Expensesincurredforattendingthetraining 12 40 sessionmaybereimbursedtothecountycoronerinthesamemanner 41 asotherexpensesasmaybeappropriatedforthatpurpose.All 42 electedorappointedcoroners,deputycoroners,andassistantsto 43 thecoronershallcompletetheannualtrainingdescribedinthis 44 subsectionwithinsixmonthsofelectionorappointment. 45 3.Thecountycoronerinanycountynothavingacharterform 46 ofgovernmentshallnot,exceptupontwo-thirdsvoteofallthe 47 membersofthesalarycommission,receiveanannualcompensation 48 inanamountlessthanthetotalcompensationbeingreceivedfor 49 theofficeofcountycoronerintheparticularcountyforservices 50 renderedorperformedonthedatethesalarycommissionvotes. 51 4.Forthetermbeginningin1997,thecompensationofthe 52 coroner,incountiesinwhichthesalarycommissionhasnotvoted 53 topayonehundredpercentofthemaximumallowablesalary,shall 54 beapercentageofthemaximumallowablesalaryestablishedbythis 55 section.Thepercentageappliedshallbethesamepercentageof 56 themaximumallowablesalaryreceivedorallowed,whicheveris 57 greater,tothepresidingcommissionerorsheriff,whicheveris 58 greater,ofthatcountyfortheyearbeginningJanuary1,1997.In 59 thosecountiesinwhichthesalarycommissionhasvotedtopayone 60 hundredpercentofthemaximumallowablesalary,thecompensation 61 ofthecoronershallbebasedonthemaximumallowablesalaryin 62 effectateachtimeacoroner'stermofofficecommencesfollowing 63 thevotetopayonehundredpercentofthemaximumallowable 64 compensation. Anyperson,corporation,or 62 limitedliabilitypartnershipowningmorethanoneparcelofland 63 locatedinsuchproposeddistrictshallbeallowedonlyone 64 signatureonsuchpetition. Thepetition,inordertobecome 65 effective,shallbefiledwiththecityclerkorcountyclerk.A 66 properpetitionforthecreationofaneighborhoodimprovement 67 districtshallsetforththeprojectnamefortheproposed 68 improvement,thegeneralnatureoftheproposedimprovement,the 69 estimatedcostofsuchimprovement,theboundariesoftheproposed 70 neighborhoodimprovementdistricttobeassessed,theproposed 71 methodormethodsofassessmentofrealpropertywithinthe 72 district,includinganyprovisionfortheannualassessmentof 73 maintenancecostsoftheimprovementineachyearduringtheterm 74 ofthebondsissuedfortheoriginalimprovementandaftersuch 21 75 bondsarepaidinfull,anoticethatthenamesofthesignersmay 76 notbewithdrawnlaterthansevendaysafterthepetitionisfiled 77 withthecityclerkorcountyclerk,andanoticethatthefinal 78 costofsuchimprovementassessedagainstrealpropertywithinthe 79 districtandtheamountofgeneralobligationbondsissued 80 thereforshallnotexceedtheestimatedcostofsuchimprovement, 81 asstatedinsuchpetition,bymorethantwenty-fivepercent,and 82 thattheannualassessmentformaintenancecostsofthe 83 improvementsshallnotexceedtheestimatedannualmaintenance 84 cost,asstatedinsuchpetition,bymorethantwenty-fivepercent. 85 4.Uponreceivingtherequisitevoterapprovalatanelection 86 oruponthefilingofaproperpetitionwiththecityclerkor 87 countyclerk,thegoverningbodymaybyresolutionorordinance 88 determinetheadvisabilityoftheimprovementandmayorderthat 89 thedistrictbeestablishedandthatpreliminaryplansand 90 specificationsfortheimprovementbemade.Suchresolutionor 91 ordinanceshallstateandmakefindingsastotheprojectnamefor 92 theproposedimprovement,thenatureoftheimprovement,the 93 estimatedcostofsuchimprovement,theboundariesofthe 94 neighborhoodimprovementdistricttobeassessed,theproposed 95 methodormethodsofassessmentofrealpropertywithinthe 96 district,includinganyprovisionfortheannualassessmentof 97 maintenancecostsoftheimprovementineachyearafterthebonds 98 issuedfortheoriginalimprovementarepaidinfull,andshall 99 alsostatethatthefinalcostofsuchimprovementassessedagainst 100 therealpropertywithintheneighborhoodimprovementdistrictand 101 theamountofgeneralobligationbondsissuedthereforshallnot, 22 102 withoutanewelectionorpetition,exceedtheestimatedcostof 103 suchimprovementbymorethantwenty-fivepercent. 104 5.Theboundariesoftheproposeddistrictshallbedescribed 105 bymetesandbounds,streetsorothersufficientlyspecific 106 description. Suchclerkshallthereupon,atthedirectionofthe 13 governingbody,publishnoticethatthegoverningbodywill 14 conductahearingtoconsidertheproposedimprovementand 15 proposedassessments. Suchnoticeshallbepublishedina 16 newspaperofgeneralcirculationatleastoncenotmorethantwenty 17 daysandnotlessthantendaysbeforethehearingandshallstate 25 18 theprojectnamefortheimprovement,thedate,timeandplaceof 19 suchhearing,thegeneralnatureoftheimprovement,therevised 20 estimatedcostor,ifavailable,thefinalcostoftheimprovement, 21 theboundariesoftheneighborhoodimprovementdistricttobe 22 assessed,andthatwrittenororalobjectionswillbeconsideredat 23 thehearing.SuchnoticeshallalsobesenttotheMissouri 24 departmentofrevenue,whichshallpublishsuchnoticeonits 25 website.Atthesametime,theclerkshallmailtotheownersof 26 recordoftherealpropertymadeliabletopaytheassessments,at 27 theirlastknownpostofficeaddress,anoticeofthehearinganda 28 statementofthecostproposedtobeassessedagainstthereal 29 propertysoownedandassessed. Thefailureofanyownerto 30 receivesuchnoticeshallnotinvalidatetheproceedings. 