AN ACT concerning 1 
 
Legislative Scholarship Programs – Eligibility and Use – Real Estate Appraisal 2 
Program 3 
 
FOR the purpose of exempting certain applicants for a senatorial scholarship from certain 4 
examination requirements; authorizing certain uses of senatorial and Delegate 5 
scholarships for applicants who plan to complete the Real Property Appraiser 6 
Qualification Criteria of the Practical Applications of Real Estate Appraisal 7 
Program; and generally relating to the legislative scholarship programs. 8 
 
BY repealing and reenacting, with amendments, 9

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 
That the Laws of Maryland read as follows: 15 
 
Article – Education 16 
 
18–402. 17 
 
 (a) (1) Except as provided in paragraphs (2) [and], (3), AND (4) of this 18 
subsection, each applicant for a senatorial scholarship shall: 19 
 
 (i) Take a competitive examination administered by the Office; and 20 
 
 (ii) 1. Be accepted for admission in the regular undergraduate, 21 
graduate, or professional program at an eligible institution; or 22

 2. Be enrolled in a 2–year terminal certificate program in 1 
which the course work is acceptable for transfer credit for an accredited baccalaureate 2 
program in an eligible institution. 3 
 
 (2) An applicant is exempt from the examination if the applicant: 4 
 
 (i) Is attending an eligible institution and has completed at least 1 5 
year in good academic standing at the institution; 6 
 
 (ii) Graduated from high school at least 5 years before application 7 
for a senatorial scholarship; 8 
 
 (iii) Is accepted for admission to a private career institution, if the 9 
institution’s curriculum is approved by the Commission, and the institution is accredited 10 
by a national accrediting association approved by the United States Department of 11 
Education; or 12 
 
 (iv) Is planning to attend or is attending a Maryland community 13 
college. 14 
 
 (3) An applicant is exempt from the requirements of paragraph (1) of this 15 
subsection if the applicant is or was enrolled in a certificate or license program, course, or 16 
sequence of courses at a community college that leads to certification or licensure. 17 
 
 (4) AN APPLICANT IS EXEMP T FROM THE REQUIREME NTS OF 18 
PARAGRAPH (1) OF THIS SUBSECTION I F THE APPLICANT IS R EGISTERED FOR OR IS 19 
PLANNING TO COMPLETE THE REAL PROPERTY APPRAISER QUALIFICATION 20 
CRITERIA OF THE PRACTICAL APPLICATIONS OF REAL ESTATE APPRAISAL 21 
PROGRAM ADOPTED BY TH	E APPRAISAL FOUNDATION APPRAISER 22 
QUALIFICATIONS BOARD AUTHORIZED UNDE R THE FEDERAL FINANCIAL 23 
INSTITUTIONS REFORM, RECOVERY, AND ENFORCEMENT ACT OF 1989. 24 
 
 (b) Each applicant shall: 25 
 
 (1) Be eligible for in–State tuition under this article; and 26 
 
 (2) At the time of the applicant’s initial application, be domiciled in the 27 
legislative district from which the applicant seeks an award. 28 
 
 (c) (1) Each applicant shall demonstrate to the Office a definite financial need, 29 
and each Senator shall consider the financial need of each applicant. 30 
 
 (2) Each Senator is the final judge of the financial need of each applicant 31 
to whom the Senator awards a scholarship, and the Office may not negate the Senator’s 32 
judgment or impose requirements of time or procedure. 33

 (d) Each applicant shall accept any other conditions attached to the award. 1

 (a) Except as provided in [subsection] SUBSECTIONS (B)(3) AND (d) of this 3 
section, a senatorial scholarship may be used only at any community colle ge or 4 
undergraduate, graduate, or professional school in the State. 5 
 
 (b) A senatorial scholarship may be used: 6 
 
 (1) If the curriculum is approved by the Commission, at a degree granting 7 
institution of higher education, a hospital diploma school for training registered nurses, or 8 
to attend a private postsecondary proprietary institution that is accredited by a national 9 
accrediting association approved by the United States Department of Education as a  10 
full–time student; [and] 11 
 
 (2) For educational expenses as defined by the Office, including: 12 
 
 (i) Tuition and mandatory fees; and 13 
 
 (ii) Room and board; AND 14 
 
 (3) FOR EXPENSES TO REGISTER FOR AND COMPLETE THE REAL 15 
PROPERTY APPRAISER QUALIFICATION CRITERIA OF THE PRACTICAL 16 
APPLICATIONS OF REAL ESTATE APPRAISAL PROGRAM ADOPTED BY TH E 17 
APPRAISAL FOUNDATION APPRAISER QUALIFICATIONS BOARD AUTHORIZED 18 
UNDER THE FEDERAL FINANCIAL INSTITUTIONS REFORM, RECOVERY, AND 19 
ENFORCEMENT ACT OF 1989. 20 
 
 (c) If on–campus housing is available, a senatorial scholarship may not be used 21 
to pay for off–campus housing. 22 
 
 (d) Each Senator may award not more than 10% of the funds available under this 23 
subtitle to applicants planning to attend accredited undergraduate, graduate, or 24 
professional institutions outside the State, provided the applicant: 25 
 
 (1) Will be studying in an academic area that is not offered in a program 26 
that is accredited by a national accrediting association approved by the United States 27 
Department of Education in any institution in the State; 28 
 
 (2) Is a hearing impaired person who will be studying at an institution 29 
outside the State that makes special provisions for hearing impaired students, and 30 
comparable special provisions are not available to the applicant at an institution in the 31 
State; or 32

 (3) Is an individual who is on active duty with the United States military 1 
who is domiciled in this State. 2 
 
