43.503.1.Forthepurposeofmaintainingcompleteandaccuratecriminalhistory
2recordinformation,allpoliceofficersofthisstate,theclerkofeachcourt,thedepartmentof
3corrections,thesheriffofeachcounty,thechieflawenforcementofficialofacitynotwithina
4countyandtheprosecutingattorneyofeachcountyorthecircuitattorneyofacitynotwithin
5acountyshallsubmitcertaincriminalarrest,charge,anddispositioninformationtothe
6centralrepositoryforfilingwithoutunduedelayintheformandmannerrequiredbysections
743.500to43.651.
HCSHB1559	3 8 2.Alllawenforcementagenciesmakingmisdemeanorandfelonyarrestsas
9determinedbysection43.506shallfurnishwithoutunduedelay,tothecentralrepository,
10fingerprints,photograph,andifavailable,anyotheruniquebiometricidentificationcollected,
11charges,appropriatechargecodes,anddescriptionsofallpersonswhoarearrestedforsuch
12offensesonstandardfingerprintformssuppliedorapprovedbythehighwaypatrolor
13electronicallyinaformatandmannerapprovedbythehighwaypatrolandincompliancewith
14thestandardssetbytheFederalBureauofInvestigationinitsAutomatedFingerprint
15IdentificationSystemoritssuccessorprogram.Allsuchagenciesshallalsonotifythecentral
16repositoryofalldecisionsnottorefersucharrestsforprosecution.Anagencymakingsuch
17arrestsmayenterintoarrangementswithotherlawenforcementagenciesforthepurposeof
18furnishingwithoutunduedelaysuchfingerprints,photograph,andifavailable,anyother
19uniquebiometricidentificationcollected,charges,appropriatechargecodes,anddescriptions
20tothecentralrepositoryuponitsbehalf.
21 3.Ininstanceswhereanindividuallessthan[seventeen] eighteenyearsofageand
22notcurrentlycertifiedasanadultistakenintocustodyforanoffensewhichwouldbeafelony
23ifcommittedbyanadult,thearrestingofficershalltakefingerprintsforthecentralrepository.
24Thesefingerprintsshallbetakenonfingerprintcardssuppliedbyorapprovedbythehighway
25patrolortransmittedelectronicallyinaformatandmannerapprovedbythehighwaypatrol
26andincompliancewiththestandardssetbytheFederalBureauofInvestigationinits
27AutomatedFingerprintIdentificationSystemoritssuccessorprogram.Thefingerprintcards
28shallbesoconstructedthatthenameofthejuvenileshouldnotbemadeavailabletothe
29centralrepository.Theindividual'snameandtheuniquenumberassociatedwiththe
30fingerprintsandotherpertinentinformationshallbeprovidedtothecourtofjurisdictionby
31theagencytakingthejuvenileintocustody.Thejuvenile'sfingerprintsandotherinformation
32shallbeforwardedtothecentralrepositoryandthecourtswithoutunduedelay.The
33fingerprintinformationfromthecardshallbecapturedandstoredintheautomated
34fingerprintidentificationsystemoperatedbythecentralrepository.Intheeventthe
35fingerprintsarefoundtomatchothertenprintsorunsolvedlatentprints,thecentralrepository
36shallnotifythesubmittingagencywhoshallnotifythecourtofjurisdictionasperlocal
37agreement.Undersection211.031,ininstanceswhereajuvenileoverfifteenandone-half
38yearsofageisallegedtohaveviolatedastateormunicipaltrafficordinanceorregulation,
39whichdoesnotconstituteafelony,andthejuvenilecourtdoesnothavejurisdiction,the
40juvenileshallnotbefingerprintedunlesscertifiedasanadult.
41 4.Uponcertificationoftheindividualasanadult,thecertifyingcourtshallordera
42lawenforcementagencytoimmediatelyfingerprintandphotographtheindividualand
43certificationpaperswillbeforwardedtotheappropriatelawenforcementagencywiththe
44orderforfingerprinting.Thelawenforcementagencyshallsubmitsuchfingerprints,

46furnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecutingattorney
47orthecircuitattorneyofacitynotwithinacountyandtotheclerkofthecourtorderingthe
48subjectfingerprinted.Ifthejuvenileisacquittedofthecrimeandisnolongercertifiedasan
49adult,theprosecutingattorneyshallnotifywithinfifteendaysthecentralrepositoryofthe
50changeofstatusofthejuvenile.Recordsofachildwhohasbeenfingerprintedand
51photographedafterbeingtakenintocustodyshallbeclosedrecordsasprovidedundersection
52610.100ifapetitionhasnotbeenfiledwithinthirtydaysofthedatethatthechildwastaken
53intocustody;andifapetitionforthechildhasnotbeenfiledwithinoneyearofthedatethe

