1.1 A bill for an act 1.2 relating to education; removing the requirement for an American Indian Parent 1.3 Advisory Committee to concur for a district to receive American Indian education 1.4 aid; amending Minnesota Statutes 2024, section 124D.81, subdivision 2b. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 124D.81, subdivision 2b, is amended to read: 1.7 Subd. 2b.Carry forward of funds.Notwithstanding section 16A.28, if a school district 1.8or Tribal contract school does not expend the full amount of the American Indian education 1.9aid in accordance with the plan in the designated fiscal year, the school district or Tribal 1.10contract school may carry forward and expend up to half of the remaining funds in the 1.11following fiscal year, and is not subject to an aid reduction if: 1.12 (1) the district is otherwise following the plan submitted and approved under subdivision 1.132; 1.14 (2) the American Indian Parent Advisory Committee for the school is aware of and has 1.15approved the carry forward and has concurred with for the district's educational offerings 1.16extended to American Indian students under section 124D.78; 1.17 (3) the funds carried over are used in accordance with section 124D.74, subdivision 1; 1.18and 1.19 (4) by April 1, the district reports to the Department of Education American Indian 1.20education director the reason the aid was not expended in the designated fiscal year, and 1.21describes how the district intends to expend the funds in the following fiscal year.
