1.1 A bill for an act 1.2 relating to food support; creating regional food bank grants; appropriating money; 1.3 proposing coding for new law in Minnesota Statutes, chapter 142F. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. [142F.16] REGIONAL FOOD BANK GRANTS. 1.6 Subdivision 1.Establishment.The commissioner of children, youth, and families shall 1.7establish regional food bank grants to increase the availability of food to individuals and 1.8families in need. 1.9 Subd. 2.Distribution of appropriation.The commissioner shall distribute money 1.10appropriated under this section to regional food banks and federally recognized American 1.11Indian Tribes or Bands in Minnesota as defined in section 10.65. The commissioner shall 1.12distribute money under this section in accordance with the federal The Emergency Food 1.13Assistance Program (TEFAP) formula and guidelines of the United States Department of 1.14Agriculture. The commissioner may increase or decrease a qualifying recipient's proportionate 1.15amount if the commissioner determines the increase or decrease is necessary to meet 1.16community needs or demands for food in Minnesota. Food banks and American Indian 1.17Tribes or Bands must be in compliance with TEFAP regulations from the United States 1.18Department of Agriculture in order to receive funding under this section, as applicable. 1.19 Subd. 3.Allowable uses of funds.(a) Money distributed under this section must be 1.20used by regional food banks to purchase, transport, and coordinate the distribution of food 1.21to TEFAP providers. 1Section 1. No. 1112 NINETY-FOURTH SESSION Authored by Hemmingsen-Jaeger; Johnson, W.; Zeleznikar; Hicks; Coulter and others02/19/2025 The bill was read for the first time and referred to the Committee on Children and Families Finance and Policy 2.1 (b) Money distributed under this section must be used by American Indian Tribes or 2.2Bands to purchase, transport, and coordinate the distribution of food to individuals and 2.3families in need. 2.4 (c) Money distributed under this section may also be used to purchase personal hygiene 2.5products, including but not limited to diapers and toilet paper. 2.6 Subd. 4.Reporting.(a) Food banks and American Indian Tribes or Bands receiving 2.7money under this section must retain records documenting expenditure of the money and 2.8comply with any additional documentation requirements imposed by the commissioner. 2.9 (b) Food banks and American Indian Tribes or Bands shall report on the use of money 2.10received under this section to the commissioner. The commissioner shall determine the 2.11timing and form required for the reports. 2.12 (c) If the commissioner determines that ineligible expenditures are made by food banks 2.13or American Indian Tribes or Bands receiving money under this section, the ineligible 2.14amount must be repaid to the commissioner and deposited in the general fund. 2.15 Sec. 2. APPROPRIATION; REGIONAL FOOD BANK GRANTS. 2.16 $10,000,000 in fiscal year 2026 and $10,000,000 in fiscal year 2027 are appropriated 2.17from the general fund to the commissioner of children, youth, and families for the purposes 2.18of Minnesota Statutes, section 142F.16. 2Sec. 2.
