                    1.1	A bill for an act​
1.2 relating to human services; modifying background check requirements for certain​
1.3 housing support providers; amending Minnesota Statutes 2024, section 256I.04,​
1.4 subdivision 2c.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 256I.04, subdivision 2c, is amended to read:​
1.7 Subd. 2c.Background study requirements.(a) Effective July 1, 2016, A provider of​
1.8housing support must initiate background studies in accordance with chapter 245C of the​
1.9following individuals:​
1.10 (1) controlling individuals as defined in section 245A.02;​
1.11 (2) managerial officials as defined in section 245A.02; and​
1.12 (3) all employees and volunteers of the establishment who have direct contact with​
1.13recipients, or who have unsupervised access to recipients, their personal property, or their​
1.14private data.​
1.15 (b) The provider of housing support must maintain compliance with all requirements​
1.16established for entities initiating background studies under chapter 245C.​
1.17 (c) Effective July 1, 2017, A provider of housing support must demonstrate that all​
1.18individuals required to have a background study according to paragraph (a) have a notice​
1.19stating either that:​
1.20 (1) the individual is not disqualified under section 245C.14; or​

The bill was read for the first time and referred to the Committee on Human Services Finance and Policy​ 2.1 (2) the individual is disqualified, but the individual has been issued a set-aside of the​
2.2disqualification for that setting under section 245C.22.​
2.3 (d) Notwithstanding paragraph (a), providers of supportive housing and emergency​
2.4shelter are not required to initiate background studies under chapter 245C.​
