1.1 A bill for an act 1.2 relating to environment; reenacting prior law prohibiting weather modification; 1.3 providing criminal penalties; proposing coding for new law in Minnesota Statutes, chapter 42. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [42.15] POLICY. 1.7 The legislature finds it necessary for the state to ensure public safety, human health, and 1.8environmental welfare by protecting citizens against weather modification. 1.9 Sec. 2. [42.16] SOVEREIGN RIGHT CLAIMED BY STATE. 1.10 For the best interest of its residents, the state claims its sovereign right to ensure public 1.11safety, human health, and environmental welfare and to protect its citizens within state 1.12boundaries and in the airspace above state boundaries. 1.13 Sec. 3. [42.17] DEFINITIONS. 1.14 (a) For purposes of this chapter, the terms defined in this section have the meanings 1.15given. 1.16 (b) "Modification" means performance or attempted performance of or an activity or 1.17attempted activity in connection with the intentional placement, injection, release, or 1.18dispersion, by any means, of a chemical, a chemical compound, a substance, or an apparatus 1.19into the atmosphere or clouds within the atmosphere, including cloud or atmosphere seeding, 1.20for the purpose of producing or attempting to produce a modifying effect to the composition, 1.21motion, or resulting behavior of the weather. 1Sec. 3. [42.18] PROHIBITION. 2.7 Notwithstanding any other law to the contrary, a person must not engage or attempt to 2.8engage in weather modification within the state's sovereign boundaries or in the airspace 2.9above the state's boundaries. 2.10 Sec. 5.