18–501. 3 
 
 (a) There is a program of Delegate Scholarships in this State that are awarded 4 
under this subtitle. 5 
 
 (b) A scholarship awarded under this subtitle may be used at: 6 
 
 (1) An eligible institution for a program of undergraduate, graduate, or 7 
professional studies; 8 
 
 (2) An accredited undergraduate, graduate, or professional institution 9 
outside the State, if the applicant: 10 
 
 (i) Will be studying in an academic area that is not offered in a 11 
program that is accredited by a national accrediting association approved by the United 12 
States Department of Education in any institution in this State; 13 
 
 (ii) Is disabled and will be studying at an institution outside the 14 
State that makes special provisions for disabled students that are not available to the 15 
applicant at an institution in the State; or 16 
 
 (iii) Is an individual who is on active duty with the United States 17 
military who is domiciled in this State; [and] 18 
 
 (3) A private career school within the State that is approved by the 19 
Maryland Higher Education Commission under § 11 –202 of this article and that is 20 
accredited by a national accrediting association that is approved by the United States 21 
Department of Education; AND 22 
 
 (4) A PRACTICAL APPLICATIONS OF REAL ESTATE APPRAISAL 23 
PROGRAM ADOPTED BY TH	E APPRAISAL FOUNDATION APPRAISER 24 
QUALIFICATIONS BOARD AUTHORIZED UNDE R THE FEDERAL FINANCIAL 25 
INSTITUTIONS REFORM, RECOVERY, AND ENFORCEMENT ACT OF 1989. 26 
 
 (c) Money appropriated to the Commission for scholarships awarded under this 27 
section that is not used by the end of the fiscal year shall be retained by the Commission 28 
for use by the awarding Delegate in the Delegate Scholarship Program during subsequent 29 
fiscal years. 30

 (a) During each term in office, each Delegate may award the equivalent of four  1 
4–year full–time scholarships, which may be awarded for either 1–, 2–, 3–, or 4–year 2 
periods. 3 
 
 (b) (1) Each scholarship pays the tuition and mandatory fees at any eligible 4 
institution OR EXPENSES TO REGIS TER FOR AND COMPLETE A PRACTICAL 5 
APPLICATIONS OF REAL ESTATE APPRAISAL PROGRAM ADOPTED BY THE 6 
APPRAISAL FOUNDATION APPRAISER QUALIFICATIONS BOARD AUTHORIZED 7 
UNDER THE FEDERAL FINANCIAL INSTITUTIONS REFORM, RECOVERY, AND 8 
ENFORCEMENT ACT OF 1989. 9 
 
 (2) The annual amount of a scholarship at a public or private institution or 10 
any graduate or professional program may not exceed the equivalent annual tuition and 11 
mandatory fees of an undergraduate program at the 4–year public institution of higher 12 
education within the University System of Maryland, other than the University of 13 
Maryland Global Campus and University of Maryland, Baltimore Campus, with the 14 
highest annual expenses for a full–time resident undergraduate. 15

 (a) As an alternative to the scholarship awards authorized by §§ 18–503 through 17 
18–505 of this subtitle, and subject to the provisions of subsection (b) of this section, during 18 
each year in office each Delegate may award scholarships in a total amount equal to four 19 
times the tuition and mandatory fees for a full–time undergraduate student enrolled at the 20 
University of Maryland, College Park Campus for the academic year commencing in that 21 
year. 22 
 
 (b) A scholarship award under subsection (a) of this section: 23 
 
 (1) May not be for an amount less than $200 or more than one–half of the 24 
total amount of scholarships authorized by subsection (a) of this section for that year; 25 
 
 (2) Shall be used at an eligible institution OR A PRACTICAL 26 
APPLICATIONS OF REAL ESTATE APPRAISAL PROGRAM ADOPTED BY TH E 27 
APPRAISAL FOUNDATION APPRAISER QUALIFICATIONS BOARD AUTHORIZED 28 
UNDER THE FEDERAL FINANCIAL INSTITUTIONS REFORM, RECOVERY, AND 29 
ENFORCEMENT ACT OF 1989; 30 
 
 (3) May be used by: 31 
 
 (i) A graduate, undergraduate, or professional student; 32 
 
 (ii) A student at a private career school within the State that is 33 
approved by the Maryland Higher Education Commission under § 11–202 of this article 34 
and that is accredited by a national accrediting association that is approved by the United 35 
States Department of Education; [or] 36  6 	SENATE BILL 583  
 
 
 
 (iii) A student who is currently enrolled or was enrolled in the last 2 1 
years in a certificate or license program, course, or sequence of courses at a community 2 
college that leads to certification or licensure as reimbursement for educational expenses 3 
that are defined by the Office and include tuition, mandatory fees, and room and board; 4 
[and] OR 5 
 
 (IV) A STUDENT WHO IS REGIS TERED FOR OR IS PLAN NING TO 6 
COMPLETE THE REAL PROPERTY APPRAISER QUALIFICATION CRITERIA OF THE 7 
PRACTICAL APPLICATIONS OF REAL ESTATE APPRAISAL PROGRAM ADOPTED BY 8 
THE APPRAISAL FOUNDATION APPRAISER QUALIFICATIONS BOARD AUTHORIZED 9 
UNDER THE FEDERAL FINANCIAL INSTITUTIONS REFORM, RECOVERY, AND 10 
ENFORCEMENT ACT OF 1989; AND 11 
 
 (4) To the extent it is not used by the student, shall be recredited to the 12 
Delegate’s scholarship account and may be awarded in the next 12 months by that Delegate 13 
to another student pursuant to this section. 14 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 15 
1, 2025. 16
