12leastoncenotmorethantwentydaysandnotlessthantendaysbeforethehearingandshall CCSSSSCSHCSHB1606 14 13statetheprojectnamefortheimprovement,thedate,timeandplaceofsuchhearing,the 14generalnatureoftheimprovement,therevisedestimatedcostor,ifavailable,thefinalcostof 15theimprovement,theboundariesoftheneighborhoodimprovementdistricttobeassessed, 16andthatwrittenororalobjectionswillbeconsideredatthehearing.Suchnoticeshallalso 17besenttotheMissouridepartmentofrevenue,whichshallpublishsuchnoticeonits 18website.Atthesametime,theclerkshallmailtotheownersofrecordoftherealproperty 19madeliabletopaytheassessments,attheirlastknownpostofficeaddress,anoticeofthe 4 (2)"Statefunds",anyfundsraisedbythestateandfederalfundsreceivedbythe 5stateforhousingorhomelessness,butshallnotincludeanyfederalfundsnotabletobe 6usedforhousingprogramspursuanttothissectionduetofederalstatutoryor 7regulatoryrestrictions. 8 2.Statefundsforthehomelessshallbeusedforthefollowing: 9 (1)Forparkingareas,eachareashallprovide: 10 (a)Accesstopotablewaterandelectricoutlets;and 11 (b)Accesstobathroomssufficienttoservealloftheparkingareas; 12 (2)Forcampingfacilities,individualsexperiencinghomelessnessmaycampand 13storepersonalpropertyatsuchfacilities,whichshallbesubjecttothefollowing: 14 (a)Individualsshallonlycampandstorepersonalpropertyatsuchfacilitiesin 15theareasdesignatedtoeachindividualbytheagencyprovidingthecampingfacilities; 16and 17 (b)Facilitiesshallprovideamentalhealthandsubstanceuseevaluationas 18designatedbyastateorlocalagencyandindividualsmaycompletesuchevaluation; 19 (3)Forindividualshelters,whichshallbesubjecttothefollowing: 20 (a)Besuitabletohousebetweenoneandthreeindividuals; 21 (b)Providebasicsleepingaccommodationsandaccesstoelectricity; CCSSSSCSHCSHB1606 20 22 (c)Provideadequateaccesstoshowersandbathroomfacilities;and 23 (d)Belimitedtooccupationbyeachindividualforaperiodofnotmorethantwo 24years; 25 (4)Forcongregatesheltershousingmorethanfourhomelessindividualsinone 26space,statefundsshallbeavailableonlytotheextentthesheltermonitorsandprovides 27programstoimprovetheemployment,income,andpreventionofreturnto 28homelessnessofindividualsleavingthoseshelters.Thedepartmentshallprovide 29performancepaymentsofuptotenpercentforsuchprogramsthatmeetguidelinesas 30establishedbythedepartment. 31 32Individualsutilizingsuchfacilitiespursuanttothissubsectionshallbeenteredintoa 33homelessnessmanagementinformationsystemmaintainedbythelocalcontinuumof 34care. 35 3.Aprivatecampgroundowneroranemployeeorofficerofaprivate 36campgroundoperatingsuchfacilitypursuanttothissectionshallbesubjecttothe 37provisionsofsection537.328. 38 4.(1)Statefundsotherwiseusedfortheconstructionofpermanenthousingfor 39thehomelessshallbeusedtoassistsuchindividualswithsubstanceuse,mentalhealth 40treatment,andotherservices,includingshort-termhousing.Thedepartmentshall 41provideuptotwenty-fivepercentofthebaseallocationofsuchfundsasperformance 42paymentstopoliticalsubdivisionsornot-for-profitorganizationsprovidingsuch 43servicesasrewardsformeetingpredeterminedgoalsonreductionsof: 44 (a)Daysunhoused; 45 (b)Daysinjailorprison;and 46 (c)Dayshospitalized,withtheweightsofsuchdaystobedeterminedbythe 47department. 48 (2)Politicalsubdivisionsandnot-for-profitorganizationsmayusestategrants 49otherwiseusedforpermanenthousingtoconductsurveystoidentifyindividualswith 50thegreatestnumberofdaysunhoused,injailorprison,orhospitalizedbutthese 51expensesshallnotexceedtenpercentofthetotalgrantamount. 