1.1 A bill for an act 1.2 relating to education; establishing a developmental delay age limit working group; 1.3 requiring a report. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. DEVELOPMENT AL DELAY AGE LIMIT WORKING GROUP. 1.6 Subdivision 1.Working group.The Department of Education must establish a working 1.7group on the age limit for children receiving special education services for developmental 1.8delay. 1.9 Subd. 2.Members.(a) The commissioner must consult with the organizations identified 1.10in paragraph (b) before naming appointed members to the working group. 1.11 (b) By July 1, 2025, the commissioner must appoint the following members to the 1.12working group: 1.13 (1) the commissioner or the commissioner's designee; 1.14 (2) two representatives from Minnesota Administrators for Special Education, consisting 1.15of one member from the seven-county metropolitan area and one member from outside the 1.16metropolitan area; 1.17 (3) one representative from the Professional Educator Licensing and Standards Board; 1.18 (4) two representatives from the Minnesota Association of Colleges for Teacher 1.19Education; 1.20 (5) two representatives from Education Minnesota, consisting of one member from the 1.21seven-county metropolitan area and one member from outside the metropolitan area; and 1Section 1. No. 1020 NINETY-FOURTH SESSION Authored by Hill, Virnig and Bennett02/17/2025 The bill was read for the first time and referred to the Committee on Education Policy 2.1 (6) two representatives from the PACER Center. 2.2 Subd. 3.Duties.The working group must meet on a regular basis and review current 2.3law limiting the eligibility of children over the age of six years from receiving intervention 2.4services for developmental delay, and assess the impact of raising eligibility to age seven. 2.5The working group must report its findings and recommendations to the legislative 2.6committees with jurisdiction over kindergarten through grade 12 education by February 1, 2.72026. 2.8 Subd. 4.Administrative provisions.(a) The commissioner or commissioner's designee 2.9must convene the initial meeting of the working group. Upon request, the commissioner 2.10must provide meeting space and administrative support for the group. 2.11 (b) Members of the working group serve without compensation or payment of expenses. 2.12 (c) The working group expires February 1, 2026, or upon submission of the report to 2.13the legislature required under subdivision 3, whichever is earlier. 2.14 EFFECTIVE DATE.This section is effective the day following final enactment. 2Section 1.
