                    HOUSE BILL NO. 4750  A bill to amend 1986 PA 268, entitled "Legislative council act," by amending section 109 (MCL 4.1109) and by adding section 204h. the people of the state of michigan enact: Sec. 109. An employee of the bureau shall not urge or oppose legislation, but upon on request shall aid and assist the members of the legislature by advising as to bills and resolutions and by furnishing to them the fullest information upon on all matters within the scope of the bureau relating to their public duties. However, the director may recommend legislation to the legislative council or the law revision commission. An employee of the bureau shall not reveal to any person outside the bureau the contents or nature of any matter not yet published without the consent of the person bringing the matter before the bureau. A substitute recommended by a committee, an amendment recommended by a committee, or a conference report shall be is considered published when received by the clerk of the house of representatives or secretary of the senate, or both, as is appropriate. The clerk of the house of representatives or the secretary of the senate, as is appropriate, shall notify the bureau upon on receipt of a substitute, an amendment recommended by a committee, or a conference committee report. A written statement as that term is defined in section 204h is considered published when made available to the public on the internet under section 204h. Sec. 204h. (1) Notwithstanding section 204, the council shall make each written statement provided to the council by a sponsoring legislator available to the public on the internet. (2) The written statement must be made available in the shortest feasible time after the written statement is provided to the council. (3) This section does not alter or relinquish any copyright or other proprietary interest or entitlement of this state relating to any of the information made available under this section. (4) The council shall not charge a fee for the information provided under this section. (5) As used in this section: (a) "Legislatively directed spending item" means that term as defined in section 364 of the management and budget act, 1984 PA 431, MCL 18.1364. (b) "Sponsoring legislator" means that term as defined in section 364 of the management and budget act, 1984 PA 431, MCL 18.1364. (c) "Written statement" means a written statement provided by a sponsoring legislator regarding a legislatively directed spending item under section 364 of the management and budget act, 1984 PA 431, MCL 18.1364. Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 4751 (request no. 02777'23) of the 102nd Legislature is enacted into law.
