds are expended for construction, 18 
reconstruction, or rehabilitation of a transportation facility by the Department or of a 19 
transportation facilities project by the Maryland Transportation Authority; or 20 
 
 (ii) Capital equipment, as defined by the Secretary. 21 
 
 (4) “Major capital project” means any new, expanded, or significantly 22 
improved facility or service that involves planning, environmental studies, design,  23 
right–of–way, construction, or purchase of essential equipment related to the facility or 24 
service. 25

ESTIMATES OF A MAJOR HIGHWAY CAPACITY EXP ANSION PROJECT ’S: 15 
 
 (I) QUANTITATIVE NET CHAN GE IN: 16 
 
 1. GREENHOUSE GAS EMISSI ONS FOR THE SIXTH YE AR 17 
AFTER THE PROJECT IS COMPLETE; AND 18 
 
 2. VEHICLE MILES TRAVELE D IN THE PROJECT ARE A 19 
FOR THE SIXTH YEAR A FTER THE PROJECT IS COMPLETE; AND 20 
 
 (II) IMPACT ON GREENHOUSE GAS EMISSIONS AND VE HICLE 21

IMPROVEMENT PROGRAM OR THE CONSOLIDATED TRANSPORTATION PROGRAM. 7 
 
 (2) A METROPOLITAN PLANNIN G ORGANIZATION SHALL : 8 
 
 (I) PERFORM AN IMPACT ASS ESSMENT FOR A MAJOR HI GHWAY 9 
CAPACITY EXPANSION P ROJECT BEFORE THE PR OJECT MAY BE CONSIDE RED FOR 10 
INCLUSION IN A METROPOLITAN PLANNING ORGANIZATION TRANSPORTATION 11 
IMPROVEMENT PROGRAM; AND 12 
 
 (II) SUBMIT AN IMPACT ASSE SSMENT PERFORMED UND ER THIS 13 
SECTION TO THE DEPARTMENT FOR REVIEW AND APPROVAL . 14 
 
 (B) THE DEPARTMENT SHALL USE THE INFORMATION COLL ECTED IN THE 15 
IMPACT ASSESSMENT RE QUIRED IN SUBSECTION (A) OF THIS SECTION TO 16 
DETERMINE WHETHER A MAJOR HIGHWAY CAPACI TY EXPANSION PROJECT MEETS 17 
THE FOLLOWING REQUIR EMENTS: 18 
 
 (1) THE PROJECT WILL NOT INCREASE GREENHOUSE GAS EMISSIONS; 19 
 
 (2) THE PROJECT WILL NOT INCREASE VEHICLE MIL ES TRAVELED; 20 
 
 (3) THE PROJECT CONFORMS 	WITH THE GREENHOUSE GAS 21 
EMISSIONS REDUCTION TARGETS SPECIFIED IN § 2–1205 OF THE ENVIRONMENT 22 
ARTICLE; AND 23 
 
 (4) THE PROJECT CONFORMS WITH THE VEHICLE MIL ES TRAVELED 24 
REDUCTION TARGETS SP ECIFIED IN THE 2024 ANNUAL ATTAINMENT REPORT ON 25 
TRANSPORTATION SYSTEM PERFORMANCE . 26 
 
 (C) (1) IF THE DEPARTMENT DETERMINES THAT A MAJOR HIGHWAY 27 
CAPACITY EXPANSION P ROJECT DOES NOT SATISFY EAC H REQUIREMENT SPECIF IED 28 
IN SUBSECTION (B) OF THIS SECTION , THE DEPARTMENT OR , FOR AN IMPACT 29 
ASSESSMENT PERFORMED BY A METROPOLITAN PL ANNING ORGANIZATION , THE 30 
METROPOLITAN PLANNIN G ORGANIZATION SHALL : 31  8 	SENATE BILL 681

SUBTITLE, THE DEPARTMENT OR A METRO POLITAN PLANNING ORG ANIZATION 18 
SHALL DEVELOP AND IM PLEMENT A MITIGATION PLAN TO ELIMINATE TH E NET 19 
INCREASE IN GREENHOU SE GAS EMISSIONS OR VEHI CLE MILES TRAVELED . 20 
 
 (B) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , A MITIGATION 21 
PLAN DEVELOPED UNDER THIS SECTION SHALL I NCLUDE ONE OR MORE O F THE 22 
FOLLOWING MITIGATION ACTIONS: 23 
 
 (I) TRANSIT EXPANSION , INCLUDING: 24

 (III) PROCEDURES ARE ESTABL ISHED TO ENSURE THAT THE 13 
MITIGATION ACTION CO NFORMS WITH THE REQU IREMENTS UN DER § 2–904(B) OF 14 
THIS SUBTITLE. 15 
 
 (C) (1) THE BENEFITS PROVIDED BY A MITIGATION ACTI ON SHALL FOCUS 16 
ON AREAS IN THE FOLL OWING ORDER OF PRIOR ITY: 17 
 
 (I) OVERBURDENED COMMUNIT IES OR UNDERSERVED 18 
COMMUNITIES IMPACTED BY THE MAJOR HIGHWAY CAPACITY EXPANSION PROJECT; 19 
 
 (II) AREAS WITHIN OR ASSOC IATED WITH AT LEAST ONE OF THE 20 
COMMUNITIES IMPACTED BY THE PROJECT ; 21 
 
 (III) OVERBURDENED COMMUNIT IES OR UNDERSERVED 22 
COMMUNITIES ; 23 
 
 (IV) THE REGION IN WHICH T HE MAJOR HIGHWAY CAP ACITY 24 
EXPANSION PROJECT IS LOCATED; OR 25 
 
 (V) BENEFITS TO THE ENTIR E STATE. 26

 (2) (I) THE DEPARTMENT SHALL APPR OVE A MITIGATION PL AN IF 7 
THE DEPARTMENT DETERMINES THAT THE MITIGATION PLAN COMPLIES WITH T HIS 8 
SECTION AND THE REQU IREMENTS UNDER § 2–904(B) OF THIS SUBTITLE. 9 
 
 (II) THE DEPARTMENT OF THE ENVIRONMENT SHALL DEV ELOP 10 
A METHODOLOGY FOR TH E DEPARTMENT TO DETERMI NE IF A MITIGATI ON PLAN 11 
FOR A MAJOR HIGHWAY CAPACITY EXPANSION P ROJECT IS SUFFICIENT FOR 12
