Any 6compensationforadditionaldutiesrelatingtoserviceasaschoolprotectionofficershallbe 7fundedbythelocalschooldistrict,withnostatefundsusedforsuchpurpose. 8 2.Anypersondesignatedbyaschooldistrictasaschoolprotectionofficershallbe 9authorizedtocarryconcealedfirearmsoraself-defensespraydeviceinanyschoolinthe 10district.Aself-defensespraydeviceshallmeananydevicethatiscapableofcarrying,and 11thatejects,releases,oremits,anonlethalsolutioncapableofincapacitatingaviolentthreat. 12Theschoolprotectionofficershallnotbepermittedtoallowanyfirearmordeviceoutof[his 13orher]theofficer'spersonalcontrolwhilethatfirearmordeviceisonschoolproperty.Any 14schoolprotectionofficerwhoviolatesthissubsectionmayberemovedimmediatelyfromthe 15classroomandsubjecttoemploymentterminationproceedings. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 3.Aschoolprotectionofficerhasthesameauthoritytodetainoruseforceagainstany 17persononschoolpropertyasprovidedtoanyotherpersonunderchapter563. 18 4.Upondetentionofapersonundersubsection3ofthissection,theschoolprotection 19officershallimmediatelynotifyaschooladministratorandaschoolresourceofficer,ifsuch 20officerispresentattheschool.Ifthepersondetainedisastudentthentheparentsor 21guardiansofthestudentshallalsobeimmediatelynotifiedbyaschooladministrator. 22 5.Anypersondetainedbyaschoolprotectionofficershallbeturnedovertoaschool 23administratororlawenforcementofficerassoonaspracticallypossibleandshallnotbe 24detainedbyaschoolprotectionofficerformorethanonehour. 25 6.Anyteacher[or],administrator, orotherdesignatedschoolpersonnelofan 26elementaryorsecondaryschoolwhoseekstobedesignatedasaschoolprotectionofficer 27shallrequestsuchdesignationinwriting,andsubmitittothesuperintendentoftheschool 28district[which] thatemploys[himorher]suchindividualasateacher[or],administrator, or 29otherdesignatedschoolpersonnel. Alongwiththisrequest,anyteacher[or],administrator, 30orotherdesignatedschoolpersonnelseekingtocarryaconcealedfirearmonschool 31propertyshallalsosubmitproofthat[heorshe]suchindividualhasavalidconcealedcarry 32endorsementorpermit,andallteachers[and],administrators, andotherdesignatedschool 33personnelseekingthedesignationofschoolprotectionofficershallsubmitacertificateof 34schoolprotectionofficertrainingprogramcompletionfromatrainingprogramapprovedby 35thedirectorofthedepartmentofpublicsafetywhichdemonstratesthatsuchpersonhas 36successfullycompletedthetrainingrequirementsestablishedbythePOSTcommissionunder 37chapter590forschoolprotectionofficers. 38 7.Noschooldistrictmaydesignateateacher[or],administrator, orotherdesignated 39schoolpersonnelasaschoolprotectionofficerunlesssuchpersonhassuccessfully 40completedaschoolprotectionofficertrainingprogram,whichhasbeenapprovedbythe 41directorofthedepartmentofpublicsafety.Noschooldistrictshallallowaschoolprotection 42officertocarryaconcealedfirearmonschoolpropertyunlesstheschoolprotectionofficer 43hasavalidconcealedcarryendorsementorpermit. 44 8.(1)Anyschooldistrictthatdesignatesateacher[or],administrator, orother 45designatedschoolpersonnelasaschoolprotectionofficershall,withinthirtydays,notify,in 46writing,thedirectorofthedepartmentofpublicsafetyofthedesignation,whichshallinclude 47thefollowing: 48 [(1)](a)Thefullname,dateofbirth,andaddressoftheofficer; 49 [(2)](b)Thenameoftheschooldistrict;and 50 [(3)](c)Thedatesuchpersonwasdesignatedasaschoolprotectionofficer. 