52 5.Nopersonshallbepermittedtousestate-ownedlandsforunauthorized 53sleeping,camping,ortheconstructionoflong-termshelters.Anyviolationofthis 54subsectionshallbeaclassCmisdemeanor;however,forthefirstoffensesuchindividual 55shallbegivenawarning,andnocitationshallbeissuedunlessthatindividualrefusesto 56movetoanyofferedservicesorshelter. CCSSSSCSHCSHB1606 21 57 6.(1)Apoliticalsubdivisionshallnotadoptorenforceanypolicyunderwhich 58thepoliticalsubdivisionprohibitsordiscouragestheenforcementofanyorderor 59ordinanceprohibitingpubliccamping,sleeping,orobstructionsofsidewalks. 60 (2)Incompliancewithsubsection5ofthissection,apoliticalsubdivisionshall 61notprohibitordiscourageapeaceofficerorprosecutingattorneywhoisemployedbyor 62otherwiseunderthedirectionorcontrolofthepoliticalsubdivisionfromenforcingany 63orderorordinanceprohibitingpubliccamping,sleeping,orobstructionsofsidewalks. 64 (3)Theprovisionsofthissectionshallnotprohibitapolicyofanypolitical 65subdivisionthatencouragesdiversionprogramsorofferingofservicesinlieuofa 66citationorarrest. 67 (4)Theattorneygeneralshallhavethepowertobringacivilactioninanycourt 68ofcompetentjurisdictionagainstanypoliticalsubdivisiontoenjointhepolitical 69subdivisionfromviolatingtheprovisionsofthissubsection. 70 (5)Theattorneygeneralmayrecoverreasonableexpensesincurredinanycivil 71actionbroughtunderthissection,includingcourtcosts,reasonableattorney'sfees, 72investigativecosts,witnessfees,anddepositioncosts. 73 7.Anypoliticalsubdivisionwithahigherper-capitarateofhomelessnessthan 74thestateaverage,asdeterminedbythemostrecentUnitedStatescensusnumbersfor 75theoverallpopulationandthemostrecentfederalDepartmentofHousingandUrban 76Developmenthomelessnesspoint-in-timecontinuumofcare,asdefinedby24C.F.R. 77578.5(a),inwhichthepoliticalsubdivisionislocated,shall,withinoneyearofthe 78passageofthisact,receivenofurtherstatefundingbythedepartmentuntilthe 79departmentdetermines: 80 (1)Thepoliticalsubdivisionhasaper-capitarateofunshelteredhomeless 81individualsatorbelowthestateaverage;or 82 (2)Thepoliticalsubdivisionisincompliancewithsubsection6ofthisact. 83 8.Thedepartmentauthorizedtoallocatefundspursuanttothissectionmay 84promulgateallrulesandregulationstoimplementtheprovisionsofthissection.Any 85ruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunder 86theauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithand 87issubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 88sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 89generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 90disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 91rulemakingauthorityandanyruleproposedoradoptedafterJanuary1,2023,shallbe 92invalidandvoid. CCSSSSCSHCSHB1606 22 93 9.Theprovisionsofthissection,includingreferencestothedisbursementof 94stategrantsandfunds,shallnotapplytosheltersforvictimsofdomesticviolenceas 95definedinsection455.200. 