FOR the purpose of authorizing the Board of License Commissioners for Baltimore City to 4
issue a Class C beer, wine, and liquor license in a certain area of the 45th alcoholic 5
beverages district in Baltimore City under certain circumstances; altering a 6
geographic boundary in the 45th district within which the holder of a Class A or 7
Class B–D–7 beer, wine, and liquor license must operate in accordance with specified 8
hours; and generally relating to alcoholic beverages in Baltimore City. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 25
That the Laws of Maryland read as follows: 26

This title applies only in Baltimore City. 3

(a) The alcoholic beverages districts described in this section at all times are 5
coterminous with the legislative districts in the Legislative Districting Plan of 2022. 6
(b) Except as provided in subsection (c) of this section, the Board may not issue a 7
new license in: 8
(1) the 40th alcoholic beverages district; 9
(2) the 41st alcoholic beverages district; 10
(3) the 43rd alcoholic beverages district; 11
(4) the 44th alcoholic beverages district; and 12
(5) the 45th alcoholic beverages district. 13
(c) The Board may issue: 14
(2) SUBJECT TO ITEM (19) OF THIS SUBSECTION , a Class C beer, wine, 15
and liquor license in the 45th alcoholic beverages district; 16
(17) a Class A–7 beer, wine, and liquor license in the 1200 block of West 17
North Avenue in the 40th alcoholic beverages district, if: 18
(i) the applicant executes a memorandum of understanding with the 19
Penn North Community Association; 20
(ii) alcoholic beverages are sold only as part of a gift basket or floral 21
arrangement; and 22
(iii) the applicant does not hold or apply for a Class BWLT beer, wine, 23
and liquor (on–premises) tasting license; [and] 24
(18) a Class B beer, wine, and liquor license for a restaurant on the even 25
side of the 400 block of West 29th Street in the 40th alcoholic beverages district if: 26
(i) the applicant executes a memorandum of understanding with the 27
Greater Remington Improvement Association; and 28

(ii) the Board waives a minimum seating requirement under item 1
(1)(ii)2 of this subsection; AND 2
(19) A CLASS C BEER, WINE, AND LIQUOR LICENSE I N THE 400 BLOCK 3
OF EAST OLIVER STREET IN THE 45TH ALCOHOLIC BEVERAG ES DISTRICT, ONLY IF: 4
(I) THE APPLICANT DOES N OT CONVERT THE LICEN SE TO A 5
DIFFERENT LICENSE CLASS; 6
(II) ALCOHOLIC BEVERAGES ARE SERVED OUTDOORS ONLY TO 7
PATRONS SEATED AT TA BLES OR STANDING IN A COURTYARD AREA ; 8
(III) THE APPLICANT DOES N OT ALLOW THE OFF –PREMISES SALE 9
OF ALCOHOLIC BEVERAG ES; 10
(IV) ALCOHOLIC BEVERAGES SALES BEGIN NOT EARLIER THAN 11
10 A.M.; AND 12
(V) THE APPLICANT EXECUT ES A MEMORANDUM OF 13
UNDERSTANDING WITH T HE GREENMOUNT WEST COMMUNITY ASSOCIATION. 14

(a) (1) Except as otherwise provided in this subtitle, a holder of a Class A beer, 16
wine, and liquor license may sell beer, wine, and liquor: 17
(i) on Monday through Saturday: 18
1. from 9 a.m. to 10 p.m. in the area specified in the Park 19
Heights Master Plan adopted by the City in 2006; [and] 20
2. FROM 9 A.M. TO 10 P.M. IN AN AREA BOUNDED A S 21
FOLLOWS: FROM THE INTERSECTIO N OF BELAIR ROAD AND ANNTANA AVENUE, 22
SOUTHWEST ON BELAIR ROAD TO THE INTERSECT ION OF BELAIR ROAD AND 23
FRANKFORD AVENUE, SOUTHEAST ON FRANKFORD AVENUE TO THE INTERSE CTION 24
OF FRANKFORD AVENUE AND SIPPLE AVENUE, WEST ON SIPPLE AVENUE TO THE 25
INTERSECTION OF SIPPLE AVENUE AND CRENSHAW AVENUE, SOUTHEAST ON 26
CRENSHAW AVENUE TO THE INTERSE CTION OF CRENSHAW AVENUE AND 27
GOODNOW ROAD, SOUTHEAST ON GOODNOW ROAD TO THE INTERSECT ION OF 28
GOODNOW ROAD AND SINCLAIR LANE, NORTHEAST ON SINCLAIR LANE TO THE 29
INTERSECTION OF SINCLAIR LANE AND RADECKE AVENUE, WEST ON RADECKE 30
AVENUE TO THE INTERSE CTION OF RADECKE AVENUE AND ANNTANA AVENUE, 31
THEN NORTH ON ANNTANA AVENUE TO THE INTERSE CTION OF ANNTANA AVENUE 32

