1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. [16B.2971] ACQUISITION OF PROPERTY PROHIBITED; FLOOD​
1.7CONTROL AND WATER RETENTION.​
1.8 (a) An agency or nonprofit organization may not acquire real property in fee or by​
1.9easement for the purpose of a flood control or water retention project if the state owns land​
1.10within the project area.​
1.11 (b) For the purposes of this section, a "flood control or water retention project" is a​
1.12project with the primary purpose to hold water on the land or otherwise prevent flooding.​
