AN ACT concerning 1 
 
Vehicle Laws – Licenses, Identification Cards, and Moped Operator’s Permits – 2 
Notation of Nonapparent Disability 3 
(Eric’s ID Law) 4 
 
FOR the purpose of requiring that certain applications for a license, an identification card, 5 
or a moped operator’s permit allow an applicant to choose to indicate on the 6 
document the applicant’s nonapparent disability; requiring the Motor Vehicle 7 
Administration to ensure that the license, identification card, or moped operator’s 8 
permit of an applicant who indicates that the applicant has a nonapparent disability 9  2 	HOUSE BILL 707  
 
 
includes a certain notation; requiring the Administration to delete a certain record 1 
about an applicant’s nonapparent disability notation under certain circumstances; 2 
requiring the Administration to establish certain public outreach efforts on the 3 
availability of the notation; prohibiting the Administration from disclosing certain 4 
information to in a certain entities manner under certain circumstances about an 5 
applicant that indicates that the applicant has a nonapparent disability; and 6 
generally relating to nonapparent disability notations on licenses, identification 7 
cards, and moped operator’s permits. 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 
That the Laws of Maryland read as follows: 20 
 
Article – Transportation 21 
 
11–128. 22 
 
 (a) “License”, as used in reference to the operation of a motor vehicle, means any: 23 
 
 (1) Driver’s license; and 24 
 
 (2) Any other license or permit to drive a motor vehicle that is issued under 25 
or granted by the laws of this State, including: 26 
 
 (i) Any temporary license; 27 
 
 (ii) A learner’s instructional permit; 28 
 
 (iii) A provisional license; 29 
 
 (iv) The privilege of any individual to drive a motor vehicle, whether 30 
or not that individual is formally licensed by this or any other jurisdiction; 31 
 
 (v) Any nonresident’s privilege to drive, as defined in this subtitle; 32 
and 33

 (vi) A commercial driver’s license. 1 
 
 (b) “License” does not include an electronic credential issued under Title 16, 2 
Subtitle 10 of this article. 3

 (a) (1) “Motor vehicle” means, except as provided in subsection (b) of this 5 
section, a vehicle that: 6 
 
 (i) Is self–propelled or propelled by electric power obtained from 7 
overhead electrical wires; and 8 
 
 (ii) Is not operated on rails. 9 
 
 (2) “Motor vehicle” includes a low speed vehicle. 10 
 
 (b) “Motor vehicle” does not include: 11 
 
 (1) A moped, as defined in § 11–134.1 of this subtitle; 12 
 
 (2) A motor scooter, as defined in § 11–134.5 of this subtitle; 13 
 
 (3) An electric bicycle, as defined in § 11–117.1 of this subtitle; 14 
 
 (4) An electric low speed scooter, as defined in § 11–117.2 of this subtitle; 15 
or 16 
 
 (5) A personal delivery device, as defined in § 21–104.5 of this article. 17

 (A) (1) IN THIS SECTION , “NONAPPARENT DISABILI TY” MEANS A 19 
DISABILITY OR HEALTH CONDITION THAT IS NO T IMMEDIATELY OBVIOU S OR 20 
VISIBLE. 21 
 
 (2) “NONAPPARENT DISABILITY ” INCLUDES: 22 
 
 (I) DEVELOPMENTAL DISABIL ITIES; AND 23 
 
 (II) INTELLECTUAL DISABILI TIES. 24 
 
 (B) AN INITIAL AND A RENE WAL APPLICATION FOR A LICENSE, AN 25 
IDENTIFICATION CARD , OR A MOPED OPERATOR ’S PERMIT SHALL ALLOW AN 26 
APPLICANT TO CHOOSE TO INDICATE ON THE DOCU MENT THAT THE APPLICANT HAS 27 
A NONAPPARENT DISABI LITY. 28  4 	HOUSE BILL 707  
 
 
 
 (C) THE ADMINISTRATION SHALL : 1 
 
 (1) ENSURE THAT THE LICEN SE, IDENTIFICATION CARD , OR MOPED 2 
OPERATOR’S PERMIT OF AN APPLI CANT WHO HAS INDICAT ED A NONAPPARENT 3 
DISABILITY ON AN APP LICATION INCLUDES A NO TATION OF THE NONAPP ARENT 4 
DISABILITY ON THE BO TTOM OF THE LICENSE , IDENTIFICATION CARD , OR MOPED 5 
OPERATOR’S PERMIT; 6 
 
 (2) CONSULT WITH DEVELOPM	ENTAL DISABILITY AND 7 
INTELLECTUAL DISABIL ITY ADVOCACY GROUPS WITH RESPECT TO THE DESIGN OF 8 
THE NONAPPARENT DISAB ILITY NOTATION; 9 
 
