A BILL ENTITLED 
 
AN ACT concerning 1 
 
Condominiums and Homeowners Associations – Governing Documents – 2 
Electric Vehicle Recharging Equipment 3 
 
FOR the purpose of prohibiting provisions of the governing documents of a condominium 4 
or homeowners association from unreasonably restricting the governing body of the 5 
condominium or homeowners association from installing or authorizing the 6 
installation of electric vehicle recharging equipment; establishing that the 7 
installation or authorization of installation of electric vehicle charging equipment by 8 
a governing body is subject to the ordinary budget processes of the condominium or 9 
homeowners association and requiring the governing bo dy to consider the 10 
availability of sufficient parking to meet the needs of the community before 11 
installation or authorization; applying this Act retroactively; authorizing the 12 
governing body of a condominium or homeowners association to grant a certain 13 
license; and generally relating to electric vehicle recharging equipment in 14 
condominiums and homeowners associations. 15

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 21 
That the Laws of Maryland read as follows: 22

 (A) IN THIS SECTION, “ELECTRIC VEHICLE REC HARGING EQUIPMENT ” HAS 1 
THE MEANING STATED I N § 11–111.4 OF THIS TITLE. 2 
 
 (B) A RECORDED COVENANT OR RESTRICTION, A PROVISION IN A 3 
DECLARATION , OR A PROVISION IN TH E BYLAWS OR RULES OF A CONDOMINIUM MAY 4 
NOT PROHIBIT OR UNRE ASONABLY RESTRICT THE GOVERNING BODY F ROM 5 
INSTALLING OR AUTHOR IZING THE INSTALLAT ION OF ELECTRIC VEHI CLE 6 
RECHARGING EQUIPMENT IN COMMON USE OR LIM ITED COMMON USE PARK ING 7 
SPACES. 8 
 
 (C) THE INSTALLATION OR A UTHORIZATION OF INST ALLATION OF 9 
ELECTRIC VEHICLE REC HARGING EQUIPMENT BY A GOVERNING BODY SHA LL BE 10 
SUBJECT TO THE ORDIN ARY BUDGET PR OCESS OF THE CONDOMI NIUM. 11 
 
 (D) A GOVERNING BODY SHALL CONSIDER THE AVAILAB ILITY OF 12 
SUFFICIENT PARKING TO MEET THE NEEDS OF TH E COMMUNITY BEFORE 13 
INSTALLING OR AUTHOR IZING THE INSTALLATI ON OF ELECTRIC VEHIC LE 14 
RECHARGING EQUIPMENT IN COMMON USE OR LIM ITED COMMON USE PARK ING 15 
SPACES. 16 
 
 (E) NOTWITHSTANDING THE P ROVISIONS OF § 11–125 OF THIS TITLE, THE 17 
GOVERNING BODY MAY G RANT A LICENSE FOR U P TO 3 YEARS, RENEWABLE AT THE 18 
DISCRETION OF THE GO VERNING BODY , ON ANY COMMON ELEMEN T NECESSARY FOR 19 
THE INSTALLATION OF EQUIPMENT OR FOR THE SUPPLY OF ELECTRICIT Y TO ANY 20 
ELECTRIC VEHICLE REC HARGING EQUIPMENT . 21

ELEMENT NECESSARY F OR THE INSTALLATION OF EQUIPMENT OR FOR THE SUPPLY 7 
OF ELECTRICITY TO AN Y ELECTRIC VEHICLE R ECHARGING EQUIPMENT . 8 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be construed to 9 
apply retroactively and shall be applied to and interpreted to affect any covenant or 10 
restriction, or provision in a declaration, bylaws, or rules, recorded or adopted before the 11 
effective date of this Act. 12 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 13 
October 1, 2025. 14
