[Brackets] indicate matter deleted from existing law. *sb0808* SENATE BILL 808 R5 5lr2759 By: Senator Augustine Introduced and read first time: January 28, 2025 Assigned to: Judicial Proceedings A BILL ENTITLED AN ACT concerning 1 Prince George’s County – Stop Sign Monitoring Systems – School Bus Stops 2 FOR the purpose of authorizing the use of stop sign monitoring systems at school bus stops 3 in Prince George’s County, if authorized by local law or, in the case of school bus 4 stops located on State highways, the State Highway Administration; and generally 5 relating to the use of stop sign monitoring systems at school bus stops in Prince 6 George’s County. 7 BY repealing and reenacting, without amendments, 8 Article – Transportation 9 Section 21–707.1(a) and (b) 10 Annotated Code of Maryland 11 (2020 Replacement Volume and 2024 Supplement) 12 BY repealing and reenacting, with amendments, 13 Article – Transportation 14 Section 21–707.1(c) 15 Annotated Code of Maryland 16 (2020 Replacement Volume and 2024 Supplement) 17 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 That the Laws of Maryland read as follows: 19 Article – Transportation 20 21–707.1. 21 (a) This section applies only in Prince George’s County. 22 (b) (1) In this section the following words have the meanings indicated. 23 2 SENATE BILL 808 (2) “Agency” means a law enforcement agency that is authorized to issue a 1 citation for a violation of the Maryland Vehicle Law or of local traffic laws or regulations. 2 (3) (i) “Owner” means the registered owner of a motor vehicle or lessee 3 of a motor vehicle under a lease of 6 months or more. 4 (ii) “Owner” does not include: 5 1. A motor vehicle leasing company; or 6 2. A holder of a special registration plate issued under Title 7 13, Subtitle 9, Part III of this article. 8 (4) “Recorded image” means images recorded by a stop sign monitoring 9 system: 10 (i) On: 11 1. Two or more photographs; 12 2. Two or more microphotographs; 13 3. Two or more electronic images; 14 4. Videotape; or 15 5. Any other medium; and 16 (ii) Showing a motor vehicle and, on at least one image or portion of 17 tape, clearly identifying the registration plate number of the motor vehicle. 18 (5) “Stop sign monitoring system” means a device designed to capture a 19 recorded image of a violation. 20 (6) (i) “Violation” means a failure to come to a complete stop at a stop 21 sign in violation of § 21–707 of this subtitle. 22 (ii) “Violation” does not include any action a driver is instructed to 23 take by a police officer. 24 (c) (1) Subject to paragraphs (2) through (5) of this subsection, an agency may 25 use stop sign monitoring systems: 26 (i) On highways located in a school zone maintained by a local 27 jurisdiction, if authorized by the governing body of the local jurisdiction; [or] 28 SENATE BILL 808 3 (II) AT A SCHOOL BUS STOP LOCATED ON A HIGHWAY 1 MAINTAINED BY A LOCA L JURISDICTION, IF AUTHORIZED BY THE GOVERNING BODY 2 OF THE LOCAL JURISDI CTION; 3 [(ii)] (III) On State highways located in a school zone, if authorized 4 by the State Highway Administration; OR 5 (IV) AT A SCHOOL BUS STOP LOCATED ON A STATE HIGHWAY , IF 6 AUTHORIZED BY THE STATE HIGHWAY ADMINISTRATIO N. 7 (2) A stop sign monitoring system: 8 (i) May not be used in a local jurisdiction under this section unless 9 its use is authorized by the governing body of the local jurisdiction by local law enacted 10 after reasonable notice and a public hearing; and 11 (ii) May only be used at a location approved by the Prince George’s 12 County Council. 13 (3) The county shall prioritize the placement of stop sign monitoring 14 systems within municipalities that have high violation rates. 15 (4) Before beginning use of stop sign monitoring systems, an agency shall 16 publish notice that the agency has adopted the use of stop sign monitoring systems on its 17 website and in a newspaper of general circulation in the jurisdiction in which the stop sign 18 monitoring system will be used. 19 (5) (i) The county shall prominently place signs on highways within the 20 county providing notice that stop sign monitoring systems are used in the county. 21 (ii) The State Highway Administration shall place signs prominently 22 providing notice that stop sign monitoring systems are in use on State highways. 23 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 24 October 1, 2025. 25