3. from 6 a.m. to midnight in all other locations in the City; 1
and 2
(ii) on the Sundays that fall between Thanksgiving Day and New 3
Year’s Day, from 1 p.m. to 9 p.m., if, on or before September 30 of that year, the license 4
holder has paid a supplementary license fee of $120 for each Sunday the privilege is to be 5
exercised. 6
(2) In addition to the privileges specified under paragraph (1)(ii) of this 7
subsection, the license holder may sell beer, wine, and liquor for off–premises consumption 8
on two additional Sundays during the calendar year if the holder pays a license fee of $120 9
at least 2 weeks before each time the privilege is exercised. 10
(c) A holder of a Class B–D–7 beer, wine, and liquor license may sell beer, wine, 11
and liquor: 12
(1) from 9 a.m. to 9 p.m. in the area bounded by Liberty Heights Avenue, 13
Northern Parkway, Druid Park Drive, and Wabash Avenue; 14
(2) from 9 a.m. to 9 p.m. along the south side of Frederick Avenue between 15
South Augusta Avenue and South Loudon Avenue; 16
(3) from 9 a.m. to 10 p.m. in the area specified in the Park Heights Master 17
Plan adopted by the City in 2006; [and] 18
(4) from 9 a.m. to 10 p.m. in an area bounded as follows: from the 19
intersection of East North Avenue and Harford Avenue, southwest on Harford Avenue to 20
the intersection of Harford Avenue and North Central Avenue, south on North Central 21
Avenue to the intersection with East Monument Street, east on East Monument Street to 22
the intersection of East Monument Street and North Wolfe Street, south on North Wolfe 23
Street to the intersection of North Wolfe Street and McElderry Street, east on McElderry 24
Street to the intersection of McElderry Street and North Collington Avenue, south on North 25
Collington Avenue to the intersection of North Collington Avenue and East Fayette Street, 26
east on East Fayette Street to the intersection of East Fayette Street and North Lakewood 27
Avenue, north on North Lakewood Avenue to the intersection of North Lakewood Avenue 28
and East Monument Street, west on East Monument Street to the intersection of East 29
Monument Street and North Luzerne Avenue, north on North Luzerne Avenue to the 30

(c) (1) This subsection does not apply to: 12
(i) a Class B beer and light wine license; 13
(ii) a Class B beer, wine, and liquor license; 14
(iii) a Class B–D–7 beer, wine, and liquor license; 15
(iv) a Class C beer and light wine license; and 16
(v) a Class C beer, wine, and liquor license. 17
(2) For a license holder in an area bounded by Liberty Heights Avenue, 18
Northern Parkway, Druid Park Drive, and Wabash Avenue, the hours of sale: 19
(i) may not begin before 9 a.m. or end after 10 p.m.; and 20
(ii) may not be extended if they begin later than 9 a.m. or end before 21
10 p.m. 22
(3) For a license holder in an area bounded as follows: from the intersection 23
of East North Avenue and Ha rford Avenue, southwest on Harford Avenue to the 24
intersection of Harford Avenue and North Central Avenue, south on North Central Avenue 25
to the intersection with East Monument Street, east on East Monument Street to the 26
intersection of East Monument Street and North Wolfe Street, south on North Wolfe Street 27
to the intersection of North Wolfe Street and McElderry Street, east on McElderry Street 28
to the intersection of McElderry Street and North Collington Avenue, south on North 29