70.631.1.Eachpoliticalsubdivisionmay,bymajorityvoteofitsgoverningbody, 2electtocoveremergencytelecommunicators,jailors,andemergencymedicalservice 3personnelaspublicsafetypersonnelmembersofthesystem.Theclerkorsecretaryofthe 4politicalsubdivisionshallcertifyanelectionconcerningthecoverageofemergency 5telecommunicators,jailors,andemergencymedicalservicepersonnelaspublicsafety 6personnelmembersofthesystemtotheboardwithintendaysaftersuchvote.Thedatein 7whichthepoliticalsubdivision'selectionbecomeseffectiveshallbethefirstdayofthe 8calendarmonthspecifiedbysuchgoverningbody,thefirstdayofthecalendarmonthnext 9followingreceiptbytheboardofthecertificationoftheelection,ortheeffectivedateofthe 10politicalsubdivision'sbecominganemployer,whicheveristhelatestdate.Suchelection 11shallnotbechangedaftertheeffectivedate.Iftheelectionismade,thecoverageprovisions 12shallbeapplicabletoallpastandfutureemploymentwiththeemployerbypresentandfuture 13employees.Ifapoliticalsubdivisionmakesnoelectionunderthissection,noemergency 14telecommunicator,jailor,oremergencymedicalservicepersonnelofthepoliticalsubdivision 15shallbeconsideredpublicsafetypersonnelforpurposesdeterminingaminimumservice 16retirementageasdefinedinsection70.600. 17 2.Ifanemployerelectstocoveremergencytelecommunicators,jailors,and 18emergencymedicalservicepersonnelaspublicsafetypersonnelmembersofthesystem,the 19employer'scontributionsshallbecorrespondinglychangedeffectivethesamedateasthe 20effectivedateofthepoliticalsubdivision'selection. 21 3.Thelimitationonincreasesinanemployer'scontributionsprovidedbysubsection 226ofsection70.730shallnotapplytoanycontributionincreaseresultingfromanemployer 23makinganelectionundertheprovisionsofthissection. 24 [4.Theprovisionsofthissectionshallonlyapplytocountiesofthethird 25classificationandanycountyofthefirstclassificationwithmorethanseventythousandbut 26fewerthaneighty-threethousandinhabitantsandwithacityofthefourthclassificationwith 27morethanthirteenthousandfivehundredbutfewerthansixteenthousandinhabitantsasthe 28countyseat,andanypoliticalsubdivisionslocated,inwholeorinpart,withinsuchcounties.] 92.720.1.Ifanyofthelandsortownlotscontainedinthebacktaxbookorlistof 2delinquentlandsorlotsremainunredeemedonthefirstdayofJanuary,thecollectormayfile 3suitinthecircuitcourtagainstsuchlandsorlotstoenforcethelienofthestateandcityas 4hereinprovidedinsections92.700to92.920. 5 2.Thecollectorshallnoteoppositesuchtractinthebacktaxbookthefactthatsuit 6hasbeencommenced. 2salebythesheriff,anyinterestedpartymayredeemanyparcelofrealestateasprovidedby 3sections92.700to92.920;exceptthatduringsuchtimeandatanytimepriortothetimeof 4foreclosuresalebythesheriff,thecollectorshallenterintoawrittenredemptioncontractwith 5theownerofanyrealestateoccupiedasahomesteadandwhohasnotpreviouslydefaulted CCSSSSCSHCSHB1606 32 9 3.Thecollectorshalladvancefromcurrenttaxcollectionsthesumsnecessarytopay 10forthepublicationofalladvertisementsrequiredbytheprovisionsofsections92.700to 1192.920andshallbeallowedcreditthereforinhisaccountswiththetaxingauthoritiesonapro 12ratabasis.Heshallgivecreditinsuchaccountsforallsuchadvancesrecoveredbyhim. 13Suchexpensesofpublicationshallbeapportionedprorataamongandtaxedascostsagainst 14therespectiveparcelsofrealestatedescribedinthejudgment;provided,however,thatnone 15ofthecostshereinenumerated,includingthecostsofpublication,shallconstituteanylien 16upontherealestateaftersuchsale. 17 4.Nopersonshallbeeligibletobidatthetimeofthesheriff'ssaleunlesssuch 18personhas,nolaterthantendaysbeforethesaledate,demonstratedtothesatisfaction 19ofthecollectororsheriffthatthepersonisnottheownerofanyparcelofrealestatein 20thecitythatissubjecttodelinquentpropertytaxes,unpaidspecialtaxbills,orvacant 21buildingfees.Aprospectivebiddershallbeprohibitedfromparticipatinginthe 22delinquentlandtaxsaleifheorshehaspreviouslybidatasheriff'ssaleandfailedto 23paybidamounts,confirmthesale,orsignasheriff'sdeed.Thecollectororsheriffmay 