BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1 That the Laws of Maryland read as follows: 2 Article – Alcoholic Beverages and Cannabis 3 22–102. 4 This title applies only in Harford County. 5 22–1005.2. 6 (b) There is a performing arts nonprofit organization beer, wine, and liquor 7 license. 8 (k) (1) The license holder shall: 9 (i) keep complete and accurate records of all alcoholic beverages 10 sold, served, and purchased under this section; 11 (ii) on written request of [the Comptroller,] the Board[,] or the 12 Executive Director, report on the form that [the Comptroller,] the Board[,] or the Executive 13 Director requires information relating to the alcoholic beverages that are the subject of the 14 records required to be kept; and 15 (iii) on request of [the Comptroller,] the Board[,] or the Executive 16 Director, make the report under oath. 17 (2) (i) Except as provided in subparagraph (ii) of this paragraph, each 18 license holder shall keep records at the location designated in the license. 19 (ii) If the license holder is allowed to have more than one location, 20 the license holder may keep the records at the principal location. 21 (iii) The records shall: 22 1. meet form and content requirements of [the Comptroller,] 23 the Board[,] or the Executive Director; 24 2. be preserved for at least 2 years in a manner that ensures 25 permanency; and 26 3. be made available for audit or inspection during regular 27 business hours by [the Comptroller,] the Board, [or] the Executive Director, or a designee 28 of [the Comptroller,] the Board[,] or the Executive Director. 29 SENATE BILL 745 3 (3) (i) [The Comptroller may without a hearing immediately suspend 1 for a maximum of 30 days the license of a license holder who fails to comply with this 2 subsection. 3 (ii)] If a report required by this section or an investigation by the 4 Board, a Board officer, [the Comptroller,] the Executive Director, or any other person 5 indicates that the license holder is violating this section, the Board [shall] MAY summon 6 the license holder and conduct a hearing. 7 [(iii)] (II) If the charges at the hearing are sustained, the Board: 8 1. [shall] MAY impose a fine of not less than $250 and not 9 more than $2,000; and 10 2. may suspend or revoke the license holder’s license 11 immediately. 12 SECTION 2.
