AN ACT concerning 1
Higher Education – Private Career Schools – Advertising 2
FOR the purpose of authorizing certain private career schools to advertise certain 3
information and collect certain contact information before receiving a certificate of 4
approval from the Maryland Higher Education Commission to operate a private 5
career school in the State; and generally relating to private career schools. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17
That the Laws of Maryland read as follows: 18

(a) In this division the following words have the meanings indicated. 21
(j) “Private career school” means a privately owned and privately operated 22
institution of postsecondary education other than an institution of higher education that 23
furnishes or offers to furnish programs, whether or not requiring a payment of tuition or 24 2 HOUSE BILL 1138
fee, for the purpose of training, retraining, or upgrading individuals for gainful employment 1
as skilled or semiskilled workers or technicians in recognized occupations or in new and 2
emerging occupations. 3

(A) A PRIVATE CAREER SCHOO L MAY ADVERTISE AND COLLECT CONTACT 5
INFORMATION FOR POTENTIAL NEW STUDEN TS BEFORE RECEIVING A C ERTIFICATE 6
OF APPROVAL TO OPERA TE IN THE STATE IF: 7
(1) THE PRIVATE CAREER SC HOOL HAS: 8
(I) COMPLETED A MARKET SURVEY ; 9
(II) SECURED A LEASE OR OWNS A PROP ERTY FOR THE SCHOOL 10
BUILDING; 11
(III) COMPLETED ANY NECESSA RY CONSTRUCTION , 12
RENOVATIONS , OR MODIFICATIONS TO THE SCHOOL BUILDI NG; AND 13
(IV) OBTAINED ALL EQUIPMENT AND PERMIT S, EXCEPT FOR THE 14
CERTIFICATE OF APPRO VAL, NECESSARY FOR OPERAT ING THE PRIVATE CARE ER 15
SCHOOL; 16
(2) THE PRIVATE CAREER SC HOOL IS LIKELY TO BE ISSUED A 17
CERTIFICATE OF APPRO VAL FROM THE COMMISSION; AND 18
(3) THE REQUEST TO BEGIN ADVERTISING IS APPRO VED BY THE 19
SECRETARY. 20
(B) ADVERTISING FOR A PRI VATE CAREER SCHOOL A PPROVED UNDER 21
SUBSECTION (A) OF THIS SECTION: 22
(1) MAY CONTAIN INFORMATI ON RELATING TO THE O PENING OF THE 23
PRIVATE CAREER SCHOOL, INCLUDING THE ANTICIPATED DATE OF OPENING , 24
PROGRAMS OF INSTRUCT ION, AND THE APPLICATION PROC ESS; AND 25
(2) SHALL DISCLOSE THAT T HE PRIVATE CAREER SC HOOL IS 26
PENDING APPROVAL . 27
(C) THE SECRETARY SHALL ADOPT REGULATIONS SPECIFYI NG THE 28
PROCESS FOR APPROVAL TO ADVERTISE A PRIVATE CAREER SCHOO L UNDER THIS 29
SECTION. 30

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 1
1, 2025. 2
