1.1 A bill for an act
1.2 relating to child care licensing; amending family child care capacity limits.
1.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.4 Section 1. DIRECTION TO COMMISSIONER OF HUMAN SERVICES;
1.5AMENDING CAPACITY LIMITS.
1.6 (a) The commissioner of children, youth, and families must amend Minnesota Rules,
1.7part 9502.0365, subpart 1, item A, to exclude up to two of the caregiver's own children for
1.8the purposes of the licensed capacity.
1.9 (b) For purposes of this section and notwithstanding any other requirements for good
1.10cause exempt rulemaking, the commissioner may use the process under Minnesota Statutes,
1.11section 14.388, subdivision 1, clause (3), and Minnesota Statutes, section 14.386, does not
1.12apply except as provided under Minnesota Statutes, section, 14.388.