50 (6)Thegeneralassembly,supremecourt,countyormunicipalitymaybyrule, 51administrativeregulation,orordinanceprohibitorlimitthecarryingofconcealedfirearmsby 52permitorendorsementholdersinthatportionofabuildingowned,leasedorcontrolledby HB1481 4 53thatunitofgovernment.Anyportionofabuildinginwhichthecarryingofconcealed 54firearmsisprohibitedorlimitedshallbeclearlyidentifiedbysignspostedattheentranceto 55therestrictedarea.Thestatute,ruleorordinanceshallexemptanybuildingusedforpublic 56housingbyprivatepersons,highwaysorrestareas,firingranges,andprivatedwellings 57owned,leased,orcontrolledbythatunitofgovernmentfromanyrestrictiononthecarrying 58orpossessionofafirearm.Thestatute,ruleorordinanceshallnotspecifyanycriminal 59penaltyforitsviolationbutmayspecifythatpersonsviolatingthestatute,ruleorordinance 60maybedeniedentrancetothebuilding,orderedtoleavethebuildingandifemployeesofthe 61unitofgovernment,besubjectedtodisciplinarymeasuresforviolationoftheprovisionsof 62thestatute,ruleorordinance.Theprovisionsofthissubdivisionshallnotapplytoanyother 63unitofgovernment; 64 (7)Anyestablishmentlicensedtodispenseintoxicatingliquorforconsumptiononthe 65premises,whichportionisprimarilydevotedtothatpurpose,withouttheconsentofthe 66ownerormanager.Theprovisionsofthissubdivisionshallnotapplytothelicenseeofsaid 67establishment.Theprovisionsofthissubdivisionshallnotapplytoanybonafiderestaurant 68opentothegeneralpublichavingdiningfacilitiesfornotlessthanfiftypersonsandthat 69receivesatleastfifty-onepercentofitsgrossannualincomefromthediningfacilitiesbythe 70saleoffood.Thissubdivisiondoesnotprohibitthepossessionofafirearminavehicleonthe 71premisesoftheestablishmentandshallnotbeacriminaloffensesolongasthefirearmisnot 72removedfromthevehicleorbrandishedwhilethevehicleisonthepremises.Nothinginthis 73subdivisionauthorizesanyindividualwhohasbeenissuedaconcealedcarrypermitor 74endorsementtopossessanyfirearmwhileintoxicated; 75 (8)Anyareaofanairporttowhichaccessiscontrolledbytheinspectionofpersons 76andproperty.Possessionofafirearminavehicleonthepremisesoftheairportshallnotbea 77criminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhile 78thevehicleisonthepremises; 79 (9)Anyplacewherethecarryingofafirearmisprohibitedbyfederallaw; 80 (10)Anyhighereducationinstitutionorelementaryorsecondaryschoolfacility 81withouttheconsentofthegoverningbodyofthehighereducationinstitutionoraschool 82officialorthedistrictschoolboard,unlessthepersonwiththeconcealedcarryendorsementor 83permitisateacher[or],administrator, orotherdesignatedschoolpersonnelofan 84elementaryorsecondaryschoolwhohasbeendesignatedby[hisorher]suchindividual's 85schooldistrictasaschoolprotectionofficerandiscarryingafirearminaschoolwithinthat 86district,inwhichcasenoconsentisrequired.Possessionofafirearminavehicleonthe 87premisesofanyhighereducationinstitutionorelementaryorsecondaryschoolfacilityshall 88notbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandished 89whilethevehicleisonthepremises; HB1481 5 90 (11)Anyportionofabuildingusedasachildcarefacilitywithouttheconsentofthe 91manager.Nothinginthissubdivisionshallpreventtheoperatorofachildcarefacilityina 92familyhomefromowningorpossessingafirearmoraconcealedcarrypermitor 93endorsement; 94 (12)Anyriverboatgamblingoperationaccessiblebythepublicwithouttheconsent 95oftheownerormanagerpursuanttorulespromulgatedbythegamingcommission. 