67.1421.1.Uponreceiptofaproperpetitionfiledwithits 2 municipalclerk,thegoverningbodyofthemunicipalityinwhich 3 theproposeddistrictislocatedshallholdapublichearingin 4 accordancewithsection67.1431andmayadoptanordinanceto 5 establishtheproposeddistrict. 6 2.Apetitionisproperif,basedonthetaxrecordsofthe 7 countyclerk,orthecollectorofrevenueifthedistrictis 8 locatedinacitynotwithinacounty,asofthetimeoffilingthe 9 petitionwiththemunicipalclerk,itmeetsthefollowing 10 requirements: 11 (1)Ithasbeensignedbypropertyownerscollectivelyowning 12 morethanfiftypercentbyassessedvalueoftherealproperty 13 withintheboundariesoftheproposeddistrict; Thedepartmentshall 40 provideperformancepaymentsofuptotenpercentforsuchprograms 41 thatmeetguidelinesasestablishedbythedepartment. 42 43 Individualsutilizingsuchfacilitiespursuanttothissubsection 44 shallbeenteredintoahomelessnessmanagementinformationsystem 45 maintainedbythelocalcontinuumofcare. 46 3.Aprivatecampgroundowneroranemployeeorofficerofa 47 privatecampgroundoperatingsuchfacilitypursuanttothis 48 sectionshallbesubjecttotheprovisionsofsection537.328. 49 4.(1)Statefundsotherwiseusedfortheconstructionof 50 permanenthousingforthehomelessshallbeusedtoassistsuch 51 individualswithsubstanceuse,mentalhealthtreatment,andother 52 services,includingshort-termhousing.Thedepartmentshall 53 provideuptotwenty-fivepercentofthebaseallocationofsuch 54 fundsasperformancepaymentstopoliticalsubdivisionsornot- 55 for-profitorganizationsprovidingsuchservicesasrewardsfor 56 meetingpredeterminedgoalsonreductionsof: 57 (a)Daysunhoused; 58 (b)Daysinjailorprison;and 59 (c)Dayshospitalized,withtheweightsofsuchdaystobe 60 determinedbythedepartment. 61 (2)Politicalsubdivisionsandnot-for-profitorganizations 62 mayusestategrantsotherwiseusedforpermanenthousingto 63 conductsurveystoidentifyindividualswiththegreatestnumber 64 ofdaysunhoused,injailorprison,orhospitalizedbutthese 65 expensesshallnotexceedtenpercentofthetotalgrantamount. 37 66 5.Nopersonshallbepermittedtousestate-ownedlandsfor 67 unauthorizedsleeping,camping,ortheconstructionoflong-term 68 shelters. AnyviolationofthissubsectionshallbeaclassC 69 misdemeanor;however,forthefirstoffensesuchindividualshall 70 begivenawarning,andnocitationshallbeissuedunlessthat 71 individualrefusestomovetoanyofferedservicesorshelter. 72 6.(1)Apoliticalsubdivisionshallnotadoptorenforce 73 anypolicyunderwhichthepoliticalsubdivisionprohibitsor 74 discouragestheenforcementofanyorderorordinanceprohibiting 75 publiccamping,sleeping,orobstructionsofsidewalks. 76 (2)Incompliancewithsubsection5ofthissection,a 77 politicalsubdivisionshallnotprohibitordiscourageapeace 78 officerorprosecutingattorneywhoisemployedbyorotherwise 79 underthedirectionorcontrolofthepoliticalsubdivisionfrom 80 enforcinganyorderorordinanceprohibitingpubliccamping, 81 sleeping,orobstructionsofsidewalks. 82 (3)Theprovisionsofthissectionshallnotprohibita 83 policyofanypoliticalsubdivisionthatencouragesdiversion 84 programsorofferingofservicesinlieuofacitationorarrest. 85 (4)Theattorneygeneralshallhavethepowertobringa 86 civilactioninanycourtofcompetentjurisdictionagainstany 87 politicalsubdivisiontoenjointhepoliticalsubdivisionfrom 88 violatingtheprovisionsofthissubsection. 89 (5)Theattorneygeneralmayrecoverreasonableexpenses 90 incurredinanycivilactionbroughtunderthissection,including 91 courtcosts,reasonableattorney'sfees,investigativecosts, 92 witnessfees,anddepositioncosts. 38 93 7.Anypoliticalsubdivisionwithahigherper-capitarateof 94 homelessnessthanthestateaverage,asdeterminedbythemost 95 recentUnitedStatescensusnumbersfortheoverallpopulationand 96 themostrecentfederalDepartmentofHousingandUrban 97 Developmenthomelessnesspoint-in-timecontinuumofcare,as 98 definedby24C.F.R.578.5(a),inwhichthepoliticalsubdivision 99 islocated,shall,withinoneyearofthepassageofthisact, 100 receivenofurtherstatefundingbythedepartmentuntilthe 101 departmentdetermines: 102 (1)Thepoliticalsubdivisionhasaper-capitarateof 103 unshelteredhomelessindividualsatorbelowthestateaverage;or 104 (2)Thepoliticalsubdivisionisincompliancewith 105 subsection6ofthisact. 106 8.Thedepartmentauthorizedtoallocatefundspursuantto 107 thissectionmaypromulgateallrulesandregulationstoimplement 108 theprovisionsofthissection.Anyruleorportionofarule,as 109 thattermisdefinedinsection536.010,thatiscreatedunderthe 110 authoritydelegatedinthissectionshallbecomeeffectiveonlyif 111 itcomplieswithandissubjecttoalloftheprovisionsofchapter 112 536and,ifapplicable,section536.028.Thissectionandchapter 113 536arenonseverableandifanyofthepowersvestedwiththe 114 generalassemblypursuanttochapter536toreview,todelaythe 115 effectivedate,ortodisapproveandannularulearesubsequently 116 heldunconstitutional, thesystemtotheboardwithintendaysaftersuchvote.Thedate 9 inwhichthepoliticalsubdivision'selectionbecomeseffective 10 shallbethefirstdayofthecalendarmonthspecifiedbysuch 11 ofcourtorwhilethecourtisinsession. 