AN ACT concerning 1 
 
Department of Information Technology – Reporting Guidelines 2 
 
FOR the purpose of altering the content of certain reports by the Department of 3 
Information Technology relating to the Information Technology Investment Fund; 4 
requiring the reports to be written and structured in a certain manner and made 5 
publicly available on the Department’s website; and generally relating to reporting 6 
by the Department of Information Technology.  7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – State Finance and Procurement 20 
 
3.5–309. 21 
 
 (a) There is an Information Technology Investment Fund. 22 
  2 	HOUSE BILL 738  
 
 
 (n) (1) On or before [November] OCTOBER 1 of each year, the Secretary shall 1 
report to the Governor and the Secretary of Budget and Management and, in accordance 2 
with § 2–1257 of the State Government Article, to the Senate Budget and Taxation 3 
Committee, the Senate Committee on Education, Energy, and the Environment, the House 4 
Appropriations Committee, the House Health and Government Operations Committee, and 5 
the Joint Committee on Cybersecurity, Information Technology, and Biotechnology. 6 
 
 (2) The report shall include: 7 
 
 (i) the financial status of the Fund and a summary of its operations 8 
for the preceding fiscal year; 9 
 
 (ii) an accounting for the preceding fiscal year of all money from each 10 
of the revenue sources specified in subsection (e) of this section, including any expenditures 11 
made from the Fund; and 12 
 
 (iii) for each project receiving money from the Fund in the preceding 13 
fiscal year and for each major information technology development project or expedited 14 
project receiving funding from any source other than the Fund in the preceding fiscal year: 15 
 
 1. A BRIEF DESCRIPTION OF THE PROJECT , INCLUDING 16 
MAJOR CUSTOMERS AND INTERDEPENDENCIES WI TH OTHER SYSTEMS ;  17 
 
 2. AN ANALYSIS OF HOW T HE PROJECT GOALS PRO VIDE 18 
AN ADVANTAGE OVER CU RRENT AGENCY OPERATI ONS, INCLUDING A DESCRIPT ION 19 
OF KEY PROJECT GOALS , CRITICAL SUCCESS FACTORS , HOW THE PROJECT 20 
SUPPORTS THE BUSINES S PROCESS, AND WHETHER THE SUCC ESSFUL PROJECT 21 
WILL PROVIDE A BASIS FOR A FUTURE PROJECT AT THE SAME OR ANY O THER UNIT 22 
OF STATE GOVERNMENT ;  23 
 
 3. A DESCRIPTION OF TEC HNOLOGIES EMPLOYED I N 24 
THE PROJECT;  25 
 
 4. AN ASSESSMENT OF THE VENDOR POOL OF LIKEL Y 26 
BIDDERS OR OFFERORS ;  27 
 
 5. A DESCRIPTION OF THE PROCESS USED TO DEVE LOP 28 
THE PROJECT;  29 
 
 6. AN OVERVIEW OF THE P	ROJECT SCHEDULE , 30 
INCLUDING ANY INTERM EDIATE PROJECT DEADL INES;  31 
 
 [1.] 7.  the status of the project and project funding 32 
decisions; 33

 [2.] 8.  a comparison of estimated and actual costs of the 1 
project; 2 
 
 [3.] 9.  any known or anticipated changes in scope or costs 3 
of the project; 4 
 
 10. A DESCRIPTION OF ANY ONGOING OPERATING 5 
EXPENSES AS A RESULT OF THE PROJECT AND A TIMELINE OF WHEN THO SE COSTS 6 
WILL BE INCURRED ;  7 
 
 [4.] 11. an evaluation of whether the project is using best 8 
practices; and 9 
 
 [5.] 12. a summary of any monitoring and oversight of the 10 
project from outside the agency in which the project is being developed, including a 11 
description of any problems identified by any external review and any corrective actions 12 
taken. 13 
 
 (3) THE REPORT SUBMITTED UNDER THIS SUBSECTIO N SHALL BE: 14 
 
 (I) WRITTEN, AS PRACTICABLE , IN A MANNER THAT IS CLEAR, 15 
CONCISE, AND WELL–ORGANIZED AND AVOIDS TECHNICAL JARGON ;  16 
 
 (II) STRUCTURED TO INCLUD E AN EXECUTIVE SUMMA RY OF KEY 17 
INFORMATION THAT HIG HLIGHTS ACTION ITEMS AND DECISION POINTS ; AND 18 
 
 (III) MADE PUBLIC LY AVAILABLE ON THE DEPARTMENT ’S 19 
WEBSITE. 20 
 
 (o) (1) On or before January 15 of each year, for each major information 21 
technology development project or expedited project currently in development or for which 22 
operations and maintenance funding is being provided in accordance with subsection (i)(3) 23 
of this section, subject to § 2–1257 of the State Government Article, the Secretary shall 24 
provide a summary report to the Department of Legislative Services with the most  25 
up–to–date project information including: 26 
 
 [(1)] (I) project funding decisions and project status, INCLUDING:  27 
 
 1. ANNUAL DEVELOPMENT C OSTS;  28 
 
 2. FUNDING SOURCES ; AND 29 
 
 3. ONGOING OPERATING CO STS, INCLUDING LICENSES 30 
AND SUPPORT TO MAINT AIN AND UPDATE THE S YSTEM; 31

 [(2)] (II) any schedule, cost, and scope changes since the [last annual] 1 
report REQUIRED UNDER SUBSE CTION (N) OF THIS SECTION WAS SUBMITTED; 2 
 
 [(3)] (III) a risk assessment THAT GIVES A DETAILE D DESCRIPTION OF 3 
THE RISK IDENTIFIED , including:  4 
 
 1. TYPE OF RISK IDENTIF IED, INCLUDING AGENCY 5 
GOVERNANCE , STAFF RESOURCE AVAIL ABILITY OR TRAINING , FUNDING, 6 
INTERDEPENDENCIES WI TH OTHER SYSTEMS , TECHNICAL ISSUES , 7 
ORGANIZATIONAL CULTU RE, OR LONG–TERM SUPPORTABILITY ; AND 8 
 
 2. any problems identified by any internal or external review 9 
and any corrective actions taken; [and] 10 
 
 (IV) PROJECT TRACKING MET RICS, INCLUDING:  11 
 
 1. PROJECT DEADLINES AN	D ASSOCIATED 12 
DELIVERABLES ; AND 13 
 
 2. A DESCRIPTION OF ANY CHANGES IN SCOPE , 14 
TIMELINE, AND COSTS; AND 15 
 
 [(4)] (V) any change in the monitoring or oversight status. 16 
 
 (2) THE REPORT SUBMITTED UNDER THIS SUBSECTIO N SHALL BE: 17 
 
 (I) WRITTEN, AS PRACTICABLE , IN A MANNER THAT IS CLEAR, 18 
CONCISE, AND WELL–ORGANIZED AND AVOIDS TECHNICAL JARGON ;  19 
 
 (II) STRUCTURED TO INCLUD E AN EXECUTIVE SU MMARY OF KEY 20 
INFORMATION THAT HIG HLIGHTS ACTION ITEMS AND DECISION POINTS ; AND 21 
 
 (III) MADE PUBLICLY AVAILA BLE ON THE DEPARTMENT ’S 22

 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 24 
1, 2025. 25
