AN ACT concerning 1 
 
Community Development Administration – Live Near Your School Program – 2 
Funding and Extension 3 
 
FOR the purpose of requiring the Governor, for certain fiscal years, to include in the annual 4 
budget bill an appropriation for the Live Near Your School program in the 5 
Community Development Administration; extending the termination date for the 6 
program; and generally relating to the Live Near Your School program. 7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 21 
That the Laws of Maryland read as follows: 22 
 
Article – Housing and Community Development 23

 (a) In this title the following words have the meanings indicated. 1 
 
 (b) “Administration” means the Community Development Administration. 2 
 
4–217. 3 
 
 (a) A project, undertaking, or a part of a project or undertaking, including the 4 
real, personal, and mixed property involved, qualifies as a community development project 5 
if it is planned, acquired, owned, developed, constructed, reconstructed, rehabilitated, 6 
repaired, renovated, or improved to promote sound community development. 7 
 
 (b) A community development project shall provide for: 8 
 
 (1) new or existing housing: 9 
 
 (i) that is or will be occupied in substantial part by families of 10 
limited income; or 11 
 
 (ii) at least 20% of which is or will be occupied by families of limited 12 
income, if the project is financed with bonds, notes, or other evidences of indebtedness 13 
issued by the Administration, the income from which being includable in the holder’s gross 14 
income under the Internal Revenue Code as determined by the Administration at the time 15 
of issue; 16 
 
 (2) any improvements, such as streets, roads, sewer lines, and water lines 17 
that are needed to support the housing; and 18 
 
 (3) the public or private commercial, educational, cultural, recreational, 19 
community, or civic facilities that are needed to support the housing. 20 
 
 (e) (1) (i) In this subsection the following words have the meanings 21 
indicated. 22 
 
 (ii) “Current student” means an individual who: 23 
 
 1. attends a public institution of higher education in the 24 
State; and 25 
 
 2. is a degree–seeking, full–time equivalent student in an 26 
undergraduate level, graduate level, or professional degree program. 27 
 
 (iii) “Public institution of higher education” has the meaning stated 28 
in § 10–101 of the Education Article. 29

 (iv) “Recent graduate” means an individual who, within 5 years 1 
before applying for assistance under this section, graduated from a public institution of 2 
higher education in the State with at least: 3 
 
 1. 120 credits in an undergraduate level program; or 4 
 
 2. 30 credits in a graduate level or professional degree 5 
program. 6 
 
 (2) The Administration may administer community development projects 7 
that: 8 
 
 (i) are in sustainable communities approved under § 6–305 of this 9 
article; and 10 
 
 (ii) provide current students and recent graduates with financial 11 
assistance in the form of grants to buy homes near the school of the student or graduate. 12 
 
 (3) A community development project administered under this subsection 13 
is not subject to the provisions of subsection (b)(1) of this section that require part of the 14 
housing to be occupied by families of limited income. 15 
 
 (4) The community development projects administered under this 16 
subsection shall be known as the Live Near Your School program. 17 
 
 (5) The Administration shall adopt regulations to implement the Live Near 18 
Your School program established under this subsection. 19 
 
 (6) FOR FISCAL YEARS 2026 THROUGH 2030, EACH YEAR THE 20 
GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDGET BILL AN APPROPRIATIO N OF 21 
$200,000 FOR THE LIVE NEAR YOUR SCHOOL PROGRAM ESTABLISHED U NDER THIS 22 
SUBSECTION. 23 
 
Chapter 247 of the Acts of 2021 24 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 25 
October 1, 2021. It shall remain effective for a period of [3] 9 years and, at the end of 26 
September 30, [2024] 2030, this Act, with no further action required by the General 27 
Assembly, shall be abrogated and of no further force and effect. 28 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 29 
1, 2024. 30