24requireprospectivebidderstosubmitanaffidavitattestingtotherequirementsofthis 25sectionandisexpresslyauthorizedtopermanentlyprecludeanyprospectivebidder 26fromparticipatinginthesaleforfailuretocomplywiththissection.Notwithstanding 27theprovisionsofthissection,anytaxingauthorityorlandreutilizationauthorityshall 28beeligibletobidatanysaleconductedunderthissectionwithoutmakingsucha 29demonstration.Thepurchaseratasaleconductedbythesheriffshallpaycashimmediately 30attheendofbiddingofeachparcelonthedayofthesaleinanamountincludingalltaxes 31thendueandowing, whichmaybeinanamountinexcessoforlessthanthejudgment 32amount,andothercosts[asotherwiseprovidedbylaw],exclusiveofanyamountsfordebts 33owedtoanystatutorilycreatedsewerdistrict. 92.835.1.Thetitletoanyrealestatewhichshallvestinthelandreutilization 2authorityundertheprovisionsofsections92.700to92.920shallbeheldbytheland 3reutilizationauthorityofthecityintrustforthetaxbillownersandtaxingauthoritieshaving 4aninterestinanytaxlienswhichwereforeclosed,astheirinterestsmayappearinthe 5judgmentofforeclosure. 6 2.Thetitletoanyrealestatewhichshallvestinanypurchaser,uponconfirmationof 7suchsalebythecourt,shallbeanabsoluteestateinfeesimple,subjecttorights-of-way 8thereonofpublicutilitiesonwhichtaxhasbeenotherwisepaid,andsubjecttoanytaxlien 9thereonoftheUnitedStatesofAmerica,ifany,andallpersons,includingthestateof 10Missouri,anytaxingauthorityortaxdistrictasdefinedherein,judgmentcreditors, 11lienholders,minors,incapacitatedanddisabledpersons,andnonresidentswhomayhavehad 12anyright,title,interest,claim,orequityofredemptioninorto,orlienupon,suchlandsshall CCSSSSCSHCSHB1606 33 13bebarredandforeverforeclosedofallsuchright,title,interest,claim,lienorequityof 14redemption,andthecourtshallorderimmediatepossessionofsuchrealestatebegivento 15suchpurchaser[; provided,however,thatsuchtitleshallalsobesubjecttotheliensofanytax 16billswhichmayhaveattachedtosuchparcelofrealestatepriortothetimeofthefilingofthe 17petitionaffectingsuchparcelofrealestatenotthendelinquent,orwhichmayhaveattached 18afterthefilingofthepetitionandpriortosheriff'ssaleandnotincludedinanyanswertosuch 19petition,but].Ifsuchparcelofrealestateissoldtothelandreutilizationauthoritythetitle 20theretoshallbefreeofany[such] lienstotheextentoftheinterestofanytaxingauthorityin 21suchrealestate;providedfurther,thatsuchtitleshallnotbesubjecttothelienofspecialtax 22bills[whichhasattachedtotheparcelofrealestatepriortoJanuary1,1972,butthelienof 23suchspecialtaxbillsshallattachtotheproceedsofthesheriff'ssaleortotheproceedsofthe 24ultimatesaleofsuchparcelbythelandreutilizationauthority]. 92.840.1.Withinsixmonthsafterthesheriffsellsanyparcelofrealestate,thecourt 2shall,uponitsownmotionoruponmotionofanyinterestedparty,setthecausedownfor 3hearingtoconfirmorsetasidetheforeclosuresaleoftherealestate,eventhoughsuch 4parcelsarenotalloftheparcelsofrealestatedescribedinthenoticeofsheriff'sforeclosure 5sale.Noticeofthehearingshallbesentbyanyinterestedparty,orthecourt,movingto 6confirmtheforeclosuresale,toeachpersonwho[received] wassentnoticeofsaleas 7specifiedin[subsection3]subsections4and5ofsection92.810andtoanyother 8necessarypartiesasrequiredbyprevailingnotionsofdueprocess. Atthetimeofsuch 9hearing,thesheriffshallmakereportofthesale,andthecourtshallhearevidenceofthevalue 10ofthepropertyofferedonbehalfofanyinterestedpartytothesuit,andshallimmediately 11determinewhetheranadequateconsiderationhasbeenpaidforeachsuchparcel.Anyparcel 