Page 1 - 131LR1230(01)1 2 3 That the Department of Health and 4 Human Services shall amend its rule Chapter 332: MaineCare Eligibility Manual, Part 16 5 to increase the amount of a prepaid burial contract from $12,000 to $18,000 that is 6 considered unavailable for use as an asset in determining eligibility for MaineCare and 7 further provide that the amount of a prepaid burial contract considered unavailable for use 8 as an asset in determining eligibility for MaineCare must be increased on January 1, 2025, 9 and every year thereafter, by the same percentage as the percentage increase of the 10 Consumer Price Index for the preceding year. For purposes of this section, "Consumer 11 Price Index" has the same meaning as in the Maine Revised Statutes, Title 5, section 17001, 12 subsection 9. 13 14 This resolve requires the Department of Health and Human Services to amend its 15 MaineCare rules to increase the amount of a prepaid burial contract, also known as a 16 mortuary trust, unavailable for use as an asset in determining eligibility for MaineCare from 17 $12,000 to $18,000 and increase that amount yearly by the same percentage as the 18 percentage increase in the Consumer Price Index for the preceding year. 14 15 16 17 18