7 2.Suchsaleshallconveythewholeinterestofeveryperson 8 havingorclaiminganyright,titleorinterestinorlienupon 9 suchrealestate,whethersuchpersonhasansweredornot,subject 10 torights-of-waythereonofpublicutilitiesuponwhichtaxhas 11 beenotherwisepaid,andsubjectonlytothetaxlienthereon,if 12 any,oftheUnitedStatesofAmerica. 13 3.Thecollectorshalladvancefromcurrenttaxcollections 14 thesumsnecessarytopayforthepublicationofalladvertisements 15 requiredbytheprovisionsofsections92.700to92.920andshall 16 beallowedcreditthereforinhisaccountswiththetaxing 17 authoritiesonaproratabasis.Heshallgivecreditinsuch 18 accountsforallsuchadvancesrecoveredbyhim.Suchexpensesof 19 publicationshallbeapportionedprorataamongandtaxedascosts 20 againsttherespectiveparcelsofrealestatedescribedinthe 21 judgment;provided,however,thatnoneofthecostsherein 22 enumerated,includingthecostsofpublication,shallconstitute 23 anylienupontherealestateaftersuchsale. 24 4.Nopersonshallbeeligibletobidatthetimeofthe 25 sheriff'ssaleunlesssuchpersonhas,nolaterthantendays 26 beforethesaledate,demonstratedtothesatisfactionofthe 27 collectororsheriffthatthepersonisnottheownerofanyparcel 28 ofrealestateinthecitythatissubjecttodelinquentproperty 58 29 taxes,unpaidspecialtaxbills,orvacantbuildingfees.A 30 prospectivebiddershallbeprohibitedfromparticipatinginthe 31 delinquentlandtaxsaleifheorshehaspreviouslybidata 32 sheriff'ssaleandfailedtopaybidamounts,confirmthesale,or 33 signasheriff'sdeed.Thecollectororsheriffmayrequire 34 prospectivebidderstosubmitanaffidavitattestingtothe 35 requirementsofthissectionandisexpresslyauthorizedto 36 permanentlyprecludeanyprospectivebidderfromparticipatingin 37 thesaleforfailuretocomplywiththissection.Notwithstanding 38 theprovisionsofthissection,anytaxingauthorityorland 39 purchaser,uponconfirmationofsuchsalebythecourt,shallbean 9 absoluteestateinfeesimple,subjecttorights-of-waythereonof 59 10 publicutilitiesonwhichtaxhasbeenotherwisepaid,andsubject 11 toanytaxlienthereonoftheUnitedStatesofAmerica,ifany, 12 andallpersons,includingthestateofMissouri,anytaxing 13 authorityortaxdistrictasdefinedherein,judgmentcreditors, 14 lienholders,minors,incapacitatedanddisabledpersons,and 15 nonresidentswhomayhavehadanyright,title,interest,claim,or 16 equityofredemptioninorto,orlienupon,suchlandsshallbe 17 affectingsuchparcelofrealestatenotthendelinquent,orwhich 24 mayhaveattachedafterthefilingofthepetitionandpriorto 25 sheriff'ssaleandnotincludedinanyanswertosuchpetition, 26 but]. Ifsuchparcelofrealestateissoldtotheland 27 reutilizationauthoritythetitletheretoshallbefreeofany 28 [such] lienstotheextentoftheinterestofanytaxingauthority 29 insuchrealestate;providedfurther,thatsuchtitleshallnotbe 30 subjecttothelienofspecialtaxbills[whichhasattachedtothe 31 parcelofrealestatepriortoJanuary1,1972,butthelienof 32 suchspecialtaxbillsshallattachtotheproceedsofthe 33 sheriff'ssaleortotheproceedsoftheultimatesaleofsuch 34 parcelbythelandreutilizationauthority]. 92.840.1.Withinsixmonthsafterthesheriffsellsany 2 parcelofrealestate,thecourtshall,uponitsownmotionorupon 60 3 motionofanyinterestedparty,setthecausedownforhearingto 4 confirmorsetasidetheforeclosuresaleoftherealestate,even 5 thoughsuchparcelsarenotalloftheparcelsofrealestate 6 describedinthenoticeofsheriff'sforeclosuresale.Noticeof 7 thehearingshallbesentbyanyinterestedparty,orthecourt, 8 movingtoconfirmtheforeclosuresale,toeachpersonwho 9 [received] wassentnoticeofsaleasspecifiedin[subsection 3] 10 subsections4and5ofsection92.810andtoanyothernecessary 11 partiesasrequiredbyprevailingnotionsofdueprocess.Atthe 12 timeofsuchhearing,thesheriffshallmakereportofthesale, 13 andthecourtshallhearevidenceofthevalueoftheproperty 14 offeredonbehalfofanyinterestedpartytothesuit,andshall 15 immediatelydeterminewhetheranadequateconsiderationhasbeen 16 paidforeachsuchparcel.Anyparceldeemedtohavebeen 17 purchasedbythelandreutilizationauthoritypursuanttosection 18 92.830shallnotrequireanyinquiryastovalue.Thecourt's 19 judgmentshallincludeaspecificfindingthatadequatenoticewas 20 providedtoallnecessarypartiespursuanttoprevailingnotions 21 ofdueprocessandsections92.700to92.920,recitingthenotice 22 effortsofthecollector,sheriff,andtaxsalepurchaser.Nothing 23 inthissectionshallbeinterpretedtoprecludeasuccessfultax 24 salepurchaserfromassertingaclaimtoquiettitletothebid 25 uponparcelpursuanttosection527.150. 