                    1.1	A bill for an act​
1.2 relating to environment; prohibiting the commissioner from adopting rules that​
1.3 apply only to construction and demolition landfills; amending Minnesota Statutes​
1.4 2024, section 115A.06, subdivision 2.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 115A.06, subdivision 2, is amended to read:​
1.7 Subd. 2.Rules.(a) Unless otherwise provided, the commissioner shall promulgate rules​
1.8in accordance with chapter 14 to govern the agency's activities and implement this chapter.​
1.9 (b) Notwithstanding paragraph (a) or any other provision of law, the commissioner must​
1.10not adopt any rules that exclusively govern solid waste disposal facilities that accept only:​
1.11 (1) construction and demolition debris and incidental nonrecyclable packaging; or​
1.12 (2) industrial waste that is limited to wood, concrete, porcelain fixtures, shingles, or​
1.13window glass resulting from the manufacture of construction materials.​
1.14 EFFECTIVE DATE.This section is effective the day following final enactment and​
1.15applies to any proposed or adopted rule not yet effective on or after that date.​