12deemedtohavebeenpurchasedbythelandreutilizationauthoritypursuanttosection 1392.830shallnotrequireanyinquiryastovalue.Thecourt'sjudgmentshallincludea 14specificfindingthatadequatenoticewasprovidedtoallnecessarypartiespursuantto 15prevailingnotionsofdueprocessandsections92.700to92.920,recitingthenoticeefforts 16ofthecollector,sheriff,andtaxsalepurchaser.Nothinginthissectionshallbe 17interpretedtoprecludeasuccessfultaxsalepurchaserfromassertingaclaimtoquiet 18titletothebiduponparcelpursuanttosection527.150. 19 2.Forthispurpose,thecourtshallhavepowertosummonanycityofficialorany 20privatepersontotestifyastothereasonablevalueoftheproperty,andifthecourtfindsthat 21adequateconsiderationhasbeenpaid,heshallconfirmthesaleandorderthesherifftoissuea 22deedwithrestrictionasprovidedhereintothepurchasersubjecttotheapplicationofan 23occupancypermitforallparcelsasprovidedinsubsection[5]7ofthissection.Ifthecourt 24findsthattheconsiderationpaidisinadequate,thepurchasermayincreasehisbidtosuch 25amountasthecourtmaydeemtobeadequate,whereuponthecourtmayconfirmthesale.If, CCSSSSCSHCSHB1606 34 26however,thepurchaserdeclinestoincreasehisbidandmakesuchadditionalpayment,then 27thesaleshallbedisapproved,thelienofthejudgmentcontinued,andsuchparcelofreal 28estateshallbeagainadvertisedandofferedforsalebythesherifftothehighestbidderat 29publicauctionforcashatanysubsequentsheriff'sforeclosuresale. 30 3.Ifthesaleisconfirmed,thecourtshallordertheproceedsofthesaleappliedinthe 31followingorder: 32 (1)Tothepaymentofthecostsofthepublicationofthenoticeofforeclosureandof 33thesheriff'sforeclosuresale; 34 (2)Tothepaymentofallofthecollectorandsheriff'scostsincludingappraiser'sfee 35andattorney'sfees; 36 (3)Tothepaymentofalltaxbillsadjudgedtobedueintheorderoftheirpriority, 37includingprincipal,interestandpenaltiesthereon.If,aftersuchpayment,thereisanysum 38remainingoftheproceedsofthesheriff'sforeclosuresale,thecourtshallthereupontryand 39determinetheotherissuesinthesuitinaccordancewithsection92.775.Ifanyanswering 40partieshavespeciallyappealedasprovidedinsection92.845,thecourtshallretainthe 41custodyofsuchfundspendingdispositionofsuchappeal,andupondispositionofsuch 42appealshallmakesuchdistribution.Iftherearenotsufficientproceedsofthesaletopayall 43claimsinanyclassdescribed,thecourtshallorderthesametobepaidproratainaccordance 44withthepriorities. 45 4.Ifthereareanyfundsremainingoftheproceedsafterthesheriff'ssaleandafterthe 46distributionofsuchfundsassetoutinthissectionandnopersonentitledtoanysuchfunds, 47whetherornotapartytothesuit,shall,withintwoyearsaftersuchsale,appearandclaimthe 48funds,theyshallbedistributedtenpercenttotheaffordablehousingtrustfundor 49equivalentofsuchcityoperatingundersections92.700to92.920forpurposesthat 50promotethereductionandpreventionofvacantproperties,withtheremaindertobe 51distributedtotheappropriatetaxingauthorities. 52 5.Anycityoperatingundertheprovisionsofsections92.700to92.920,by 53ordinance,mayelecttoallocateaportionofitsshareoftheproceedsofthesheriff'ssale 54towardsafundforthepurposeofdefendingagainstclaimschallengingthesufficiencyof 55noticeprovisionsunderthissection. 56 6.Forthepurposeofthissection,theterm"occupancypermit"shallmeanthe 57certificateof[useand]inspectionoroccupancypermitforresidentialorcommercial 58structuresasprovidedforintherevisedmunicipalcodeofanycitynotwithinacounty, 59whichnowhasormayhereafterhaveapopulationinexcessofthreehundredthousand 60inhabitants. 