96Possessionofafirearminavehicleonthepremisesofariverboatgamblingoperationshall 97notbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandished 98whilethevehicleisonthepremises; HB1481 6 125 (17)Anyhospitalaccessiblebythepublic.Possessionofafirearminavehicleonthe 126premisesofahospitalshallnotbeacriminaloffensesolongasthefirearmisnotremoved 127fromthevehicleorbrandishedwhilethevehicleisonthepremises. 128 2.Carryingofaconcealedfirearminalocationspecifiedinsubdivisions(1)to(17) 129ofsubsection1ofthissectionbyanyindividualwhoholdsaconcealedcarrypermitissued 130pursuanttosections571.101to571.121,oraconcealedcarryendorsementissuedpriorto 131August28,2013,shallnotbeacriminalactbutmaysubjectthepersontodenialtothe 132premisesorremovalfromthepremises.Ifsuchpersonrefusestoleavethepremisesanda 133peaceofficerissummoned,suchpersonmaybeissuedacitationforanamountnottoexceed 134onehundreddollarsforthefirstoffense.Ifasecondcitationforasimilarviolationoccurs 135withinasix-monthperiod,suchpersonshallbefinedanamountnottoexceedtwohundred 136dollarsand[hisorher]suchindividual'spermit,and,ifapplicable,endorsementtocarry 137concealedfirearmsshallbesuspendedforaperiodofoneyear.Ifathirdcitationforasimilar 138violationisissuedwithinoneyearofthefirstcitation,suchpersonshallbefinedanamount 139nottoexceedfivehundreddollarsandshallhave[hisorher]suchindividual'sconcealed 140carrypermit,and,ifapplicable,endorsementrevokedandsuchpersonshallnotbeeligiblefor 141aconcealedcarrypermitforaperiodofthreeyears.Uponconvictionofchargesarisingfrom 142acitationissuedpursuanttothissubsection,thecourtshallnotifythesheriffofthecounty 143whichissuedtheconcealedcarrypermit,or,ifthepersonisaholderofaconcealedcarry 144endorsementissuedpriortoAugust28,2013,thecourtshallnotifythesheriffofthecounty 145whichissuedthecertificateofqualificationforaconcealedcarryendorsementandthe 146departmentofrevenue.Thesheriffshallsuspendorrevoketheconcealedcarrypermitor,if 147applicable,thecertificateofqualificationforaconcealedcarryendorsement.Iftheperson 148holdsanendorsement,thedepartmentofrevenueshallissueanoticeofsuchsuspensionor 149revocationoftheconcealedcarryendorsementandtakeactiontoremovetheconcealedcarry 150endorsementfromtheindividual'sdrivingrecord.Thedirectorofrevenueshallnotifythe 151licenseethat[heorshe]thelicenseemustapplyforanewlicensepursuanttochapter302 152whichdoesnotcontainsuchendorsement.Thenoticeissuedbythedepartmentofrevenue 153shallbemailedtothelastknownaddressshownontheindividual'sdrivingrecord.The 154noticeisdeemedreceivedthreedaysaftermailing. 571.215.1.AMissourilifetimeorextendedconcealedcarrypermitissuedunder 2sections571.205to571.230shallauthorizethepersoninwhosenamethepermitisissuedto 3carryconcealedfirearmsonorabout[hisorher]theindividual'spersonorvehicle 4throughoutthestate.NoMissourilifetimeorextendedconcealedcarrypermitshallauthorize 5anypersontocarryconcealedfirearmsinto: 6 (1)Anypolice,sheriff,orhighwaypatrolofficeorstationwithouttheconsentofthe 7chieflawenforcementofficerinchargeofthatofficeorstation.Possessionofafirearmina HB1481 7 8vehicleonthepremisesoftheofficeorstationshallnotbeacriminaloffensesolongasthe 9firearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 47 (6)Thegeneralassembly,supremecourt,county,ormunicipalitymaybyrule, 