                    1.1	A bill for an act​
1.2 relating to local government; allowing local government noncompliance with​
1.3 unfunded mandates; proposing coding for new law in Minnesota Statutes, chapters​
1.4 373; 471.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. [373.52] NO MANDATES WITHOUT FUNDING.​
1.7 Subdivision 1.County noncompliance allowed.(a) Except as provided under subdivision​
1.82, a county is not required to comply with a state mandate in paragraph (b) until a state law​
1.9provides a county with the amount of revenue needed to pay for the mandate.​
1.10 (b) A state mandate that a county is not required to comply with under paragraph (a) is​
1.11a mandate that:​
1.12 (1) affects the daily operation of a county government;​
1.13 (2) changes the allocation of a county's resources; or​
1.14 (3) changes a county's spending priorities.​
1.15 Subd. 2.Exceptions.A county must comply with a state mandate if the amount of​
1.16revenue needed for compliance is incidental compared to the county's total budget. A county​
1.17must continue compliance with any law that governs financial audit requirements or that​
1.18directly affects the safety and health of county residents.​
1.19 EFFECTIVE DATE.This section applies to state mandates that are in effect after June​
1.2030, 2025.​

2.6 (b) A state mandate that a municipality is not required to comply with under paragraph​
2.7(a) is a mandate that:​
2.8 (1) affects the daily operation of municipal government;​
2.9 (2) changes the allocation of municipal resources; or​
2.10 (3) changes a municipality's spending priorities.​
2.11 Subd. 2.Exceptions.A municipality must comply with a state mandate if the amount​
2.12of revenue needed for compliance is incidental compared to the municipality's total budget.​
2.13A municipality must continue compliance with any law that governs financial audit​
2.14requirements or that directly affects the safety and health of municipal residents.​
