1.1 A bill for an act 1.2 relating to public safety; modifying the fleeing a peace officer crime; amending 1.3 Minnesota Statutes 2024, sections 171.174; 609.487, subdivisions 3, 5, by adding 1.4 a subdivision. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 171.174, is amended to read: 1.7 171.174 REVOCATION; FLEEING PEACE OFFICER OFFENSE. 1.8 The commissioner of public safety shall revoke the license of a person upon receipt of 1.9a certificate of conviction showing that the person has in a motor vehicle violated section 1.10609.487, subdivision 3, 3a, or 4, or an ordinance in conformity with those subdivisions. The 1.11commissioner shall revoke the license as follows: 1.12 (1) for the first offense under section 609.487, subdivision 3, for not less than one year; 1.13 (2) (1) for the second offense or subsequent offenses under section 609.487, subdivision 1.143, for not less than three years one year; 1.15 (2) for an offense under section 609.487, subdivision 3a, for not less than two years; 1.16 (3) for an offense under section 609.487, subdivision 4, clause (a), for not less than ten 1.17years; 1.18 (4) for an offense under section 609.487, subdivision 4, clause (b), for not less than 1.19seven years; and 1.20 (5) for an offense under section 609.487, subdivision 4, clause (c), for not less than five 1.21years. 1Section 1. 25-03115 as introduced02/03/25 REVISOR KLL/CH SENATE STATE OF MINNESOTA S.F. Minnesota Statutes 2024, section 609.487, subdivision 3, is amended to read: 2.7 Subd. 3.Fleeing officer; motor vehicle.Whoever by means of a motor vehicle flees 2.8or attempts to flee a peace officer who is acting in the lawful discharge of an official duty, 2.9and the perpetrator knows or should reasonably know the same to be a peace officer, is 2.10guilty of a felony and may be sentenced to imprisonment for not more than three years and 2.11one day or to payment of a fine of not more than $5,000, or both gross misdemeanor. 2.12 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes 2.13committed on or after that date. 2.14 Sec. 3. Minnesota Statutes 2024, section 609.487, is amended by adding a subdivision to 2.15read: 2.16 Subd. 3a.Fleeing an officer; motor vehicle; culpable negligence.Whoever, by means 2.17of a motor vehicle, flees or attempts to flee a peace officer who is acting in the lawful 2.18discharge of an official duty, and the perpetrator knows or should reasonably know the same 2.19to be a peace officer, and who in the course of fleeing operates the vehicle in a culpably 2.20negligent manner whereby the perpetrator creates an unreasonable risk and consciously 2.21takes chances of causing death or great bodily harm to another, is guilty of a felony and 2.22may be sentenced to imprisonment for not more than three years or to payment of a fine of 2.23not more than $5,000, or both. 2.24 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to crimes 2.25committed on or after that date. 2.26 Sec. 4.