86ofcorrectionsorthedepartmentofmentalhealthifthepersoniscommittedpursuantto
87chapter552.Thisinformationshallbereportedtothedepartmentofcorrectionsorthe
88departmentofmentalhealthatthetimeofcommitmentorassignment.Iftheoffenderwas
89alreadyinthecustodyofthedepartmentofcorrectionsorthedepartmentofmentalhealthat
90thetimeofsuchsubsequentconviction,theclerkshallfurnishnoticeofsuchsubsequent
91convictiontotheappropriatedepartmentbycertifiedmail,returnreceiptrequested,orina
92mannerandformatmutuallyagreedto,withinfifteendaysofsuchdisposition.
93 8.Informationandfingerprints,photographandifavailable,anyotherunique
94biometricidentificationcollected,forwardedtothecentralrepository,normallyobtainedfrom
95apersonatthetimeofthearrest,maybeobtainedatanytimethesubjectisinthecriminal
96justicesystemorcommittedtothedepartmentofmentalhealth.Alawenforcementagency
97orthedepartmentofcorrectionsmayfingerprint,photograph,andcaptureanyotherunique
98biometricidentificationofthepersonunlesscollectingotheruniquebiometricidentification
99ofthepersonisnotfinanciallyfeasibleforthelawenforcementagency,andobtainthe
100necessaryinformationatanytimethesubjectisincustody.Ifatthetimeofanycourt
101appearance,thedefendanthasnotbeenfingerprintedandphotographedforanoffensein
102whichafingerprintandphotographisrequiredbystatutetobecollected,maintained,or
103disseminatedbythecentralrepository,thecourtshallorderalawenforcementagencyor
104courtmarshaltofingerprintandphotographimmediatelythedefendant.Theorderfor
105fingerprintsshallcontaintheoffense,chargecode,dateofoffense,andanyotherinformation
106necessarytocompletethefingerprintcard.Thelawenforcementagencyorcourtmarshal
107shallsubmitsuchfingerprints,photograph,andifavailable,anyotheruniquebiometric
108identificationcollected,tothecentralrepositorywithoutunduedelayandwithinthirtydays
109andshallfurnishtheoffensecyclenumberassociatedwiththefingerprintstotheprosecuting
110attorneyorthecircuitattorneyofacitynotwithinacountyandtothecourtclerkofthecourt
111orderingthesubjectfingerprinted.
112 9.Thedepartmentofcorrectionsandthedepartmentofmentalhealthshallfurnishthe
113centralrepositorywithallinformationconcerningthereceipt,escape,execution,death,
114release,pardon,parole,commutationofsentence,grantingofexecutiveclemency,legalname
115change,ordischargeofanindividualwhohasbeensentencedtothatdepartment'scustodyfor
116anyoffenseswhicharemandatedbylawtobecollected,maintainedordisseminatedbythe
117centralrepository.Allrecordsforwardedtothecentralrepositorybythedepartmentas
118requiredbysections43.500to43.651shallincludetheoffensecyclenumberoftheoffense,

2carelicensingprovisionsunderthischaptersolongastheprogrammeetsthefollowing
3requirements:
4 (1)Theprogramisaffiliatedandingoodstandingwithanationalcongressionally
5charteredorganization'sstandardsunderTitle36,PublicLaw105-225;
6 (2)Theprogramprovidesactivitiesdesignedforrecreational,educational,and
7characterbuildingpurposesforchildrensixto[seventeen] eighteenyearsofage;
8 (3)Thegoverningbodyoftheprogramadoptsstandardsforcarethatataminimum
9includestaffratios,stafftraining,healthandsafetystandards,andmechanismsforassessing
10andenforcingtheprogram'scompliancewiththestandards;
11 (4)Theprogramdoesnotcollectcompensationforitsservicesexceptforone-time
12annualmembershipduesnottoexceedfiftydollarsperyearorprogramservicefeesfor
13specialactivitiessuchasfieldtripsorsportsleagues,exceptforcurrentexemptionsaswritten

5subjecttoanyrequiredfederalauthorization,immediatelyconductaname-basedcriminal
6historyrecordchecktoincludefullordersofprotectionandoutstandingwarrantsofeach
7personovertheageofseventeenresidinginthehomebyusingtheMissouriuniformlaw

