AN ACT concerning 1 
 
Employed Individuals With Disabilities Program – Upper Age Limit – 2 
Prohibition 3 
 
FOR the purpose of prohibiting the Maryland Department of Health from establishing an 4 
upper age limit on eligibility to receive Employed Individuals with Disabilities 5 
Program services; and generally relating to the Employed Individuals with 6 
Disabilities Program. 7 
 
BY repealing and reenacting, without amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – Health – General 20 
 
15–138. 21 
 
 (a) (1) In this section the following words have the meanings indicated. 22 
 
 (2) “EID Program” means the Employed Individuals with Disabilities 23 
Program operated under the Maryland Medical Assistance Program. 24  2 	HOUSE BILL 430  
 
 
 
 (b) The Department shall provide health care services for individuals under the 1 
EID Program in accordance with this section. 2 
 
 (e) The Department may not: 3 
 
 (1) Limit eligibility to receive EID Program services based on: 4 
 
 (i) The earned or unearned income of the applicant or the 5 
applicant’s spouse; 6 
 
 (ii) Any assets or resources of the applicant’s or recipient’s spouse 7 
that are not joint assets for a recipient; 8 
 
 (iii) Any retirement account assets or resources for an applicant or a 9 
recipient; or 10 
 
 (iv) Any assets or resources in an independence account established 11 
for a recipient of EID Program services; [or] 12 
 
 (2) Establish as a prerequisite for eligibility to receive EID Program 13 
services that an applicant apply for Social Security Disability Insurance benefits when the 14 
applicant does not receive the benefits and has earnings that are above the substantial 15 
gainful activity level established by the Social Security Administration; OR 16 
 
 (3) ESTABLISH AN UPPER AG E LIMIT ON ELIGIBILI TY TO RECEIVE 17 
EID PROGRAM SERVICES . 18 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 19 
October 1, 2025. 20
