Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and Whereas, the Legislature appropriated funds during the 131st Legislature to support certified community behavioral health clinic projects; and Whereas, since the adjournment of the 131st Legislature, the State was accepted into the Certified Community Behavioral Health Clinic Medicaid Demonstration Program by the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services, in partnership with the United States Department of Health and Human Services, Substance Abuse and Mental Health Services Administration; and Whereas, behavioral health clinic projects is needed for state-licensed mental health organizations to establish certified community behavioral health clinics within the federal Medicaid demonstration program and to leverage federal funding for the implementation of a Medicaid prospective payment system model; and Whereas, the federal Medicaid demonstration program is critical to strengthening the community mental health system to provide comprehensive and integrated mental health and substance use services that ensure timely access to care, improve accountability and improve the quality of behavioral health services and supports to meet the needs of people in this State; and Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, Be it enacted by the People of the State of Maine as follows: Sec. 1.
