BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 That the Laws of Maryland read as follows: 16 Article – Local Government 17 1–1321. 18 (A) IN THIS SECTION , “RETAILER” MEANS A PERSON ENGAGED IN THE 19 RETAIL SALE OF GOODS . 20 (B) THIS SECTION APPLIES TO EACH COUNTY AND MUNICIPALIT Y. 21 (C) IF A COUNTY OR MUNICIPALITY ENACTS A LOCAL LAW T HAT 22 AUTHORIZES OR REQUIR ES A RETAILER TO CHARGE A FEE AT THE POINT OF SALE 23 2 HOUSE BILL 1067 FOR PROVIDING A PLASTIC OR PAPER C ARRYOUT BAG TO A CUS TOMER, THE 1 RETAILER MAY NOT CHARGE THE FEE FOR ANY TRANSACTION FOR WHICH THE 2 CUSTOMER MAKES A PURCHASE USING A FORM OF PAYMENT ISSUED AS PART OF : 3 (1) THE FEDERAL SUPPLEMENTAL NUTRITION ASSISTANCE 4 PROGRAM; OR 5 (2) THE FEDERAL SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR 6 WOMEN, INFANTS, AND CHILDREN. 7 SECTION 2.