26 2.Forthispurpose,thecourtshallhavepowertosummonany 27 cityofficialoranyprivatepersontotestifyastothereasonable 28 valueoftheproperty,andifthecourtfindsthatadequate 29 considerationhasbeenpaid,heshallconfirmthesaleandorder 61 30 thesherifftoissueadeedwithrestrictionasprovidedhereinto 31 thepurchasersubjecttotheapplicationofanoccupancypermitfor 32 allparcelsasprovidedinsubsection[5]7ofthissection.If 33 thecourtfindsthattheconsiderationpaidisinadequate,the 34 purchasermayincreasehisbidtosuchamountasthecourtmaydeem 35 tobeadequate,whereuponthecourtmayconfirmthesale.If, 36 however,thepurchaserdeclinestoincreasehisbidandmakesuch 37 additionalpayment,thenthesaleshallbedisapproved,thelienof 38 thejudgmentcontinued,andsuchparcelofrealestateshallbe 39 againadvertisedandofferedforsalebythesherifftothehighest 40 bidderatpublicauctionforcashatanysubsequentsheriff's 41 foreclosuresale. 42 3.Ifthesaleisconfirmed,thecourtshallorderthe 43 proceedsofthesaleappliedinthefollowingorder: 44 (1)Tothepaymentofthecostsofthepublicationofthe 45 noticeofforeclosureandofthesheriff'sforeclosuresale; 46 (2)Tothepaymentofallofthecollectorandsheriff's 47 costsincludingappraiser'sfeeandattorney'sfees; 48 (3)Tothepaymentofalltaxbillsadjudgedtobedueinthe 49 orderoftheirpriority,includingprincipal,interestand 50 penaltiesthereon.If,aftersuchpayment,thereisanysum 51 remainingoftheproceedsofthesheriff'sforeclosuresale,the 52 courtshallthereupontryanddeterminetheotherissuesinthe 53 suitinaccordancewithsection92.775.Ifanyansweringparties 54 havespeciallyappealedasprovidedinsection92.845,thecourt 55 shallretainthecustodyofsuchfundspendingdispositionofsuch 56 appeal,andupondispositionofsuchappealshallmakesuch 62 57 distribution. Iftherearenotsufficientproceedsofthesaleto 58 payallclaimsinanyclassdescribed,thecourtshallorderthe 59 sametobepaidproratainaccordancewiththepriorities. 60 4.Ifthereareanyfundsremainingoftheproceedsafterthe 61 sheriff'ssaleandafterthedistributionofsuchfundsassetout 62 inthissectionandnopersonentitledtoanysuchfunds,whether 63 ornotapartytothesuit,shall,withintwoyearsaftersuch 64 sale,appearandclaimthefunds,theyshallbedistributedten 65 percenttotheaffordablehousingtrustfundorequivalentofsuch 66 cityoperatingundersections92.700to92.920forpurposesthat 67 promotethereductionandpreventionofvacantproperties,with 68 theremaindertobedistributedtotheappropriatetaxing 69 authorities. 70 5.Anycityoperatingundertheprovisionsofsections92.700 71 to92.920,byordinance,mayelecttoallocateaportionofits 72 shareoftheproceedsofthesheriff'ssaletowardsafundforthe 73 purposeofdefendingagainstclaimschallengingthesufficiencyof 74 noticeprovisionsunderthissection. 75 6.Forthepurposeofthissection,theterm"occupancy 76 permit"shallmeanthecertificateof[useand] inspectionor 77 occupancypermitforresidentialorcommercialstructuresas 78 providedforintherevisedmunicipalcodeofanycitynotwithina 79 county,whichnowhasormayhereafterhaveapopulationinexcess 80 ofthreehundredthousandinhabitants. 81 [6.] 7.Ifthereisabuildingorstructureontheparcel, 82 thepurchasershallapplyforanoccupancypermitfromthecityor 83 appropriategovernmentalagencywithintendaysafterthe 63 84 confirmationhearing.Anypurchaserwhoisapubliccorporation 85 actinginagovernmentalcapacityshallnotberequiredtoacquire 86 theoccupancypermit.Whenaparcel,acquiredatasheriffsale, 87 containingabuildingissoldfromapubliccorporationactingina 88 governmentalcapacity,thesubsequentpurchasershallberequired 89 toapplyfortheoccupancypermit.Failuretoapplyforsuch 90 occupancypermitwithintendaysafterconfirmationshallresult 91 inthesaleandconfirmationbeingimmediatelysetasidebythe 92 motionofanyinterestedpartyandthatparcelshallagainbe 93 advertisedandofferedforsalebythesherifftothehighest 94 bidderatpublicauctionforcashatanysubsequentsheriff 95 foreclosuresale. 96 [7.] 8.Thesheriffshallincludeadeedrestrictioninthe 97 sheriff'sdeed,issuedafterconfirmationandafterthe 98 applicationofanoccupancypermitforanyparcelcontaininga 99 buildingorstructure. Thedeedrestrictionshallstatethatthe 100 purchasersatthesheriff'ssalewhohadthepropertyconfirmedand 101 whoappliedforanoccupancypermitshallobtainanoccupancy 102 permitforthebuildingorstructurefromtheappropriate 103 governmentalagencypriortoanysubsequenttransferorsaleof 104 thisproperty. Thisdeedrestrictionshallnotexistasalien 105 againstsuchrealestate[whilethepurchasersholdsameinthe 106 amountoffivethousanddollars]. Thepurchasersoftheproperty 107 atthesheriffsalewhohadthepropertyconfirmedandappliedfor 108 theoccupancypermitshallagreethatintheeventoftheirfailure 109 toobtainanoccupancypermitpriortoanysubsequenttransferof 110 theproperty,theyshallpaytothesheriffthesumoffive 64 111 thousanddollarsasfixed,liquidatedandascertaineddamages 112 withoutproofoflossordamages.Thesedamagesshallnot 113 constitutealienonproperty,andthesheriffshallhavethe 114 discretionarypowertofilealawsuitagainstsuchpurchaserfor 115 collectionoftheseliquidateddamages.Theseliquidateddamages 116 shallbedistributedonaproratedbasistotheappropriatetaxing 117 authorityafterthesheriffdeductsallcosts,expensesand 118 [attorney] attorney'sfeesforsuchlawsuits. Thesheriffmay 119 employattorneysashedeemsnecessarytocollectliquidated 120 damages. 