1.2 relating to education; establishing a developmental delay age limit working group;​
1.3 requiring a report.​
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.5 Section 1. DEVELOPMENT AL DELAY AGE LIMIT WORKING GROUP.​
1.6 Subdivision 1.Working group.The Department of Education must establish a working​
1.7group on the age limit for children receiving special education services for developmental​
1.8delay.​
1.9 Subd. 2.Members.(a) The commissioner of education must consult with the​
1.10organizations identified in paragraph (b) before naming appointed members to the working​
1.11group.​
1.12 (b) By July 1, 2025, the commissioner must appoint the following members to the​
1.13working group:​
1.14 (1) the commissioner or the commissioner's designee;​
1.15 (2) two representatives from Minnesota Administrators for Special Education, consisting​
1.16of one member from the seven-county metropolitan area and one member from outside the​
1.17metropolitan area;​
1.18 (3) one representative from the Professional Educator Licensing and Standards Board;​
1.19 (4) two representatives from the Minnesota Association of Colleges for Teacher​
1.20Education;​

2.4 (7) two representatives from the Minnesota School Psychologists Association, consisting​
2.5of one member working in a school setting and one member working in a postsecondary​
2.6school psychologist preparation program.​
2.7 Subd. 3.Duties.The working group must meet on a regular basis and review current​
2.8law limiting the eligibility of children seven years old or older from receiving intervention​
2.9services for developmental delay, and assess the impact of extending eligibility to children​
2.10under age nine. The working group must report its findings and recommendations to the​
2.11legislative committees with jurisdiction over kindergarten through grade 12 education by​
2.12February 1, 2026.​
2.13 Subd. 4.Administrative provisions.(a) The commissioner or commissioner's designee​
2.14must convene the initial meeting of the working group. Upon request, the commissioner​
2.15must provide meeting space and administrative support for the group.​
2.16 (b) Members of the working group serve without compensation or payment of expenses.​
2.17 (c) The working group expires February 1, 2026, or upon submission of the report to​
2.18the legislature required under subdivision 3, whichever is earlier.​
2.19 EFFECTIVE DATE.This section is effective the day following final enactment.​