48administrativeregulation,orordinanceprohibitorlimitthecarryingofconcealedfirearmsby 49permitholdersinthatportionofabuildingowned,leased,orcontrolledbythatunitof 50government.Anyportionofabuildinginwhichthecarryingofconcealedfirearmsis 51prohibitedorlimitedshallbeclearlyidentifiedbysignspostedattheentrancetotherestricted 52area.Thestatute,rule,orordinanceshallexemptanybuildingusedforpublichousingby 53privatepersons,highwaysorrestareas,firingranges,andprivatedwellingsowned,leased,or 54controlledbythatunitofgovernmentfromanyrestrictiononthecarryingorpossessionofa 55firearm.Thestatute,rule,orordinanceshallnotspecifyanycriminalpenaltyforitsviolation 56butmayspecifythatpersonsviolatingthestatute,rule,orordinancemaybedeniedentrance 57tothebuilding,orderedtoleavethebuildingandifemployeesoftheunitofgovernment,be 58subjectedtodisciplinarymeasuresforviolationoftheprovisionsofthestatute,rule,or 59ordinance.Theprovisionsofthissubdivisionshallnotapplytoanyotherunitofgovernment; 60 (7)Anyestablishmentlicensedtodispenseintoxicatingliquorforconsumptiononthe 61premises,whichportionisprimarilydevotedtothatpurpose,withouttheconsentofthe 62ownerormanager.Theprovisionsofthissubdivisionshallnotapplytothelicenseeofsaid 63establishment.Theprovisionsofthissubdivisionshallnotapplytoanybonafiderestaurant 64opentothegeneralpublichavingdiningfacilitiesfornotlessthanfiftypersonsandthat 65receivesatleastfifty-onepercentofitsgrossannualincomefromthediningfacilitiesbythe 66saleoffood.Thissubdivisiondoesnotprohibitthepossessionofafirearminavehicleonthe 67premisesoftheestablishmentandshallnotbeacriminaloffensesolongasthefirearmisnot 68removedfromthevehicleorbrandishedwhilethevehicleisonthepremises.Nothinginthis 69subdivisionauthorizesanyindividualwhohasbeenissuedaMissourilifetimeorextended 70concealedcarrypermittopossessanyfirearmwhileintoxicated; 71 (8)Anyareaofanairporttowhichaccessiscontrolledbytheinspectionofpersons 72andproperty.Possessionofafirearminavehicleonthepremisesoftheairportshallnotbea 73criminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhile 74thevehicleisonthepremises; 75 (9)Anyplacewherethecarryingofafirearmisprohibitedbyfederallaw; 76 (10)Anyhighereducationinstitutionorelementaryorsecondaryschoolfacility 77withouttheconsentofthegoverningbodyofthehighereducationinstitutionoraschool 78officialorthedistrictschoolboard,unlessthepersonwiththeMissourilifetimeorextended 79concealedcarrypermitisateacher[or],administrator, orotherdesignatedschoolpersonnel 80ofanelementaryorsecondaryschoolwhohasbeendesignatedby[hisorher]such 81individual'sschooldistrictasaschoolprotectionofficerandiscarryingafirearminaschool HB1481 9 82withinthatdistrict,inwhichcasenoconsentisrequired.Possessionofafirearminavehicle 83onthepremisesofanyhighereducationinstitutionorelementaryorsecondaryschoolfacility 84shallnotbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleor 85brandishedwhilethevehicleisonthepremises; 86 (11)Anyportionofabuildingusedasachildcarefacilitywithouttheconsentofthe 87manager.Nothinginthissubdivisionshallpreventtheoperatorofachildcarefacilityina 88familyhomefromowningorpossessingafirearmoraMissourilifetimeorextended 89concealedcarrypermit; 90 (12)Anyriverboatgamblingoperationaccessiblebythepublicwithouttheconsent 91oftheownerormanagerunderrulespromulgatedbythegamingcommission.Possessionof 