121 9.Ifanysaleisnotconfirmedwithinsixmonthsafterthe 122 sale,anyset-asideofthesalemay,atthediscretionofthecourt 123 orcollector,includeapenaltyoftwenty-fivepercentofthebid 124 amountoverandabovetheopeningbidamount,andsuchpenalty 125 shallbedirectedtotheaffordablehousingtrustfundorthe 126 equivalent,ifany,ofacityoperatingundersections92.700to 127 92.920. 128 10.Anyinterestedparty,otherthanthesheriff'ssale 129 purchaser,whomovesthecourttosetasideasheriff'ssaleafter 130 theissuanceofasheriff'sdeedmadeundertheprovisionsof 131 sections92.700to92.920shallberequiredtopayintothecourt 132 theredemptionamountotherwisenecessaryundersection92.750 133 priortothecourthearinganysuchmotiontosetaside.Thecourt 134 mayhearanymotiontoconfirmbroughtunderthetermsofthis 135 sectioniftheredemptionamountisnotpaidbytheinterested 136 partymovingthecourttosetasidethesale. 92.852.Anysheriff'sdeedgivenpursuanttothemunicipal 65 2 landreutilizationlawshallbesubjecttoarecordingfeeforthe 3 costsofrecordingthedeedthatshallbeassessedandcollected 4 fromthepurchaserofthepropertyatthesametimetheproceeds 5 fromthesalearecollected. Allsuchdeedsshallberecordedat 6 theofficeoftherecorderofdeedswithintwomonthsafterthe 7 [sheriff'sdeedisgiven] courtconfirmsthesale,ifnoproceeding 8 tosetasidetheconfirmationjudgmentisbeforethecourt. 92.855.Eachsheriff'sdeedgivenpursuanttotheprovisions 2 ofthemunicipallandreutilizationlawshallbe[presumptive] 3 primafacieevidencethatthesuitandallproceedingsthereinand 4 allproceedingspriortheretofromandincludingassessmentofthe 5 landsaffectedtherebyandallnoticesrequiredbylawwereregular 6 andinaccordancewithallprovisionsofthelawrelatingthereto. 7 [Aftertwoyearsfromthedateoftherecordingofsuchsheriff's 8 deed,thepresumptionshallbeconclusive,unlessatthetimethat 9 thissectiontakeseffectthetwo-yearperiodsincetherecording 10 ofsuchsheriff'sdeedhasexpired,orlessthansixmonthsofsuch 11 periodoftwoyearsremainsunexpired,inwhichlattercasethe 12 presumptionshallbecomeconclusivesixmonthsafterSeptember28, 13 1971.Nosuittosetasideortoattackthevalidityofanysuch 14 sheriff'sdeedshallbecommencedormaintainedunlessthesuitis 15 filedpriortothetimethatthepresumptionbecomesconclusive,as 16 aforesaid.] 99.825.1.Priortotheadoptionofanordinanceproposing 2 thedesignationofaredevelopmentarea,orapprovinga 3 redevelopmentplanorredevelopmentproject,thecommissionshall 4 fixatimeandplaceforapublichearingasrequiredinsubsection 66 5 4ofsection99.820andnotifyeachtaxingdistrictlocatedwholly 6 orpartiallywithintheboundariesoftheproposedredevelopment 7 area,planorproject.Atthepublichearinganyinterestedperson 8 oraffectedtaxingdistrictmayfilewiththecommissionwritten 9 objectionsto,orcommentson,andmaybeheardorallyinrespect 10 to,anyissuesembodiedinthenotice.Thecommissionshallhear 11 andconsiderallprotests,objections,commentsandotherevidence 12 presentedatthehearing.Thehearingmaybecontinuedtoanother 13 datewithoutfurthernoticeotherthanamotiontobeenteredupon 14 theminutesfixingthetimeandplaceofthesubsequenthearing,as 15 wellasprovidingsuchinformationtotheMissouridepartmentof 16 revenue,whichshallpublishsuchinformationonitswebsite; 17 provided,ifthecommissioniscreatedundersubsection3of 18 section99.820,thehearingshallnotbecontinuedformorethan 19 thirtydaysbeyondthedateonwhichitisoriginallyopenedunless 20 suchlongerperiodisrequestedbythechiefelectedofficialof 21 themunicipalitycreatingthecommissionandapprovedbya 22 majorityofthecommission. Aftertheadoptionofanordinanceapprovinga 40 redevelopmentplanorredevelopmentproject,ordesignatinga 41 redevelopmentarea,noordinanceshallbeadoptedalteringthe 42 exteriorboundaries,affectingthegenerallandusesestablished 43 pursuanttotheredevelopmentplanorchangingthenatureofthe 44 redevelopmentprojectwithoutcomplyingwiththeprocedures 45 providedinthissectionpertainingtotheinitialapprovalofa 46 redevelopmentplanorredevelopmentprojectanddesignationofa 47 redevelopmentarea.Hearingswithregardtoaredevelopment 48 project,redevelopmentarea,orredevelopmentplanmaybeheld 49 simultaneously. 50 2.If,afterconcludingthehearingrequiredunderthis 51 section,thecommissionmakesarecommendationundersection 52 99.820inoppositiontoaproposedredevelopmentplan, 53 redevelopmentproject,ordesignationofaredevelopmentarea,or 54 anyamendmentsthereto,amunicipalitydesiringtoapprovesuch 55 project,plan,designation,oramendmentsshalldosoonlyupona 56 two-thirdsmajorityvoteofthegoverningbodyofsuch 57 municipality. Noticeofsuchpublichearingshallbegivenina 63 newspaperofgeneralcirculationintheareaservedbythe 64 commissiononceeachweekforfourweeksimmediatelypriortothe 65 hearing,andshallalsobesenttotheMissouridepartmentof 66 revenue,whichshallpublishsuchnoticeonitswebsite. 67 4.Thedirectorofthedepartmentofrevenueshallsubmita 68 reporttothestateauditor,thespeakerofthehouseof 69 representatives, andthepresidentprotemofthesenatenolater 70 thanFebruaryfirstofeachyear.Thereportshallcontaina 71 summaryofallinformationreceivedbythedirectorpursuantto 72 subsection1ofthissection. 