AN ACT concerning 1 
 
Peace Orders – Intentional Visual Surveillance 2 
 
FOR the purpose of authorizing a certain person to petition for a peace order against 3 
another person whom the petitioner alleges has conducted intentional visual 4 
surveillance of areas of the petitioner’s residence where the petitioner has a 5 
reasonable expectation of privacy; expanding the relief that may be included in a 6 
final peace order; and generally relating to peace orders and visual surveillance. 7 
 
BY repealing and reenacting, without amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – Courts and Judicial Proceedings 20 
 
3–1501. 21 
 
 (a) In this subtitle the following words have the meanings indicated. 22 
 
 (i) “Residence” includes the yard, grounds, outbuildings, and common areas 23  2 	SENATE BILL 92  
 
 
surrounding the residence. 1 
 
3–1503. 2 
 
 (a) (1) A petitioner may seek relief under this subtitle by filing with the court, 3 
or with a commissioner under the circumstances specified in § 3–1503.1(a) of this subtitle, 4 
a petition that alleges the commission of any of the following acts against the petitioner, or 5 
any of the following acts against the petitioner’s employee at the employee’s workplace, by 6 
the respondent, if the act occurred within 30 days before the filing of the petition: 7 
 
 (i) An act that causes serious bodily harm; 8 
 
 (ii) An act that places the petitioner or the petitioner’s employee in 9 
fear of imminent serious bodily harm; 10 
 
 (iii) Assault in any degree; 11 
 
 (iv) False imprisonment; 12 
 
 (v) Harassment under § 3–803 of the Criminal Law Article; 13 
 
 (vi) Stalking under § 3–802 of the Criminal Law Article; 14 
 
 (vii) Trespass under Title 6, Subtitle 4 of the Criminal Law Article; 15 
 
 (viii) Malicious destruction of property under § 6–301 of the Criminal 16 
Law Article; 17 
 
 (ix) Misuse of telephone facilities and equipment under § 3–804 of 18 
the Criminal Law Article; 19 
 
 (x) Misuse of electronic communication or interactive computer 20 
service under § 3–805 of the Criminal Law Article; 21 
 
 (xi) Revenge porn under § 3–809 of the Criminal Law Article; [or] 22 
 
 (xii) Visual surveillance under § 3–901, § 3–902, or § 3–903 of the 23 
Criminal Law Article; OR 24 
 
 (XIII) INTENTIONAL VISUAL SURVEILLANCE , WHETHER OR NOT 25 
PROHIBITED UNDER § 3–901, § 3–902, OR § 3–903 OF THE CRIMINAL LAW ARTICLE, 26 
OF AREAS OF THE PETI TIONER’S RESIDENCE WHERE TH E PETITIONER HAS A 27 
REASONABLE EXPECTATI ON OF PRIVACY . 28

 (d) (1) The final peace order may include any or all of the following relief: 1 
 
 (i) Order the respondent to refrain from committing or threatening 2 
to commit an act specified in § 3–1503(a) of this subtitle against the petitioner or the 3 
petitioner’s employee; 4 
 
 (ii) Order the respondent to refrain from contacting, attempting to 5 
contact, or harassing the petitioner or the petitioner’s employee; 6 
 
 (iii) Order the respondent to refrain from entering the residence of 7 
the petitioner or the petitioner’s employee; 8 
 
 (iv) Order the respondent to remain away from the place of 9 
employment, school, or temporary residence of the petitioner or the petitioner’s employee; 10 
 
 (v) Direct the respondent or petitioner to participate in 11 
professionally supervised counseling or, if the parties are amenable, mediation; [and] 12 
 
 (vi) Order either party to pay filing fees and costs of a proceeding 13 
under this subtitle; AND 14 
 
 (VII) FOR AN ACT OF VISUAL SURVEILLANCE , ORDER THE 15 
RESPONDENT TO : 16 
 
 1. REMOVE OR REPOSITION A DEVICE BEING USED FO R 17 
VISUAL SURVEILLANCE WITHIN 15 DAYS AFTER ISSUANCE OF A FINAL PEACE ORDER 18 
UNDER THIS SECTION ; AND 19 
 
 2. REFRAIN FROM FURTHER VISUAL SURVEILLANCE . 20 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 21 
October 1, 2025. 22