 (3) NOTIFY AN INDIVIDUAL WITH A NONAPPARENT D ISABILITY 10 
NOTATION ON A LICENS E, IDENTIFICATION CARD , OR MOPED OPERATOR ’S PERMIT 11 
THAT TURNS 18 YEARS OF AGE THAT TH E INDIVIDUAL MAY REQ UEST THAT THE 12 
NONAPPARENT DISABILI TY NOTATION BE REMOVED ; AND 13 
 
 (4) DELETE ANY RECORD OF AN INDIVIDUAL ’S NONAPPARENT 14 
DISABILITY NOTATION ON REQUEST BY THE IN DIVIDUAL AT ANY TIME ; AND 15 
 
 (5) ESTABLISH PUBLIC OUTR EACH EFFORTS TO EDUC ATE THE 16 
GENERAL PUBLIC ON TH E AVAILABILITY OF TH E NONAPPARENT DISABILITY 17 
NOTATION. 18 
 
 (D) THERE IS NO FEE FOR A NONAPPARENT DISABILI TY NOTATION ON A 19 
LICENSE, IDENTIFICATION CARD , OR MOPED OPERATOR ’S PERMIT, INCLUDING FOR 20 
THE ISSUANCE OF A CO RRECTED DOCUMENT IF NO OTHER CORRECTIONS ARE MADE. 21 
 
 (E) THE ADMINISTRATION M AY NOT: 22 
 
 (1) REQUIRE AN APPLICANT FOR A LICENSE , AN IDENTIFICATION 23 
CARD, OR A MOPED OPERATOR ’S PERMIT TO PROVIDE PROOF OF THE APPLICA NT’S 24 
NONAPPARENT DISABILI TY; 25 
 
 (2) DENY AN APPLICATION F OR A LICENSE , AN IDENTIFICATION 26 
CARD, OR A MOPED OPERATOR ’S PERMIT BECAUSE THE NONAP PARENT DISABILITY 27 
SELECTED BY THE APPL ICANT DOES NOT MATCH THE NONAPPARENT DISA BILITY 28 
INDICATED ON ANOTHER DOCUMENT ASSOCIATED WITH THE APPLICANT ; 29 
 
 (3) NOTWITHSTANDING § 4–320 OF THE GENERAL PROVISIONS 30 
ARTICLE AND EXCEPT AS PROVID ED IN SUBSECTION (F) OF THIS SECTION, DISCLOSE 31 
FOR ANY USE WITHOUT A COURT ORDER INFORMATION RELATED TO AN 32 
APPLICANT’S INDICATION: 33   	HOUSE BILL 707 	5 
 
 
 
 (I) INDICATION OF A NONAPPARENT DIS ABILITY ON AN 1 
APPLICATION FOR A LI CENSE, AN IDENTIFICATION CA RD, OR A MOPED OPERATOR ’S 2 
PERMIT FOR ANY USE IN RESPONSE TO A REQUES T FROM AN INSURANCE COMPANY 3 
OR THE MARYLAND INSURANCE ADMINISTRATION ; OR 4 
 
 (II) REQUEST TO REMOVE AN INDICATION OF A NONAPPAR ENT 5 
DISABILITY FROM A LI CENSE, AN IDENTIFICATION CA RD, OR A MOPED OPERATOR ’S 6 
PERMIT; OR  7 
 
 (4) USE INFORMATION DISCL OSED BY A PERSON UND ER THIS 8 
SECTION AS A BASIS F OR REFERRING THE PER SON TO THE MEDICAL ADVISORY 9 
BOARD UNDER § 16–118 OF THIS ARTICLE. 10 
 
 (F) THE ADMINISTRATION MAY MA KE INFORMATION DESCR IBED IN 11 
SUBSECTION (E)(3) OF THIS SECTION AVAILABLE TO:  12 
 
 (1) A COURT;  13 
 
 (2) A CRIMINAL JUSTICE AGE NCY;  14 
 
 (3) A DRIVER LICENSING AUT HORITY;  15 
 
 (4) THE APPLICANT;  16 
 
 (5) THE APPLICANT’S ATTORNEY;  17 
 
 (6) ANY THIRD PARTY DESIG NATED BY THE APPLICA NT; OR 18 
 
 (7) THE CHILD SUPPORT ADMINISTRATION . 19 
 
 (G) THE MARYLAND POLICE TRAINING AND STANDARDS COMMISSION, IN 20 
CONSULTATION WITH TH E DEPARTMENT OF STATE POLICE AND OTHER 21 
INTERESTED STAKEHOLD ERS, SHALL IMMEDIATELY IMPLEMENT TRAINING 22 
CONCERNING INTERACTI ONS WITH INDIVIDUALS WHO HAVE A NONAPPARE NT 23 
DISABILITY NOTATION ON THEIR LICENSE , IDENTIFICATION CARD , OR MOPED 24 
OPERATOR’S PERMIT. 25 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 26 
October 1, 2025.  27