73 5.Forthepurposeofcoordinatingalltaxincrement 74 financingprojectsusingnewstaterevenues,thedirectorofthe 75 departmentofeconomicdevelopmentmaypromulgaterulesand 76 regulationstoensurecompliancewiththissection.Suchrulesand 77 regulationsmayincludemethodsforenumeratingallofthe 78 municipalitieswhichhaveestablishedcommissionspursuantto 79 section99.820.Noruleorportionofarulepromulgatedunderthe 80 authorityofsections99.800to99.865shallbecomeeffective 81 unlessithasbeenpromulgatedpursuanttotheprovisionsof 82 chapter536.AllrulemakingauthoritydelegatedpriortoJune27, 83 1997,isofnoforceandeffectandrepealed;however,nothingin 84 thissectionshallbeinterpretedtorepealoraffectthevalidity 85 ofanyrulefiledoradoptedpriortoJune27,1997,ifsuchrule 86 compliedwiththeprovisionsofchapter536.Theprovisionsof 87 thissectionandchapter536arenonseverableandifanyofthe 74 88 powersvestedwiththegeneralassemblypursuanttochapter536 89 includingtheabilitytoreview,todelaytheeffectivedate,orto 90 disapproveandannularuleorportionofarulearesubsequently 91 heldunconstitutional, thenthepurportedgrantofrulemaking 92 authorityandanyrulesoproposedandcontainedintheorderof 93 rulemakingshallbeinvalidandvoid. 94 6.Thedepartmentofeconomicdevelopmentshallprovide 95 informationandtechnicalassistance,asrequestedbyany 96 municipality,ontherequirementsofsections99.800to99.865. 97 Suchinformationandtechnicalassistanceshallbeprovidedinthe 98 formofamanual,writteninaneasy-to-followmanner,andthrough 99 consultationswithdepartmentalstaff. 100 7.Thedepartmentofrevenueshallprovidenoticeofany 101 failuretocomplywiththereportingrequirementsprovidedin 102 subsection1ofthissectiontotheapplicablemunicipality, 103 specifyinganyrequiredcorrections,bycertifiedmailaddressed 104 tothemunicipality'schiefelectedofficer.Ifsuchmunicipality 105 doesnotsatisfythereportingrequirementsforwhichit 106 previouslydidnotcomply,asspecifiedinthenoticefromthe 107 departmentofrevenue,withinsixtydaysofthereceiptofthe 108 notice,themunicipalityshallbeprohibitedfromadoptinganynew 109 taxincrementfinanceplanforaperiodoffiveyearsfromthedate 110 ofthedepartmentofrevenue'snotice.Allreportsfiledpursuant 111 tosubsection1ofthissectionorinresponsetoanoticefromthe 112 departmentofrevenuepursuanttothissubsectionshallbedeemed 113 acceptedbythedepartmentofrevenueunlessthedepartmentof 114 revenueprovidestheapplicablemunicipalitywithawritten 75 115 objectionthereto,specifyinganyrequiredcorrections,by 116 certifiedmailaddressedtothechiefelectedofficerofthe 117 municipalitywithinsixtydaysofthemunicipality'ssubmissionof 118 suchreport. 119 8.Basedupontheinformationprovidedinthereports 120 requiredundertheprovisionsofthissection,thestateauditor 121 shallmakeavailableforpublicinspectionontheauditor's 122 websiteasearchableelectronicdatabaseofsuchmunicipaltax 123 incrementfinancereports.Allinformationcontainedwithinsuch 124 databaseshallbemaintainedforaperiodofnolessthantenyears 125 frominitialposting. 105.145.1.Thefollowingdefinitionsshallbeappliedto 2 thetermsusedinthissection: 3 (1)"Governingbody",theboard,body,orpersonsinwhich 4 thepowersofapoliticalsubdivisionasabodycorporate,or 5 otherwise,arevested; 6 (2)"Politicalsubdivision",anyagencyorunitofthis 7 state,exceptcountiesandschooldistricts,whichnowis,or 8 hereaftershallbe,authorizedtolevytaxesorempoweredtocause 9 taxestobelevied. 10 2.Thegoverningbodyofeachpoliticalsubdivisioninthe 11 stateshallcausetobepreparedanannualreportofthefinancial 12 transactionsofthepoliticalsubdivisioninsuchsummaryformas 13 thestateauditorshallprescribebyrule,exceptthattheannual 14 reportofpoliticalsubdivisionswhosecashreceiptsforthe 15 reportingperiodaretenthousanddollarsorlessshallonlybe 16 requiredtocontainthecashbalanceatthebeginningofthe 76 17 reportingperiod,asummaryofcashreceipts,asummaryofcash 18 disbursementsandthecashbalanceattheendofthereporting 19 period. 20 3.Withinsuchtimefollowingtheendofthefiscalyearas 21 thestateauditorshallprescribebyrule,thegoverningbodyof 22 eachpoliticalsubdivisionshallcauseacopyoftheannual 23 financialreporttoberemittedtothestateauditor. 24 4.Thestateauditorshallimmediatelyonreceiptofeach 25 financialreportacknowledgethereceiptofthereport. 26 5.Inanyfiscalyearnomemberofthegoverningbodyofany 27 politicalsubdivisionofthestateshallreceiveanycompensation 28 orpaymentofexpensesaftertheendofthetimewithinwhichthe 29 financialstatementofthepoliticalsubdivisionisrequiredtobe 30 filedwiththestateauditoranduntilsuchtimeasthenoticefrom 31 thestateauditorofthefilingoftheannualfinancialreportfor 32 thefiscalyearhasbeenreceived. 33 6.Thestateauditorshallpreparesampleformsforfinancial 34 reportsandshallmailthesametothepoliticalsubdivisionsof 35 thestate.Failureoftheauditortosupplysuchformsshallnot 36 inanywayexcuseanypersonfromtheperformanceofanyduty 37 imposedbythissection. 38 7.Allreportsorfinancialstatementshereinabovementioned 39 shallbeconsideredtobepublicrecords. 40 8.Theprovisionsofthissectionapplytotheboardof 41 directorsofeverytransportationdevelopmentdistrictorganized 42 undersections238.200to238.275. 