                    1.1	A bill for an act​
1.21.3 relating to corrections; requiring the commissioner of corrections to submit certain​
1.4 proposed rules for legislative approval prior to implementation; amending​
1.5 Minnesota Statutes 2024, section 241.021, by adding a subdivision.​
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.7 Section 1. Minnesota Statutes 2024, section 241.021, is amended by adding a subdivision​
1.8to read:​
1.9 Subd. 1j.Legislative approval required.(a) When the commissioner adopts a new or​
1.10amends an existing rule pursuant to the authority granted in subdivision 1, the commissioner​
1.11must determine if the cost of complying with the rule in the first year after the rule takes​
1.12effect will exceed $25,000 for a jail, lockup, or workhouse. The commissioner must make​
1.13the determination required under this paragraph before the close of the hearing record, or​
1.14before the commissioner submits the record to the administrative law judge if there is no​
1.15hearing. The administrative law judge must review and approve or disapprove the agency​
1.16determination under this section.​
1.17 (b) If the commissioner determines that the cost exceeds the threshold in paragraph (a),​
1.18or if the administrative law judge disapproves the agency's determination that the cost does​
1.19not exceed the threshold in paragraph (a), any jail, lockup, or workhouse may file a written​
1.20statement with the commissioner claiming a temporary exemption from the rules. Upon​
1.21filing of the statement with the commissioner, the rules do not apply to that jail, lockup, or​
1.22workhouse until the rules are approved by a law enacted after the commissioner's​
1.23determination or administrative law judge's disapproval.​