9InterstateIdentificationIndexmaintainedbytheFederalBureauofInvestigation;and

12onthechildabuseandneglectregistry.Foranychildrenlessthan[seventeen] eighteenyears
13ofageresidinginthehome,thechildren'sdivisionshallinquireofthepersonwithwhoman
14emergencyplacementofachildwillbemadewhetheranychildrenlessthan[seventeen]
15eighteenyearsofageresidinginthehomehaveeverbeencertifiedasanadultandconvicted
16oforpledguiltyornolocontenderetoanycrime.
17 2.Ifaname-basedsearchhasbeenconductedpursuanttosubsection1ofthissection,
18withinfifteencalendardaysaftertheemergencyplacementofthechildintheprivatehome,
19andiftheprivatehomehasnotpreviouslybeenapprovedasafosteroradoptivehome,all
20personsovertheageofseventeenresidinginthehomeandallchildrenlessthan[seventeen]
21eighteenresidinginthehomewhothedivisionhasdeterminedhavebeencertifiedasanadult
22forthecommissionofacrimeshallreporttoalocallawenforcementagencyforthepurpose
23ofprovidingfingerprintsandaccompanyingfees,pursuanttosections43.530and43.540.

29 3.Iftheplacementofachildisdeniedasaresultofaname-basedcriminalhistory
30checkandthedenialiscontested,allpersonsovertheageofseventeenresidinginthehome
31andallchildrenlessthan[seventeen] eighteenyearsofageresidinginthehomewhothe
32divisionhasdeterminedhavebeencertifiedasanadultforthecommissionofacrimeshall,
33withinfifteencalendardays,submittothejuvenilecourtorthechildren'sdivisionfingerprints
34inthesamemannerdescribedinsubsection2ofthissection,accompanyingfees,andwritten
35permissionauthorizingthejuvenilecourtorthechildren'sdivisiontoforwardthefingerprints
36tothestatecriminalrecordrepositoryforsubmissiontotheFederalBureauofInvestigation.
37 4.Nopersonwhosubmitsfingerprintsunderthissectionshallberequiredtosubmit
38additionalfingerprintsunderthissectionorsection210.487unlesstheoriginalfingerprints
39retainedbythedivisionarelostordestroyed.
40 5.Subjecttoappropriation,thetotalcostoffingerprintingrequiredbythissection
41maybepaidbythestate,includingreimbursementofpersonsincurringfingerprintingcosts
42underthissection.
43 6.Forthepurposesofthissection,"emergencyplacement"referstothoselimited
44instanceswhenthejuvenilecourtorchildren'sdivisionisplacingachildinthehomeof

210.487.1.Whenconductinginvestigationsofpersonsforthepurposeoffoster
2parentlicensing,thedivisionshall:
3 (1)Conductasearchforallpersonsovertheageofseventeenintheapplicant's
4householdandforanychildlessthan[seventeen] eighteenyearsofageresidinginthe
5applicant'shomewhothedivisionhasdeterminedhasbeencertifiedasanadultforthe
6commissionofacrimeforevidenceoffullordersofprotection.Theofficeofstatecourts
7administratorshallallowaccesstotheautomatedcourtinformationsystembythedivision.
8Theclerkofeachcourtcontactedbythedivisionshallprovidethedivisioninformationwithin
9tendaysofarequest;
10 (2)Obtainfingerprintsforanypersonovertheageofseventeenintheapplicant's
11householdandforanychildlessthan[seventeen] eighteenyearsofageresidinginthe
12applicant'shomewhothedivisionhasdeterminedhasbeencertifiedasanadultforthe
13commissionofacrimeinthesamemannersetforthinsubsection2ofsection210.482.The
14highwaypatrolshallassistthedivisionandprovidethecriminalfingerprintbackground
15information,uponrequest,underandinaccordancewiththeprovisionsofsection43.540;and
16 (3)Determinewhetheranypersonovertheageofseventeenresidinginthehomeand
17anychildlessthan[seventeen] eighteenyearsofageresidingintheapplicant'shomewhothe
18divisionhasdeterminedhasbeencertifiedasanadultforthecommissionofacrimeislisted
19onthechildabuseandneglectregistry.Foranychildrenlessthan[seventeen] eighteenyears
20ofageresidingintheapplicant'shome,thechildren'sdivisionshallinquireoftheapplicant
21whetheranychildrenlessthan[seventeen] eighteenyearsofageresidinginthehomehave
22everbeencertifiedasanadultandbeenconvictedoforpledguiltyornolocontenderetoany
23crime.
24 2.Aftertheinitialinvestigationiscompletedundersubsection1ofthissection:
25 (1)Nopersonwhosubmitsfingerprintsundersubsection1ofthissectionorsection
26210.482shallberequiredtosubmitadditionalfingerprintsunderthissectionorsection