61 [6.]7.Ifthereisabuildingorstructureontheparcel,thepurchasershallapplyforan 62occupancypermitfromthecityorappropriategovernmentalagencywithintendaysafterthe CCSSSSCSHCSHB1606 35 63confirmationhearing.Anypurchaserwhoisapubliccorporationactinginagovernmental 64capacityshallnotberequiredtoacquiretheoccupancypermit.Whenaparcel,acquiredata 65sheriffsale,containingabuildingissoldfromapubliccorporationactinginagovernmental 66capacity,thesubsequentpurchasershallberequiredtoapplyfortheoccupancypermit. 67Failuretoapplyforsuchoccupancypermitwithintendaysafterconfirmationshallresultin 68thesaleandconfirmationbeingimmediatelysetasidebythemotionofanyinterestedparty 69andthatparcelshallagainbeadvertisedandofferedforsalebythesherifftothehighest 70bidderatpublicauctionforcashatanysubsequentsheriffforeclosuresale. 71 [7.]8.Thesheriffshallincludeadeedrestrictioninthesheriff'sdeed,issuedafter 72confirmationandaftertheapplicationofanoccupancypermitforanyparcelcontaininga 73buildingorstructure.Thedeedrestrictionshallstatethatthepurchasersatthesheriff'ssale 74whohadthepropertyconfirmedandwhoappliedforanoccupancypermitshallobtainan 75occupancypermitforthebuildingorstructurefromtheappropriategovernmentalagency 76priortoanysubsequenttransferorsaleofthisproperty.Thisdeedrestrictionshallnotexist 77asalienagainstsuchrealestate[whilethepurchasersholdsameintheamountoffive 78thousanddollars]. Thepurchasersofthepropertyatthesheriffsalewhohadtheproperty 79confirmedandappliedfortheoccupancypermitshallagreethatintheeventoftheirfailureto 80obtainanoccupancypermitpriortoanysubsequenttransferoftheproperty,theyshallpayto 81thesheriffthesumoffivethousanddollarsasfixed,liquidatedandascertaineddamages 82withoutproofoflossordamages.Thesedamagesshallnotconstitutealienonproperty, 83andthesheriffshallhavethediscretionarypowertofilealawsuitagainstsuchpurchaserfor 84collectionoftheseliquidateddamages.Theseliquidateddamagesshallbedistributedona 85proratedbasistotheappropriatetaxingauthorityafterthesheriffdeductsallcosts,expenses 86and[attorney] attorney'sfeesforsuchlawsuits.Thesheriffmayemployattorneysashe 87deemsnecessarytocollectliquidateddamages. 88 9.Ifanysaleisnotconfirmedwithinsixmonthsafterthesale,anyset-asideof 89thesalemay,atthediscretionofthecourtorcollector,includeapenaltyoftwenty-five 90percentofthebidamountoverandabovetheopeningbidamount,andsuchpenalty 91shallbedirectedtotheaffordablehousingtrustfundortheequivalent,ifany,ofacity 92operatingundersections92.700to92.920. 93 10.Anyinterestedparty,otherthanthesheriff'ssalepurchaser,whomovesthe 94courttosetasideasheriff'ssaleaftertheissuanceofasheriff'sdeedmadeunderthe 95provisionsofsections92.700to92.920shallberequiredtopayintothecourtthe 96redemptionamountotherwisenecessaryundersection92.750priortothecourthearing 97anysuchmotiontosetaside.Thecourtmayhearanymotiontoconfirmbroughtunder 98thetermsofthissectioniftheredemptionamountisnotpaidbytheinterestedparty 99movingthecourttosetasidethesale. CCSSSSCSHCSHB1606 36 92.852.Anysheriff'sdeedgivenpursuanttothemunicipallandreutilizationlawshall 2besubjecttoarecordingfeeforthecostsofrecordingthedeedthatshallbeassessedand 3collectedfromthepurchaserofthepropertyatthesametimetheproceedsfromthesaleare 4collected.Allsuchdeedsshallberecordedattheofficeoftherecorderofdeedswithintwo 5monthsafterthe[sheriff'sdeedisgiven] courtconfirmsthesale,ifnoproceedingtoset 6asidetheconfirmationjudgmentisbeforethecourt. 