[Brackets] indicate matter deleted from existing law. *sb0944* SENATE BILL 944 C9 5lr2302 CF 5lr1319 By: Senator Hettleman Introduced and read first time: January 28, 2025 Assigned to: Education, Energy, and the Environment A BILL ENTITLED AN ACT concerning 1 Housing Development Permits – Local Reporting Requirement s 2 (Maryland Housing Data Transparency Act) 3 FOR the purpose of requiring certain local jurisdictions to make certain monthly reports to 4 the Department of Planning regarding housing development permits issued by the 5 local jurisdiction, beginning on a certain date; requiring the Department to make 6 certain information public in a certain manner; and generally relating to housing 7 development permits. 8 BY repealing and reenacting, with amendments, 9 Article – Land Use 10 Section 7–105 11 Annotated Code of Maryland 12 (2012 Volume and 2024 Supplement) 13 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 That the Laws of Maryland read as follows: 15 Article – Land Use 16 7–105. 17 (a) This section applies only to a local jurisdiction with at least 150,000 residents. 18 (b) On or before July 1 each year, each local jurisdiction subject to the 19 requirements of this section shall report to the Department of Housing and Community 20 Development and the Department of Planning the following information for each building 21 or development permit application which includes a residential housing component as part 22 of the development considered by the local jurisdiction during the immediately preceding 23 calendar year: 24 2 SENATE BILL 944 (1) the total number of complete applications received by type; 1 (2) the total number of complete applications issued by type; 2 (3) the total number of complete applications rejected by type; 3 (4) the net total number of residential units approved; 4 (5) the mean and median processing times for permit applications and the 5 standard deviation from the mean; 6 (6) the amount of time spent processing applications, including the time 7 spent by agencies reviewing applications, by applicants making edits, and any public notice 8 or comment time periods; 9 (7) any type of expedited permit application process that the local 10 jurisdiction employed to accelerate residential housing development projects; 11 (8) the total number of residential housing development projects that 12 benefited from an expedited permit application process in the local jurisdiction and which 13 type of expedited process was used; and 14 (9) any other information the jurisdiction considers relevant. 15 (C) (1) THIS SUBSECTION APPLI ES ONLY TO A LOCAL J URISDICTION 16 THAT ISSUES AT LEAST 50 BUILDING OR DEVELOPM ENT PERMITS FOR NEW 17 RESIDENTIAL UNITS EA CH YEAR. 18 (2) BEGINNING JANUARY 1, 2027, AND ON THE FIRST DAY OF EACH 19 MONTH THEREAFTER , EACH LOCAL J URISDICTION SUBJECT TO THE REQUIREMENTS 20 OF THIS SECTION SHAL L REPORT TO THE DEPARTMENT OF PLANNING THE 21 FOLLOWING INFORMATIO N FOR EACH BUILDING OR DEVELOPMENT PERMI T THAT 22 INCLUDES A RESIDENTI AL HOUSING COMPONENT AS PART OF THE DEVEL OPMENT 23 ISSUED BY THE LOCA L JURISDICTION DURIN G THE IMMEDIATELY PR ECEDING 24 MONTH: 25 (I) THE PERMIT NUMBER ; 26 (II) THE PERMIT APPROVAL DATE; 27 (III) THE DATE ON WHICH TH E USE AND OCCUPANCY PERMIT 28 WAS ISSUED; 29 (IV) THE PARCEL TAX IDENT IFICATION NUMBER ; 30 SENATE BILL 944 3 (V) THE SITE ADDRES S; 1 (VI) THE HOUSING TYPE AUT HORIZED UNDER THE PE RMIT; 2 (VII) THE PERMIT TYPE ; 3 (VIII) THE TOTAL NUMBER OF RESIDENTIAL UNITS AU THORIZED 4 UNDER THE PERMIT ; 5 (IX) A GENERAL DESCRIPTIO N OF THE WORK AUTHOR IZED 6 UNDER THE PERMIT ; 7 (X) THE TOTAL COST OF CONSTRUCTION ; AND 8 (XI) ANY OTHER INFORMATIO N THE JURISDICTION C ONSIDERS 9 RELEVANT. 10 (D) ON OR BEFORE JULY 1, 2027, AND AS THE INFORMATI ON BECOMES 11 AVAILABLE THEREAFTER , THE DEPARTMENT OF PLANNING SHALL PUBLIS H THE 12 INFORMATION REPORTED BY LOCAL JURISDICTIONS UNDER T HIS SUBSECTION FOR 13 THE IMMEDIATELY PREC EDING FISCAL YEAR : 14 (1) ON A PUBLIC, INTERACTIVE, AND SEARCHABLE WEBSI TE; 15 (2) BY HOUSING TYPE , SPECIFICALLY LABELED AS SINGLE FAMILY , 16 TOWNHOUSES , APARTMENTS , DUPLEXES, TRIPLEXES, OR QUADPLEXE S; 17 (3) BY THE TOTAL BUILT A ND EXISTING HOUSING SUPPLY, 18 ORGANIZED BY HOUSING TYPE, IN EACH COUNTY IN TH E STATE; AND 19 (4) BY DATA SOURCE . 20 [(c)] (E) (1) (i) Subject to paragraph (2) of this subsection, a local 21 jurisdiction shall make the [report] REPORTS required under this section publicly 22 available on its website. 23 (ii) An announcement posted to a local jurisdiction’s website stating 24 that a person should contact the relevant local department for access to the [report] 25 REPORTS does not fulfill the requirements of subparagraph (i) of this paragraph. 26 (2) A local jurisdiction that does not maintain a website shall make the 27 [report] REPORTS publicly available through any other reasonable method. 28 4 SENATE BILL 944 (3) To the extent practicable, a local jurisdiction may submit and transmit 1 [the] A report required under this section as part of another report required to be filed 2 under this article. 3 (F) ON OR BEFORE DECEMBER 31 EACH YEAR, THE DEPARTMENT OF 4 PLANNING SHALL SUBMIT A REPORT ON THE BUIL DING PERMIT INFORMAT ION 5 COLLECTED UNDER THIS SECTION TO THE GOVERNOR AND , IN ACCORDANCE WITH 6 § 2–1257 OF THE STATE GOVERNMENT ARTICLE, THE GENERAL ASSEMBLY. 7 (G) THE DEPARTMENT OF PLANNING MAY ADOPT RE GULATIONS TO CARRY 8 OUT THIS SECTION . 9 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 10 1, 2025. 11