17hoursofamissingchildreportbeingfiledforachildplacedinanauthorizedagencyor
18fostercareorwithinseventy-twohoursofanauthorizedagencyorfostercarebeing
19notifiedthatachildunderitscustodyismissing,whichevereventfirstoccurs,afamily
20supportteammeetingshallbeheldtodiscussthewhereaboutsofthemissingchildand
21todiscusstheinitialdecisionregardingthecustodyandplacementofthemissingchild
22oncethechildisfound.Ifthemissingchildisbroughtbackintocustody,anotherfamily
23supportteammeetingshallbeheldasprovidedunderthissection.Anyagencyor

25withtheprovisionsunderthissubdivisionshallbeliabletotheinjuredparty,which
26includesthemissingchild,parent,fosterparent,orlegalguardianofthemissingchild,
27andthestateofMissouri,inanactionatlawandsubjecttoacivilpenaltyoffifty
28thousanddollarsperoccurrence.
29 2.Theparents,thelegalcounselfortheparents,thefosterparents,thelegalguardian
30orcustodianofthechild,theguardianadlitemforthechild,andthevolunteeradvocate,and
31anydesigneeoftheparentthathaswrittenauthorizationshallbenotifiedandinvitedto
32participateinallfamilysupportteammeetings.Thefamilysupportteammeetingmay
33includesuchotherpersonswhoseattendanceatthemeetingmayassisttheteaminmaking
34appropriatedecisionsinthebestinterestsofthechild.Ifthedivisionfindsthatitisnotinthe
35bestinterestofachildtobeplacedwithrelatives,thedivisionshallmakespecificfindingsin
36thedivision'sreportdetailingthereasonswhythebestinterestsofthechildnecessitate
37placementofthechildwithpersonsotherthanrelatives.
38 3.Thedivisionshallusetheformcreatedinsubsection2ofsection210.147tobe
39signedupontheconclusionofthemeetingpursuanttosubsection1ofthissectionconfirming
40thatallinvolvedpartiesareawareoftheteam'sdecisionregardingthecustodyandplacement
41ofthechild.Anydissentingviewsmustberecordedandattestedtoonsuchform.
42 4.Thecasemanagershallberesponsibleforincludingsuchformwiththecase
43recordsofthechild.
44 5.Asusedinthissection,"familysupportteam"meansateamwhomayconsist
45ofayouthiftheyouthistwelveyearsofageorolder,parents,legalcounselforthe
46parents,resourceproviders,thelegalguardianforthechild,thejuvenileofficer,the
47guardianadlitem,thecourtappointedspecialadvocate,uptotwoyouth-chosen
48advocatesforayouthtwelveyearsofageorolder,andindividualsinvitedbythe
49parents.Theteammeetsforthepurposeofdeterminingthefollowing:
50 (1)Thesafetyofthechild;
51 (2)Acomprehensivevisitationplanforparents,siblings,andfamilymembers;
52 (3)Serviceandtreatmentneeds;
53 (4)Theneedforplacementanddevelopingaplanforreunificationorother
54permanencyoptions,includingaprojecteddateforpermanency;
55 (5)Theappropriateplacementofthechild;
56 (6)Thechild'saccessandopportunitiesfornormalcyactivitiesbasedonthe
57reasonableandprudentparentingstandard;
58 (7)Aneducationalplanforthechild;
59 (8)Thecaseplan,whichincludesestablishingandrevisingthecaseplan;and

