Local Government – Fee for Plastic and Paper Carryout Bags – Prohibition on 2
Charge 3
FOR the purpose of prohibiting certain retailers that are authorized or required by a local 4
law to charge a fee to a customer for a plastic or paper carryout bag from charging 5
the fee if the customer’s form of payment uses federal Supplemental Nutrition 6
Assistance Program or federal Special Supplemental Food Program for Women, 7
Infants, and Children benefits; and generally relating to local fees for plastic and 8
paper carryout bags. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15

RETAIL SALE OF GOODS . 20

(C) IF A COUNTY OR MUNICIPALITY ENACTS A LOCAL LAW T HAT 22
AUTHORIZES OR REQUIR ES A RETAILER TO CHARGE A FEE AT THE POINT OF SALE 23 2 HOUSE BILL 1067
FOR PROVIDING A PLASTIC OR PAPER C ARRYOUT BAG TO A CUS TOMER, THE 1
RETAILER MAY NOT CHARGE THE FEE FOR ANY TRANSACTION FOR WHICH THE 2
CUSTOMER MAKES A PURCHASE USING A FORM OF PAYMENT ISSUED AS PART OF : 3
(1) THE FEDERAL SUPPLEMENTAL NUTRITION ASSISTANCE 4
PROGRAM; OR 5
(2) THE FEDERAL SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR 6
WOMEN, INFANTS, AND CHILDREN. 7
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 8
October 1, 2025. 9