92afirearminavehicleonthepremisesofariverboatgamblingoperationshallnotbea 93criminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhile 94thevehicleisonthepremises; 95 (13)Anygatedareaofanamusementpark.Possessionofafirearminavehicleon 96thepremisesoftheamusementparkshallnotbeacriminaloffensesolongasthefirearmis 97notremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 98 (14)Anychurchorotherplaceofreligiousworshipwithouttheconsentofthe 99ministerorpersonorpersonsrepresentingthereligiousorganizationthatexercisescontrol 100overtheplaceofreligiousworship.Possessionofafirearminavehicleonthepremisesshall 101notbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandished 102whilethevehicleisonthepremises; 103 (15)Anyprivatepropertywhoseownerhaspostedthepremisesasbeingoff-limitsto 104concealedfirearmsbymeansofoneormoresignsdisplayedinaconspicuousplaceofa 105minimumsizeofeleveninchesbyfourteenincheswiththewritingthereoninlettersofnot 106lessthanoneinch.Theowner,businessorcommerciallessee,managerofaprivatebusiness 107enterprise,oranyotherorganization,entity,orpersonmayprohibitpersonsholdinga 108Missourilifetimeorextendedconcealedcarrypermitfromcarryingconcealedfirearmsonthe 109premisesandmayprohibitemployees,notauthorizedbytheemployer,holdingaMissouri 110lifetimeorextendedconcealedcarrypermitfromcarryingconcealedfirearmsontheproperty 111oftheemployer.Ifthebuildingorthepremisesareopentothepublic,theemployerofthe 112businessenterpriseshallpostsignsonoraboutthepremisesifcarryingaconcealedfirearmis 113prohibited.Possessionofafirearminavehicleonthepremisesshallnotbeacriminal 114offensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicle 115isonthepremises.AnemployermayprohibitemployeesorotherpersonsholdingaMissouri 116lifetimeorextendedconcealedcarrypermitfromcarryingaconcealedfirearminvehicles 117ownedbytheemployer; HB1481 10 118 (16)Anysportsarenaorstadiumwithaseatingcapacityoffivethousandormore. 119Possessionofafirearminavehicleonthepremisesshallnotbeacriminaloffensesolongas 120thefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthe 121premises; 122 (17)Anyhospitalaccessiblebythepublic.Possessionofafirearminavehicleonthe 123premisesofahospitalshallnotbeacriminaloffensesolongasthefirearmisnotremoved 124fromthevehicleorbrandishedwhilethevehicleisonthepremises. 125 2.Carryingofaconcealedfirearminalocationspecifiedinsubdivisions(1)to(17) 126ofsubsection1ofthissectionbyanyindividualwhoholdsaMissourilifetimeorextended 127concealedcarrypermitshallnotbeacriminalactbutmaysubjectthepersontodenialtothe 128premisesorremovalfromthepremises.Ifsuchpersonrefusestoleavethepremisesanda 129peaceofficerissummoned,suchpersonmaybeissuedacitationforanamountnottoexceed 130onehundreddollarsforthefirstoffense.Ifasecondcitationforasimilarviolationoccurs 131withinasix-monthperiod,suchpersonshallbefinedanamountnottoexceedtwohundred 132dollarsand[hisorher]suchindividual'spermittocarryconcealedfirearmsshallbe 133suspendedforaperiodofoneyear.Ifathirdcitationforasimilarviolationisissuedwithin 134oneyearofthefirstcitation,suchpersonshallbefinedanamountnottoexceedfivehundred 135dollarsandshallhave[hisorher]suchindividual'sMissourilifetimeorextendedconcealed 136carrypermitrevokedandsuchpersonshallnotbeeligibleforaMissourilifetimeorextended 137concealedcarrypermitoraconcealedcarrypermitissuedundersections571.101to571.121 138foraperiodofthreeyears.Uponconvictionofchargesarisingfromacitationissuedunder 139thissubsection,thecourtshallnotifythesheriffofthecountywhichissuedtheMissouri 140lifetimeorextendedconcealedcarrypermit.ThesheriffshallsuspendorrevoketheMissouri 141lifetimeorextendedconcealedcarrypermit. 