92.855.Eachsheriff'sdeedgivenpursuanttotheprovisionsofthemunicipalland 2reutilizationlawshallbe[presumptive] primafacieevidencethatthesuitandallproceedings 3thereinandallproceedingspriortheretofromandincludingassessmentofthelandsaffected 4therebyandallnoticesrequiredbylawwereregularandinaccordancewithallprovisionsof 5thelawrelatingthereto.[Aftertwoyearsfromthedateoftherecordingofsuchsheriff'sdeed, 6thepresumptionshallbeconclusive,unlessatthetimethatthissectiontakeseffectthetwo- 7yearperiodsincetherecordingofsuchsheriff'sdeedhasexpired,orlessthansixmonthsof 8suchperiodoftwoyearsremainsunexpired,inwhichlattercasethepresumptionshall 9becomeconclusivesixmonthsafterSeptember28,1971.Nosuittosetasideortoattackthe 10validityofanysuchsheriff'sdeedshallbecommencedormaintainedunlessthesuitisfiled 11priortothetimethatthepresumptionbecomesconclusive,asaforesaid.] 99.825.1.Priortotheadoptionofanordinanceproposingthedesignationofa 2redevelopmentarea,orapprovingaredevelopmentplanorredevelopmentproject,the 3commissionshallfixatimeandplaceforapublichearingasrequiredinsubsection4of 4section99.820andnotifyeachtaxingdistrictlocatedwhollyorpartiallywithinthe 5boundariesoftheproposedredevelopmentarea,planorproject.Atthepublichearingany 6interestedpersonoraffectedtaxingdistrictmayfilewiththecommissionwrittenobjections 7to,orcommentson,andmaybeheardorallyinrespectto,anyissuesembodiedinthenotice. 8Thecommissionshallhearandconsiderallprotests,objections,commentsandother 9evidencepresentedatthehearing.Thehearingmaybecontinuedtoanotherdatewithout 10furthernoticeotherthanamotiontobeenteredupontheminutesfixingthetimeandplaceof 11thesubsequenthearing, aswellasprovidingsuchinformationtotheMissouridepartment 12ofrevenue,whichshallpublishsuchinformationonitswebsite; provided,ifthe 13commissioniscreatedundersubsection3ofsection99.820,thehearingshallnotbe 14continuedformorethanthirtydaysbeyondthedateonwhichitisoriginallyopenedunless 15suchlongerperiodisrequestedbythechiefelectedofficialofthemunicipalitycreatingthe 16commissionandapprovedbyamajorityofthecommission.Priortotheconclusionofthe 17hearing,changesmaybemadeintheredevelopmentplan,redevelopmentproject,or 18redevelopmentarea,providedthateachaffectedtaxingdistrictisgivenwrittennoticeofsuch 19changesatleastsevendayspriortotheconclusionofthehearing.Afterthepublichearing 20butpriortotheadoptionofanordinanceapprovingaredevelopmentplanorredevelopment CCSSSSCSHCSHB1606 37 21project,ordesignatingaredevelopmentarea,changesmaybemadetotheredevelopment 22plan,redevelopmentprojectsorredevelopmentareaswithoutafurtherhearing,ifsuch 23changesdonotenlargetheexteriorboundariesoftheredevelopmentareaorareas,anddonot 24substantiallyaffectthegenerallandusesestablishedintheredevelopmentplanor 25substantiallychangethenatureoftheredevelopmentprojects,providedthatnoticeofsuch 26changesshallbegivenbymailtoeachaffectedtaxingdistrictandbypublicationina 27newspaperofgeneralcirculationintheareaoftheproposedredevelopmentnotlessthanten 28dayspriortotheadoptionofthechangesbyordinance.Aftertheadoptionofanordinance 29approvingaredevelopmentplanorredevelopmentproject,ordesignatingaredevelopment 30area,noordinanceshallbeadoptedalteringtheexteriorboundaries,affectingthegeneralland 31usesestablishedpursuanttotheredevelopmentplanorchangingthenatureofthe 32redevelopmentprojectwithoutcomplyingwiththeproceduresprovidedinthissection 33pertainingtotheinitialapprovalofaredevelopmentplanorredevelopmentprojectand 34designationofaredevelopmentarea.Hearingswithregardtoaredevelopmentproject, 35redevelopmentarea,orredevelopmentplanmaybeheldsimultaneously. 