Records describing security plans, security procedures or risk assessments prepared 5 specifically for the purpose of preventing or preparing for acts of terrorism, but only to 6 the extent that release of information contained in the record could reasonably be 7 expected to jeopardize the physical safety of government personnel or the public. 8 Information contained in records covered by this paragraph may be disclosed to the 9 Legislature or, in the case of a political or administrative subdivision, to municipal 10 officials or board members under conditions that protect the information from further 11 disclosure. For purposes of this paragraph, "terrorism" means conduct that is designed 12 to cause serious bodily injury or substantial risk of bodily injury to multiple persons, 13 substantial damage to multiple structures whether occupied or unoccupied or 14 substantial physical damage sufficient to disrupt the normal functioning of a critical 15 infrastructure has the same meaning as in Title 37-B, section 703, subsection 8; 16 is enacted to read: 17 18 telecommunications technology infrastructure, systems or services or critical 19 infrastructure, whether physical or non-physical, for the purpose of disrupting, disabling, 20 destroying or maliciously controlling such infrastructure, systems or services or destroying 21 the integrity of the data or stealing the information residing thereon. 22 as enacted by PL 2013, c. 146, §6, is amended 23 to read: 24 25 persons or property to intimidate or coerce a government or civilian population in 26 furtherance of political or social objectives. "Terrorism" includes conduct that is designed 27 to cause serious bodily injury or substantial risk of bodily injury to multiple persons, 28 substantial damage to multiple structures whether occupied or unoccupied or substantial 29 physical damage sufficient to disrupt the normal functioning of a critical infrastructure; or 30 conduct that constitutes a cyberattack on the State's information and telecommunications 31 technology infrastructure, systems or services or critical infrastructure, whether physical or 32 non-physical. 33 34 This bill updates the definition of "terrorism" in the laws governing the Department of 35 Defense, Veterans and Emergency Management, Maine Emergency Management Agency 36 to include acts against non-physical infrastructure, including, but not limited to, 37 information and telecommunications technology infrastructure, systems or services or 38 critical infrastructure.
