BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16 That the Laws of Maryland read as follows: 17 Article – State Finance and Procurement 18 4–601. 19 (a) Subject to subsection [(b)] (C) of this section, the Department has jurisdiction 20 over and full police authority for the enforcement STATEWIDE of the criminal laws and the 21 parking and motor vehicle laws as to the operation, maintenance, and protection of: 22 2 SENATE BILL 766 (1) [buildings and grounds that, on June 30, 1984, were administered by 1 the Office of Annapolis Public Buildings and Grounds, and extending to the surrounding 2 area that encompasses 1,000 feet in any direction from the boundary of those buildings and 3 grounds; 4 (2) buildings and grounds that, on June 30, 1984, were administered by the 5 Office of Baltimore Public Buildings and Grounds, and extending to the surrounding area 6 that encompasses 1,000 feet in any direction from the boundary of those buildings and 7 grounds; 8 (3) multiservice centers designated by law or by the Board of Public Works 9 and extending to the surrounding area that encompasses 1,000 feet in any direction from 10 the boundary of those multiservice centers; 11 (4) buildings and grounds that, on June 30, 2019, were administered by the 12 Maryland Department of Labor, and extending to the surrounding area that encompasses 13 1,000 feet in any direction from the boundary of those buildings; 14 (5)] State–owned or State–leased buildings and grounds and extending to 15 the surrounding area that encompasses [1,000] 2,000 feet in any direction from the 16 boundary of those buildings and grounds; and 17 [(6)] (2) other public improvements or grounds designated by law or by 18 the Board of Public Works. 19 (b) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION A ND IN 20 ADDITION TO THE POWE RS GRANTED UNDER SUB SECTION (A) OF THIS SECTION , A 21 POLICE OFFICER OF TH E MARYLAND CAPITOL POLICE WITHIN THE DEPARTMENT 22 MAY INVESTIGATE AND ENFORCE STATEWIDE THE CRIMINAL LAWS AND TITLE 12 OF 23 THE CRIMINAL PROCEDURE ARTICLE. 24 (2) IF A POLICE OFFICER O F THE MARYLAND CAPITOL POLICE 25 WITHIN THE DEPARTMENT EXERCISES THE POWERS GRANTED UNDER PARAGR APH 26 (1) OF THIS SUBS ECTION, NOTIFICATION OF THE I NVESTIGATION AND 27 ENFORCEMENT SHALL BE PROVIDED AS SOON AS POSSIBLE : 28 (I) IN A MUNICIPAL CORPO RATION, TO THE CHIEF OF POLI CE 29 OR DESIGNEE OF THE C HIEF OF POLICE; 30 (II) IN A COUNTY WITH A C OUNTY POLICE DEPARTM ENT, TO THE 31 CHIEF OF POLICE OR DESI GNEE OF THE CHIEF OF POLICE; 32 (III) IN A COUNTY WITHOUT A POLICE DEPARTMENT , TO THE 33 SHERIFF OR DESIGNEE OF THE SHERIFF; AND 34 SENATE BILL 766 3 (IV) IN BALTIMORE CITY, TO THE POLICE COMMISSIONER OR 1 DESIGNEE OF THE POLICE COMMISSIONER . 2 (C) Consistent with Article 8 of the Maryland Declaration of Rights, with respect 3 to State legislative buildings in the City of Annapolis, the presiding officers of the General 4 Assembly shall have final authority over the use of and access to the buildings by the 5 members of the General Assembly, their staff, and Department of Legislative Services 6 personnel. 7 4–605. 8 (a) (1) In accordance with the provisions of the State Personnel and Pensions 9 Article, the Secretary may establish a police and security force, known as the Maryland 10 Capitol Police of the Department of General Services, to protect people and property on or 11 about improvements, grounds, and multiservice centers under the jurisdiction of the 12 Department, and in the surrounding areas of the buildings and grounds in the State as 13 described in § 4–601 of this subtitle. 14 (2) (i) The Secretary shall appoint the Chief of the Maryland Capitol 15 Police of the Department of General Services. 16 (ii) The Chief of the Maryland Capitol Police of the Department of 17 General Services serves at the pleasure of the Secretary. 18 (iii) The Chief of the Maryland Capitol Police of the Department of 19 General Services shall supervise and direct the affairs and operations of the Maryland 20 Capitol Police. 21 (3) The Maryland Capitol Police of the Department of General Services 22 may include sworn police officers. 23 (b) A member of the Maryland Capitol Police of the Department of General 24 Services may not be involuntarily transferred from a site to another site. 25 (c) Subject to subsection (d) of this section, a Maryland Capitol Police officer has 26 all the powers granted to a peace officer and a police officer of the State. 27 (d) A Maryland Capitol Police officer may exercise the powers described in 28 subsection (c) of this section within the Department’s jurisdiction as specified in § 4–601 of 29 this subtitle provided the police officer: 30 (1) meets the legal requirements set forth by the Maryland Police Training 31 and Standards Commission; and 32 (2) is designated by the Department as a police officer. 33 4 SENATE BILL 766 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 1 October 1, 2025. 2
