BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section311.332,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection311.332,toreadasfollows:
311.332.1.Itshallbeunlawfulforanywholesalerlicensedtosellintoxicatingliquor
2andwinecontainingalcoholinexcessoffivepercentbyweighttopersonsdulylicensedto
3sellsuchintoxicatingliquorandwineatretail,todiscriminatebetweenretailersorinfavorof
4oragainstanyretailerorgroupofretailers,directlyorindirectly,inprice,indiscountsfor
5timeofpayment,orindiscountsonquantityofmerchandisesold,ortograntdirectlyor
6indirectlyanydiscount,rebate,freegoods,allowanceorotherinducement,exceptinga
7discountnotinexcessofonepercentforquantityofliquorandwine,andadiscountnotin
8excessofonepercentforpaymentonorbeforeacertaindate.Thedeliveryofmanufacturer
9rebatecouponsbywholesalerstoretailersshallnotbeaviolationofthissubsection.
10 2.Manufacturersorwholesalersshallbepermittedtodonateordeliverorcausetobe
11deliveredbeer,wine,distilledspirits,orbrandyfornonresalepurposestoanyunlicensed
12personoranylicensedretaildealerwhoisacharitableorreligiousorganizationasdefinedin
13section313.005oreducationalinstitution,atanylocationorlicensedpremises,provided,
14suchbeer,wine,distilledspirits,orbrandyisunrelatedtotheorganization'sorinstitution's
15licensedretailoperation.Achargeforadmissiontoaneventoractivityatwhichbeer,wine,
16distilledspirits,orbrandyisavailablewithoutseparatechargeshallnotconstituteresalefor
17thepurposesofthissubsection.Wineusedinreligiousceremoniesmaybesoldby

22theoriginalpackagetoacharitableorreligiousorganizationasdefinedinsection313.005or
23educationalinstitutionforthesolepurposeofbeingauctionedbytheorganizationor
24institutionforfund-raisingpurposes,providedtheauctiontakesplaceonaretail-licensed
25premisesandallproceedsfromthesalegointoafundofanorganizationorinstitutionthatis
26unrelatedtoanylicensedretailoperation.