43 9.Anypoliticalsubdivisionthatfailstotimelysubmita 77 44 copyoftheannualfinancialstatementtothestateauditorshall 45 besubjecttoafineoffivehundreddollarsperday. 46 10.Thestateauditorshallreportanyviolationof 47 subsection9ofthissectiontothedepartmentofrevenue.Upon 48 notificationfromthestateauditor'sofficethatapolitical 49 subdivisionfailedtotimelysubmitacopyoftheannualfinancial 50 statement,thedepartmentofrevenueshallnotifysuchpolitical 51 subdivisionbycertifiedmailthatthestatementhasnotbeen 52 received. Suchnoticeshallclearlysetforththefollowing: 53 (1)Thenameofthepoliticalsubdivision; 54 (2)Thatthepoliticalsubdivisionshallbesubjecttoafine 55 offivehundreddollarsperdayifthepoliticalsubdivisiondoes 56 notsubmitacopyoftheannualfinancialstatementtothestate 57 auditor'sofficewithinthirtydaysfromthepostmarkeddate 58 stampedonthecertifiedmailenvelope; 59 (3)Thatthefinewillbeenforcedandcollectedasprovided 60 undersubsection11ofthissection;and 61 (4)Thatthefinewillbeginaccruingonthethirty-firstday 62 fromthepostmarkeddatestampedonthecertifiedmailenvelopeand 63 willcontinuetoaccrueuntilthestateauditor'sofficereceivesa 64 copyofthefinancialstatement. 65 66 Intheeventacopyoftheannualfinancialstatementisreceived 67 withinsuchthirty-dayperiod,nofineshallaccrueorbeimposed. 68 Thestateauditorshallreportreceiptofthefinancialstatement 69 tothedepartmentofrevenuewithintenbusinessdays.Failureof 70 thepoliticalsubdivisiontosubmittherequiredannualfinancial 78 71 statementwithinsuchthirty-dayperiodshallcausethefinetobe 72 collectedasprovidedundersubsection11ofthissection. 73 11.Thedepartmentofrevenuemaycollectthefineauthorized 74 undertheprovisionsofsubsection9ofthissectionbyoffsetting 75 anysalesorusetaxdistributionsduetothepolitical 76 subdivision. Thedirectorofrevenueshallretaintwopercentfor 77 thecostofsuchcollection. Theremainingrevenuescollectedfrom 78 suchviolationsshallbedistributedannuallytotheschoolsofthe 79 countyinthesamemannerthatproceedsforallpenalties, 80 forfeitures,andfinescollectedforanybreachofthepenallaws 81 ofthestatearedistributed. 82 12.Any[transportation developmentdistrictorganizedunder 83 sections238.200to238.275having] politicalsubdivisionthathas 84 grossrevenuesoflessthanfivethousanddollarsorthathasnot 85 leviedorcollectedtaxesinthefiscalyearforwhichtheannual 86 financialstatementwasnottimelyfiledshallnotbesubjectto 87 thefineauthorizedinthissection. 88 13.Ifafailuretotimelysubmittheannualfinancial 89 statementistheresultoffraudorotherillegalconductbyan 90 employeeorofficerofthepoliticalsubdivision,thepolitical 91 subdivisionshallnotbesubjecttoafineauthorizedunderthis 92 sectionifthestatementisfiledwithinthirtydaysofthe 93 discoveryofthefraudorillegalconduct.Ifafineisassessed 94 andpaidpriortothefilingofthestatement,thedepartmentof 95 revenueshallrefundthefineuponnotificationfromthepolitical 96 subdivision. 97 14.Ifapoliticalsubdivisionhasanoutstandingbalancefor 79 98 finesorpenaltiesatthetimeitfilesitsfirstannualfinancial 99 statementafterJanuary1,2023,thedirectorofrevenueshallmake 100 aone-timedownwardadjustmenttosuchoutstandingbalanceinan 101 amountthatreducestheoutstandingbalancebynolessthanninety 102 percent. 103 15.Thedirectorofrevenueshallhavetheauthoritytomake 104 aone-timedownwardadjustmenttoanyoutstandingpenaltyimposed 105 underthissectiononapoliticalsubdivisionifthedirector 106 determinesthefineisuncollectable. Thedirectorofrevenuemay 107 prescriberulesandregulationsnecessarytocarryoutthe 108 provisionsofthissubsection. Anyruleorportionofarule,as 109 thattermisdefinedinsection536.010,thatiscreatedunderthe 110 authoritydelegatedinthissectionshallbecomeeffectiveonlyif 111 itcomplieswithandissubjecttoalloftheprovisionsofchapter 112 536and,ifapplicable,section536.028.Thissectionandchapter 113 536arenonseverable,andifanyofthepowersvestedwiththe 114 generalassemblypursuanttochapter536toreview,todelaythe 115 effectivedate,ortodisapproveandannularulearesubsequently 116 heldunconstitutional, thenthegrantofrulemakingauthorityand 117 anyruleproposedoradoptedafterAugust28,2022,shallbe 118 invalidandvoid. 140.170.1.Exceptforlandsdescribedinsubsection7of 2 thissection,thecountycollectorshallcauseacopyofthelist 3 ofdelinquentlandsandlotstobeprintedinsomenewspaperof 4 generalcirculationpublishedinthecountyforthreeconsecutive 5 weeks,oneinsertionweekly,beforethesale,thelastinsertionto 6 beatleastfifteendayspriortothefourthMondayinAugust. 80 7 2.Inadditiontothenamesofallrecordownersorthenames 8 ofallownersappearingonthelandtaxbookitisonlynecessary 9 intheprintedandpublishedlisttostateintheaggregatethe 10 amountoftaxes,penalty,interestandcostduethereon,eachyear 11 separatelystated. 