210.795.Acaseworkershallnotifyajuvenileofficerifachildgoesmissingoris
2suspectedofbeingontherun.Oncethejuvenileofficerisnotified,theofficershallfile
3withthecourtanoticeinthechild'scasefilethatstatesthechildismissingandinclude
4anyotherrelevantinformation,whichshallincludethemissingchildreport.Ifthe
5missingchildisfound,thejuvenileofficershallfilewiththecourtanoticeinthechild's
6casefilethatthechildhasbeenfoundandincludeanyotherrelevantinformation.
217.343.Offenderswhoareyoungerthan[seventeen] eighteenyearsofageandhave
2beenadjudicatedasanadultshallbeemancipatedforthepurposeofdecisionmakingand
3participationinalldepartmentprogramsandservices,includingbutnotlimitedtomedical
4care,mentalhealthcare,treatmentprograms,educationalprograms,workassignments,and
5rehabilitativeprograms.
217.690.1.Allreleasesorparolesshallissueuponorderoftheparoleboard,duly
2adopted.
3 2.Beforeorderingtheparoleofanyoffender,theparoleboardshallconducta
4validatedriskandneedsassessmentandevaluatethecaseundertherulesgoverningparole
5thatarepromulgatedbytheparoleboard.Theparoleboardshallthenhavetheoffender
6appearbeforeahearingpanelandshallconductapersonalinterviewwithhimorher,unless
7waivedbytheoffender,oriftheguidelinesindicatetheoffendermaybeparoledwithoutneed
8foraninterview.Theguidelinesandrulesshallnotallowforthewaiverofahearingifa
9victimrequestsahearing.Theappearanceorpresencemayoccurbymeansofa
10videoconferenceatthediscretionoftheparoleboard.Aparolemaybeorderedforthebest
11interestofsocietywhenthereisareasonableprobability,basedontheriskassessmentand
12indicatorsofreleasereadiness,thatthepersoncanbesupervisedunderparolesupervisionand
13successfullyreintegratedintothecommunity,notasanawardofclemency;itshallnotbe
14consideredareductionofsentenceorapardon.Everyoffenderwhileonparoleshallremain
15inthelegalcustodyofthedepartmentbutshallbesubjecttotheordersoftheparoleboard.
16 3.Thedivisionofprobationandparolehasdiscretionaryauthoritytorequirethe
17paymentofafee,nottoexceedsixtydollarspermonth,fromeveryoffenderplacedunder
18divisionsupervisiononprobation,parole,orconditionalrelease,towaiveallorpartofany
19fee,tosanctionoffendersforwillfulnonpaymentoffees,andtocontractwithaprivateentity
20forfeecollectionsservices.Allfeescollectedshallbedepositedintheinmatefund

50 8.Anyoffenderunderasentenceforfirstdegreemurderwhohasbeendeniedrelease
51onparoleafteraparolehearingshallnotbeeligibleforanotherparolehearinguntilatleast
52threeyearsfromthemonthoftheparoledenial;however,thissubsectionshallnotpreventa
53releasepursuanttosubsection4ofsection558.011.
54 9.Avictimwhohasrequestedanopportunitytobeheardshallreceivenoticethatthe
55paroleboardisconductinganassessmentoftheoffender'sriskandreadinessforreleaseand
56thatthevictim'sinputwillbeparticularlyhelpfulwhenitpertainstosafetyconcernsand
57specificprotectivemeasuresthatmaybebeneficialtothevictimshouldtheoffenderbe
58grantedrelease.
59 10.Parolehearingsshall,ataminimum,containthefollowingprocedures:

84conditionsuponrelease,andtorequirethemodificationandreductionofconditionsbasedon
85theperson'scontinuingstabilityinthecommunity.Paroleboardrulesshallpermitparole
86conditionstobemodifiedbyparoleofficerswithreviewandapprovalbysupervisors.
87 14.Nothingcontainedinthissectionshallbeconstruedtorequirethereleaseofan
88offenderonparolenortoreducethesentenceofanoffenderheretoforecommitted.
89 15.BeginningJanuary1,2001,theparoleboardshallnotorderaparoleunlessthe
90offenderhasobtainedahighschooldiplomaoritsequivalent,orunlesstheparoleboardis
91satisfiedthattheoffender,whilecommittedtothecustodyofthedepartment,hasmadean
92honestgood-faithefforttoobtainahighschooldiplomaoritsequivalent;providedthatthe
93directormaywaivethisrequirementbycertifyinginwritingtotheparoleboardthatthe
94offenderhasactivelyparticipatedinmandatoryeducationprogramsorisacademicallyunable
95toobtainahighschooldiplomaoritsequivalent.
96 16.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis

2stateshallapplytotheboard,shallberegisteredasanapprenticewiththeboard,andshallpay
3theappropriatefeespriortobeginningtheirapprenticeship.Barberapprenticesshallbeat
4least[seventeen] eighteenyearsofage.
5 2.Anypersondesiringtoactasanapprenticesupervisorforbarberinginthisstate
6shallfirstpossessalicensetopracticetheoccupationofbarbering,applytotheboard,paythe
