AN ACT concerning 1 
 
Baltimore City – Speed Monitoring System Citations – Late Fees 2 
 
FOR the purpose of requiring that a citation generated by a speed monitoring system 3 
located in Baltimore City include certain information regarding late fees; authorizing 4 
the Baltimore Police Department to charge a late fee for the failure to pay a civil 5 
penalty or contest liability for a citation generated by a speed monitoring system 6 
located in Baltimore City; and generally relating to speed monitoring systems. 7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 23 
That the Laws of Maryland read as follows: 24

 (c) (1) Unless the driver of the motor vehicle received a citation from a police 2 
officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 3 
section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 4 
recorded by a speed monitoring system while being operated in violation of this subtitle. 5 
 
 (2) A civil penalty under this subsection may not exceed $40. 6 
 
 (3) For purposes of this section, the District Court shall prescribe: 7 
 
 (i) A uniform citation form consistent with subsection (d)(1) of this 8 
section and § 7–302 of the Courts Article; and 9 
 
 (ii) A civil penalty, which shall be indicated on the citation, to be paid 10 
by persons who choose to prepay the civil penalty without appearing in District Court. 11 
 
 (d) (1) Subject to the provisions of paragraphs (2) through (4) of this 12 
subsection, an agency shall mail to an owner liable under subsection (c) of this section a 13 
citation that shall include: 14 
 
 (i) The name and address of the registered owner of the vehicle; 15 
 
 (ii) The registration number of the motor vehicle involved in the 16 
violation; 17 
 
 (iii) The violation charged; 18 
 
 (iv) The location where the violation occurred; 19 
 
 (v) The date and time of the violation; 20 
 
 (vi) A copy of the recorded image; 21 
 
 (vii) The amount of the civil penalty imposed and the date by which 22 
the civil penalty should be paid; 23 
 
 (viii) A signed statement by a duly authorized law enforcement officer 24 
employed by or under contract with an agency that, based on inspection of recorded images, 25 
the motor vehicle was being operated in violation of this subtitle; 26 
 
 (ix) A statement that recorded images are evidence of a violation of 27 
this subtitle; 28 
 
 (x) Information advising the person alleged to be liable under this 29 
section of the manner and time in which liability as alleged in the citation may be contested 30 
in the District Court; [and] 31   	SENATE BILL 501 	3 
 
 
 
 (xi) Information advising the person alleged to be liable under this 1 
section that failure to pay the civil penalty or to contest liability in a timely manner: 2 
 
 1. Is an admission of liability; 3 
 
 2. May result in the refusal by the Administration to register 4 
the motor vehicle; and 5 
 
 3. May result in the suspension of the motor vehicle 6 
registration; AND 7 
 
 (XII) FOR A CITATION GENERATED BY A SPEED MONITORING 8 
SYSTEM LOCATED IN BALTIMORE CITY, INFORMATION ADVISING THE PERSON 9 
ALLEGED TO BE LIABLE UNDER THIS SECTION T HAT FAILURE TO PAY T HE CIVIL 10 
PENALTY OR TO CONTES T LIABILITY IN ACCORDANCE WITH PARA GRAPH (6) OF THIS 11 
SUBSECTION MAY RESULT IN THE ASSESS MENT OF A LATE FEE . 12 
 
 (6) (I) THIS PARAGRAPH APPLIE S ONLY IN BALTIMORE CITY. 13 
 
 (II) AN AGENCY MAY CHARGE A LATE FEE IF A PERSON ALLEGED 14 
TO BE LIABLE UNDER T HIS SECTION FAILS TO PAY THE CIV IL PENALTY OR TO 15 
CONTEST LIABILITY WITHIN A TIMEFRAME DETERMINED BY THE AGENCY. 16 
 
 [(6)] (7) To mail the citation or warning notice, an agency shall use: 17 
 
 (i) The current mailing address on file with the Administration; or 18 
 
 (ii) If a mailing address is unavailable, the current residential 19 
address on file with the Administration. 20 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 21 
October 1, 2025. 22