590.010.Asusedinthischapter,thefollowingtermsmean: 2 (1)"Commission",whennotobviouslyreferringtothePOSTcommission,meansa 3grantofauthoritytoactasapeaceofficer; 4 (2)"Director",thedirectoroftheMissouridepartmentofpublicsafetyor[hisorher] 5thedirector'sdesignatedagentorrepresentative; 6 (3)"Peaceofficer",alawenforcementofficerofthestateoranypoliticalsubdivision 7ofthestatewiththepowerofarrestforaviolationofthecriminalcodeordeclaredordeemed 8tobeapeaceofficerbystatestatute; 9 (4)"POSTcommission",thepeaceofficerstandardsandtrainingcommission; 10 (5)"Reservepeaceofficer",apeaceofficerwhoregularlyworkslessthanthirtyhours 11perweek; HB1481 11 12 (6)"Schoolprotectionofficer",anelementaryorsecondaryschoolteacher[or], 13administrator, orotherdesignatedschoolpersonnelwhohasbeendesignatedasaschool 14protectionofficerbyaschooldistrict. 590.205.1.ThePOSTcommissionshallestablishminimumstandardsforschool 2protectionofficertraininginstructors,trainingcenters,andtrainingprograms. 3 2.Thedirectorshalldevelopandmaintainalistofapprovedschoolprotectionofficer 4traininginstructors,trainingcenters,andtrainingprograms.Thedirectorshallnotplaceany 5instructor,trainingcenter,ortrainingprogramonitsapprovedlistunlesssuchinstructor, 6trainingcenter,ortrainingprogrammeetsallofthePOSTcommissionrequirementsunder 7thissectionandsection590.200.Thedirectorshallmakethisapprovedlistavailabletoevery 8schooldistrictinthestate.Therequiredtrainingtobecomeaschoolprotectionofficershall 9beprovidedbythosefirearminstructors,privateandpublic,whohavesuccessfullycompleted 10adepartmentofpublicsafetyPOSTcertifiedlawenforcementfirearmsinstructorschool. 11 3.Eachpersonseekingentranceintoaschoolprotectionofficertrainingcenteror 12trainingprogramshallsubmitafingerprintcardandauthorizationforacriminalhistory 13backgroundchecktoincludetherecordsoftheFederalBureauofInvestigationtothetraining 14centerortrainingprogramwheresuchpersonisseekingentrance.Thetrainingcenteror 15trainingprogramshallcauseacriminalhistorybackgroundchecktobemadeandshallcause 16theresultingreporttobeforwardedtotheschooldistrictwheretheelementaryorsecondary 17schoolteacher[or],administrator, orotherdesignatedschoolpersonnelisseekingtobe 18designatedasaschoolprotectionofficer. 19 4.Nopersonshallbeadmittedtoaschoolprotectionofficertrainingcenteror 20trainingprogramunlesssuchpersonsubmitsprooftothetrainingcenterortrainingprogram 21that[heorshe]suchindividualhasavalidconcealedcarryendorsementorpermit. 22 5.Acertificateofschoolprotectionofficertrainingprogramcompletionmaybe 23issuedtoanyapplicantbyanyapprovedschoolprotectionofficertraininginstructor.Onthe 24certificateofprogramcompletiontheapprovedschoolprotectionofficertraininginstructor 25shallaffirmthattheindividualreceivinginstructionhastakenandpassedaschoolprotection 26officertrainingprogramthatmeetstherequirementsofthissectionandsection590.200and 27indicatewhethertheindividualhasavalidconcealedcarryendorsementorpermit.The 28instructorshallalsoprovideacopyofsuchcertificatetothedirectorofthedepartmentof 29publicsafety. ✔ HB1481 12
