This bill is a concept draft pursuant to Joint Rule 208.
In Public Law 2021, chapter 151, the 130th Legislature enacted the Maine Revised
Statutes, Title 35-A, chapter 34-D, which requires certain solar energy developments to
have decommissioning plans. Chapter 34-D applies to solar energy developments on which
construction began on or after October 1, 2021 and to solar energy developments that
undergo a change in ownership on or after October 1, 2021. This bill proposes to address
the issue of decommissioning plans for solar energy developments of a size similar to the
size of developments that are subject to the provisions of chapter 34-D and on which
construction began before October 1, 2021. It also proposes to address the issue of
decommissioning plans for stored energy systems developments.
