1.1 A bill for an act
1.2 relating to transportation; requiring local approval before Department of
1.3 Transportation may acquire easements for certain road projects; proposing coding
1.4 for new law in Minnesota Statutes, chapter 160.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [160.086] LOCAL APPROVAL REQUIRED FOR CERTAIN
1.7EASEMENTS.
1.8 Subdivision 1.Definitions.(a) For purposes of this section, the following terms have
1.9the meanings given.
1.10 (b) "Easement" means the acquisition or designation of private or public land for the
1.11purpose of constructing, maintaining, or improving certain project elements related to a
1.12road construction project.
1.13 (c) "Local approval" means the approval by a statutory or home rule charter city, county,
1.14or town either by:
1.15 (1) a formal resolution adopted by the governing body of the local government unit; or
1.16 (2) a vote at the next general election and, if approved by a majority of those voting on
1.17the question, becoming effective following the final canvass of the election.
1.18 (d) "Roadway project elements" means the construction, maintenance, improvement,
1.19capacity expansion, reconstruction, resurfacing, or any other development of roadway
1.20infrastructure including shoulders, ditches, and culverts for the exclusive use of motor
1.21vehicle travel on the trunk highway system.

2.5on or after that date.