12 3.Tothelistshallbeattachedandinlikemannerprinted 13 andpublishedanoticeofsaidlandsandlotsstatingthatsaid 14 landandlotswillbesoldatpublicauctiontodischargethe 15 taxes,penalty,interest,andcostsduethereonatthetimeofsale 16 inoradjacenttothecourthouseofsuchcounty,onthefourth 17 MondayinAugustnextthereafter,commencingatteno'clockofsaid 18 dayandcontinuingfromdaytodaythereafteruntilallare 19 offered.Suchauctionmayalsobeconductedbyelectronicmedia, 20 includingtheinternet,atthesametimeandatthediscretionof 21 thecountycollector. 22 4.Thecountycollector,onorbeforethedayofsale,shall 23 insertatthefootofthelistonhisorherrecordacopyofthe 24 noticeandcertifyonhisorherrecordimmediatelyfollowingthe 25 noticethenameofthenewspaperofthecountyinwhichthenotice 26 wasprintedandpublishedandthedatesofinsertionsthereofin 27 thenewspaper. 28 5.Theexpenseofsuchprintingshallbepaidoutofthe 29 countytreasuryandshallnotexceedtherateprovidedforin 30 chapter493,relatingtolegalpublications,noticesand 31 advertisements, andthecostofprintingattheratepaidbythe 32 countyshallbetaxedaspartofthecostsofthesaleofanyland 33 orlotcontainedinthelist. 81 34 6.Thecountycollectorshallcausetheaffidavitofthe 35 printer,editororpublisherofthenewspaperinwhichthelistof 36 delinquentlandsandnoticeofsalewaspublished,asprovidedby 37 section493.060,withthelistandnoticeattached,toberecorded 38 intheofficeoftherecorderofdeedsofthecounty,andthe 39 recordershallnotchargeorreceiveanyfeesforrecordingthe 40 same. 41 7.Thecountycollectormayhaveaseparatelistofsuch 42 lands,withoutlegaldescriptionsorthenamesoftherecord 43 owners,printedinanewspaperofgeneralcirculationpublishedin 44 suchcountyforthreeconsecutiveweeksbeforethesaleofsuch 45 landsforaparcelorlotoflandthat: 46 (1)Hasanassessedvalueofonethousandfivehundred 47 dollarsorlessandhasbeenadvertisedpreviously;or 48 (2)Isalotinadevelopmentoftwentyormorelotsandsuch 49 lothasanassessedvalueofonethousandfivehundreddollarsor 50 less. 51 52 Thenoticeshallstatethatlegaldescriptionsandthenamesofthe 53 recordownersofsuchlandsshallbepostedatanycounty 54 courthousewithinthecountyandtheofficeofthecounty 55 collector. 56 8.If,intheopinionofthecountycollector,anadequate 57 legaldescriptionofthedelinquentlandandlotscannotbe 58 obtainedthroughresearchingthedocumentsavailablethroughthe 59 recorderofdeeds,thecollectormaycommissionaprofessional 60 landsurveyortoprepareanadequatelegaldescriptionofthe 82 61 delinquentlandandlotsinquestion. Thecostsofany 62 commissionedlandsurveydeemednecessarybythecountycollector 63 shallbetaxedaspartofthecostsofthesaleofanylandorlots 64 containedinthelistpreparedunderthissection. 140.190.1.Onthedaymentionedinthenotice,thecounty 2 collectorshallcommencethesaleofsuchlands,andshallcontinue 3 thesamefromdaytodayuntileachparcelassessedorbelongingto 4 eachpersonassessedshallbesoldaswillpaythetaxes,interest 5 andchargesthereon,orchargeabletosuchpersoninsaidcounty. 6 2.Thepersonorlandbankagencyofferingatsaidsale, 7 whetherinpersonorbyelectronicmedia,topaytherequiredsum 8 foratractshallbeconsideredthepurchaserofsuchland; 9 provided,nosaleshallbemadetoanypersonordesignatedagent 10 whoiscurrentlydelinquentonanytaxpaymentsonanyproperty, 11 otherthanadelinquencyonthepropertybeingofferedforsale, 12 andwhodoesnotsignanaffidavitstatingsuchatthetimeof 13 sale.Failuretosignsuchaffidavitaswellassigningafalse 14 affidavitmayinvalidatesuchsale.Nobidshallbereceivedfrom 15 anypersonnotaresidentofthestateofMissourioraforeign 16 corporationorentityalldeemednonresidents. Anonresident 17 shallfilewithsaidcollectoranagreementinwritingconsenting 18 tothejurisdictionofthecircuitcourtofthecountyinwhich 19 suchsaleshallbemade,andalsofilingwithsuchcollectoran 20 appointmentofsomecitizenofsaidcountyasagentofsaid 21 nonresident,andconsentingthatserviceofprocessonsuchagent 22 shallgivesuchcourtjurisdictiontotryanddetermineanysuit 23 growingoutoforconnectedwithsuchsalefortaxes.Afterthe 83 24 delinquentauctionsale,anycertificateofpurchaseshallbe 25 issuedtotheagent.Aftermeetingtherequirementsofsection 26 140.405,thepropertyshallbeconveyedtotheagentonbehalfof 27 thenonresident,andtheagentshallthereafterconveythe 28 propertytothenonresident. 29 3.Allsuchwrittenconsentstojurisdictionandselective 30 appointmentsshallbepreservedbythecountycollectorandshall 31 bebindinguponanypersonorcorporationclaimingundertheperson 32 consentingtojurisdictionandmakingtheappointmentherein 33 referredto;providedfurther,thatintheeventofthedeath, 34 disabilityorrefusaltoactofthepersonappointedasagentof 35 saidnonresidentthecountyclerkshallbecometheappointeeas 36 agentofsaidnonresident. 37 4.Nopersonresidinginanyhomerulecitywithmorethan 38 seventy-onethousandbutfewerthanseventy-ninethousand 39 inhabitantsshallbeeligibletooffertopurchaselandsunderthis 40 sectionunlesssuchpersonhas,nolaterthantendaysbeforethe 41 saledate,demonstratedtothesatisfactionoftheofficial 42 chargedbylawwithconductingthesalethatthepersonisnotthe 43 ownerofanyparcelofrealpropertythathastwoormore 44 violationsofthemunicipality'sbuildingorhousingcodes.A 45 prospectivebiddermaymakesuchademonstrationbypresenting 46 statementsfromtheappropriatecollectionandcodeenforcement 47 officialsofthemunicipality.
