                    1.1	A bill for an act​
1.2 relating to human services; requiring the commissioner of human services to​
1.3 establish a minimum per diem rate for a specified psychiatric residential treatment​
1.4 facility; appropriating money for a psychiatric residential treatment facility in Clay​
1.5 County; appropriating money for psychiatric residential treatment facility start-up​
1.6 and capacity-building grants; amending Laws 2023, chapter 70, article 20, section​
1.7 2, subdivision 30.​
1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.9 Section 1. Laws 2023, chapter 70, article 20, section 2, subdivision 30, is amended to​
1.10read:​

1.12Grants​
1.13(a) Psychiatric residential treatment facility​
1.14start-up grants. $1,000,000 in fiscal year​
1.152024 and $1,000,000 $800,000 in fiscal year​
1.162025 are for psychiatric residential treatment​
1.17facility start-up grants under Minnesota​
1.18Statutes, section 256B.0941, subdivision 5.​
1.19This is a onetime appropriation and is​
1.20available until June 30, 2027.​
1.21(b) African American Child Wellness​
1.22Institute. $2,000,000 in fiscal year 2024 is​
1.23for a grant to the African American Child​
1.24Wellness Institute to provide culturally​
1.25specific mental health and substance use​

2.5(c) Base level adjustment. The general fund​
2.6base is $34,648,000 in fiscal year 2026 and​
2.7$34,648,000 in fiscal year 2027.​
2.8 Sec. 2. DIRECTION TO COMMISSIONER OF HUMAN SERVICES; CLAY​
2.9COUNTY PSYCHIATRIC RESIDENTIAL TREATMENT FACILITY PER DIEM​
2.10RATE.​
2.11 Notwithstanding any statutory requirements to the contrary under Minnesota Statutes,​
2.12section 256B.0941, subdivision 3, when establishing the provider-specific per diem rate​
2.13under Minnesota Statutes, section 256B.0941, subdivision 3, for the Clay County psychiatric​
2.14residential treatment facility, the commissioner of human services must establish the rate​
2.15in an amount equal to or greater than $1,800 per diem.​
2.16 Sec. 3. APPROPRIATION; CLAY COUNTY PSYCHIATRIC RESIDENTIAL​
2.17TREATMENT FACILITY.​
2.18 $1,000,000 in fiscal year 2026 is appropriated from the general fund to the commissioner​
2.19of human services for a grant to Clay County for costs related to the purchase of equipment​
2.20and final redesign and remodeling for the conversion of the West Central Regional Juvenile​
2.21Center nonsecure unit into an 18-bed psychiatric residential treatment facility for persons​
2.22younger than 21 years of age, pursuant to Minnesota Statutes, section 256B.0941. This is​
2.23a onetime appropriation.​
2.24 Sec. 4. APPROPRIATIONS; PSYCHIATRIC RESIDENTIAL TREATMENT​
2.25START-UP AND CAPACITY-BUILDING GRANTS.​
2.26 $1,000,000 in fiscal year 2026 and $1,000,000 in fiscal year 2027 are appropriated from​
2.27the general fund to the commissioner of human services for psychiatric residential treatment​
2.28facility start-up and capacity-building grants under Minnesota Statutes, section 256B.0941,​
2.29subdivision 5. Of these amounts, $200,000 in fiscal year 2026 is for a grant award to Clay​
2.30County for eligible grant activities related to a new 18-bed psychiatric residential treatment​
2.31facility in the county. This is a onetime appropriation and is available until June 30, 2029.​
