AN ACT concerning 1 
 
County Boards of Education – Special Education Service Delivery Models – 2 
Publication Requirement 3 
 
FOR the purpose of requiring each county board of education to publish on its website a 4 
certain list of special education service delivery models provided for  5 
parentally–placed private school students; and generally relating to publication 6 
requirements regarding special education programs and county boards of education. 7 
 
BY repealing and reenacting, with amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13 
That the Laws of Maryland read as follows: 14 
 
Article – Education 15

 (A) (1) IN THIS SECTION , “PARENTALLY –PLACED PRIVATE SCHOO L 17 
STUDENT” MEANS A CHILD WITH A DISABILITY ENROLLED BY THE PARENT OR 18 
GUARDIAN OF THE CHILD IN A PRIVATE ELEMENTARY OR SECOND ARY SCHOOL OR 19 
FACILITY, INCLUDING A RELIGIOU S SCHOOL OR FACILITY , IN ACCORDANCE WITH 20 20 
U.S.C. § 1412(A)(10)(A). 21 
 
 (2) “PARENTALLY–PLACED PRIVATE SCHOO L STUDENT” DOES NOT 22 
INCLUDE A CHILD WITH A DISABILITY WHO WAS PLACED IN OR REFERRE D TO A 23  2 	HOUSE BILL 702  
 
 
PRIVATE SCHOOL OR FACILITY BY A PUBLIC AGENCY AS A MEANS OF PROVIDING 1 
SPECIAL EDUCATION AN D RELATED SERVICES UNDER § 8–406 OF THIS SUBTITLE. 2 
 
 [(a)] (B) (1) Each county board shall develop and publish on its website a list 3 
of all special education service delivery models [in]: 4 
 
 (I) IN the local school system; AND 5 
 
 (II) PROVIDED TO PARENTALLY –PLACED PRIVATE SCHOOL 6 
STUDENTS WITHIN THE JURISDICT ION OF THE LOCAL SCH OOL SYSTEM. 7 
 
 (2) The county board shall clearly state that all decisions regarding the 8 
placement of a child with a disability in a special education service delivery model under 9 
paragraph [(1)] (1)(I) of this subsection will be made by an individualized education 10 
program team in consultation with the parents or guardians of the child and consistent 11 
with the least restrictive environment requirements of the federal Individuals with 12 
Disabilities Education Act. 13 
 
 [(b)] (C) On request, the county board shall provide a written copy of the 14 
information provided under subsection [(a)] (B) of this section. 15 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 16 
1, 2025. 17
