1.1 A bill for an act
1.2 relating to local government; prohibiting outgoing officials from voting on new
1.3 municipal debt obligations; amending Minnesota Statutes 2024, sections 475.51,
1.4 by adding a subdivision; 475.52, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 475.51, is amended by adding a subdivision
1.7to read:
1.8 Subd. 15.Outgoing official."Outgoing official" means a person who is serving the
1.9remainder of the person's term in an elected or appointed position in a governing body after
1.10the election or appointment of the person's successor.
1.11 Sec. 2. Minnesota Statutes 2024, section 475.52, is amended by adding a subdivision to
1.12read:
1.13 Subd. 7.Limitation on outgoing officials.(a) An outgoing official must abstain from
1.14any vote by the governing body of a municipality to issue a new obligation of the
1.15municipality. If an outgoing local official votes in violation of this paragraph, the governing
1.16body must not count the outgoing official's vote.
1.17 (b) Paragraph (a) does not apply to the issuance of a new obligation that is subject to
1.18approval of a majority of electors under section 475.58.
