Jackson Requested: May 18, 2024 Introduced and read first time: January 8, 2025 Assigned to: Education, Energy, and the Environment Committee Report: Favorable Senate action: Adopted Read second time: February 2, 2025 CHAPTER ______ AN ACT concerning 1 Department of General Services – Identification Cards – Veteran Status 2 Notation 3 FOR the purpose of authorizing the Department of General Services to include a notation 4 on a certain identification card indicating that the holder is a veteran under certain 5 circumstances; requiring the Department to obtain the consent of a certain holder of 6 an identification card before transmitting certain information to a certain executive 7 agency; prohibiting the Department from transmitting certain information obtained 8 on an application for an identification card except under certain circumstances; and 9 generally relating to veterans and identification cards issued by the Department of 10 General Services. 11 BY repealing and reenacting, without amendments, 12 Article – State Finance and Procurement 13 Section 4–101 14 Annotated Code of Maryland 15 (2021 Replacement Volume and 2024 Supplement) 16 BY adding to 17 Article – State Finance and Procurement 18 Section 4–211 19 Annotated Code of Maryland 20 (2021 Replacement Volume and 2024 Supplement) 21 2 SENATE BILL 48 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 That the Laws of Maryland read as follows: 2 Article – State Finance and Procurement 3 4–101. 4 (a) In this title the following words have the meanings indicated. 5 (b) “Department” means the Department of General Services. 6 (c) “Secretary” means the Secretary of General Services. 7 4–211. 8 (A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS 9 INDICATED. 10 (2) “EXECUTIVE AGENCY ” MEANS A UNIT OF THE EXECUTIVE 11 BRANCH OF STATE GOVERNMENT . 12 (3) “IDENTIFICATION CARD ” MEANS A SECURITY CARD ISSUED BY 13 THE DEPARTMENT TO A STATE EMPLOYEE OR OTH ER INDIVIDUAL AUTHOR IZED BY 14 THE SECRETARY, INCLUDING A CONTRACTOR , REGULATED LOBBYIST , MEDIA 15 PERSONNEL , LOCAL GOVERNMENT OFF ICIAL, OR VOLUNTEER . 16 (B) (1) THE DEPARTMENT MAY INCLUD E A NOTATION ON A N 17 IDENTIFICATION CARD INDICATING THAT THE HOLDER IS A VETERAN IF THE 18 INDIVIDUAL ISSUED TH E IDENTIFICATION CAR D PRESENTS A CERTIFICA TION OF 19 VETERAN STATUS OBTAI NED FROM THE DEPARTMENT OF VETERANS AND MILITARY 20 FAMILIES IN ACCORDANC E WITH § 9–905 OF THE STATE GOVERNMENT ARTICLE, A 21 DD FORM 214, OR OTHER DOCUMENTATI ON ACCEPTABLE TO THE DEPARTMENT . 22 (2) THE DEPARTMENT MAY LIMIT THE NOTATION AUTHORIZED BY 23 PARAGRAPH (1) OF THIS SUBSECTION T O A CERTAIN CATEGORY OR CATEGORIES OF 24 IDENTIFICATION CARD HOLDERS. 25 (C) (1) IF THE DEPARTMENT PROVIDES A N OPTION FOR A NOTATION ON 26 AN IDENTIFICATION CARD THAT INDICATES THAT THE HOLDER IS A VETERAN, THE 27 DEPARTMENT SHALL INCLUDE ON THE APPLI CATION FOR THE IDENTIFICATION 28 CARD THE OPTION FOR THE A PPLICANT TO: 29 (I) INDICATE THAT THE APPLICANT IS A VETERAN; AND 30 SENATE BILL 48 3 (II) CONSENT TO BEING CON TACTED BY APPROPRIAT E 1 EXECUTIVE AGENCIES RE GARDING THE INDIVIDUAL’S ELIGIBILITY FOR STATE OR 2 FEDERAL VETERANS ’ BENEFITS. 3 (2) (I) IN ACCORDANCE WITH TITLE 4, SUBTITLE 3 OF THE 4 GENERAL PROVISIONS ARTICLE AND ANY OTHER APPLICABLE LAW , AND ON 5 REQUEST BY AN EXECUTIVE AGENCY, THE DEPARTMENT SHALL TRANSMIT TO TH E 6 EXECUTIVE AGENCY APPROPRIATE I NFORMATION ABOUT EAC H IDENTIFICATION 7 CARD HOLDER WHO HAS GIVEN CONSENT UNDER PARAGRAPH (1)(II) OF THIS 8 SUBSECTION. 9 (II) UNLESS OTHERWISE AUTH ORIZED OR REQUIRED B Y LAW, 10 THE DEPARTMENT MAY NOT TR ANSMIT INFORMATION O BTAINED ON AN 11 APPLICATION FOR AN I DENTIFICATION CARD THAT RELATES TO THE APPLICANT’S 12 STATUS AS A VETERAN UNLESS THE APPLICANT HAS GIVEN CONSENT UNDER 13 PARAGRAPH (1)(II) OF THIS SUBSECTION . 14 (D) THE DEPARTMENT MAY ADOPT REGULATION S TO CARRY OUT THIS 15 SECTION. 16 SECTION 2.