36 2.If,afterconcludingthehearingrequiredunderthissection,thecommissionmakes 37arecommendationundersection99.820inoppositiontoaproposedredevelopmentplan, 38redevelopmentproject,ordesignationofaredevelopmentarea,oranyamendmentsthereto,a 39municipalitydesiringtoapprovesuchproject,plan,designation,oramendmentsshalldoso 40onlyuponatwo-thirdsmajorityvoteofthegoverningbodyofsuchmunicipality.Forplans, 41projects,designations,oramendmentsapprovedbyamunicipalityovertherecommendation 42inoppositionbythecommissionformedundersubsection3ofsection99.820,theeconomic 43activitytaxesandpaymentsinlieuoftaxesgeneratedbysuchplan,project,designation,or 44amendmentshallberestrictedtopayingonlythoseredevelopmentprojectcostscontainedin 45subparagraphsb.andc.ofparagraph(c)ofsubdivision(16)ofsection99.805per 46redevelopmentproject. 47 3.Taxincrementalfinancingprojectswithinaneconomicdevelopmentareashall 48applytoandfundonlythefollowinginfrastructureprojects:highways,roads,streets,bridges, 49sewers,trafficcontrolsystemsanddevices,waterdistributionandsupplysystems,curbing, 50sidewalksandanyothersimilarpublicimprovements,butinnocaseshallitinclude 51buildings. 52 4.(1)Thegoverningbodyofthemunicipalityestablishingaredevelopmentarea 53shall,assoonasispracticable,submitthefollowinginformationtothestateauditorand 54thedepartmentofrevenue: 55 (a)Adescriptionoftheboundariesofsuchredevelopmentarea; 56 (b)Anyamendmentsmadetotheboundariesofaredevelopmentarea; CCSSSSCSHCSHB1606 38 57 (c)Theestimatedredevelopmentprojectcostsandtheestimateddateof 58completionofallredevelopmentprojects;and 59 (d)Thedateonwhichtheredevelopmentareaisdissolved. 60 (2)Thegoverningbodyofthemunicipalityestablishingaredevelopmentareaon 61orafterAugust28,2022,shallnotdepositanypaymentsinlieuoftaxesoranyother 62taxesintothespecialallocationfunduntilsuchgoverningbodyhassubmittedthe 63informationrequiredbyparagraph(a)ofsubdivision(1)ofthissubsection. 99.830.1.Noticeofthepublichearingrequiredbysection99.825shallbegivenby 2publicationandmailing.Noticebypublicationshallbegivenbypublicationatleasttwice, 3thefirstpublicationtobenotmorethanthirtydaysandthesecondpublicationtobenotmore 4thantendayspriortothehearing,inanewspaperofgeneralcirculationintheareaofthe 5proposedredevelopment.Noticebymailingshallbegivenbydepositingsuchnoticeinthe 6UnitedStatesmailbycertifiedmailaddressedtothepersonorpersonsinwhosenamethe 7generaltaxesforthelastprecedingyearwerepaidoneachlot,block,tract,orparcelofland 8lyingwithintheredevelopmentprojectorredevelopmentareawhichistobesubjectedtothe 9paymentorpaymentsinlieuoftaxesandeconomicactivitytaxespursuanttosection99.845. 10Suchnoticeshallbemailednotlessthantendayspriortothedatesetforthepublichearing. 11Intheeventtaxesforthelastprecedingyearwerenotpaid,thenoticeshallalsobesenttothe 12personslastlistedonthetaxrollswithintheprecedingthreeyearsastheownersofsuch 13property. 14 2.Thenoticesissuedpursuanttothissectionshallincludethefollowing: 15 (1)Thetimeandplaceofthepublichearing; 7 (2)Theamountandpurposeofexpendituresfromthespecialallocationfund; 8 (3)Theamountofanypledgeofrevenues,includingprincipalandinterestonany 9outstandingbondedindebtedness; 10 (4)Theoriginalassessedvalueoftheredevelopmentproject; 11 (5)Theassessedvaluationaddedtotheredevelopmentproject; 12 (6)Paymentsmadeinlieuoftaxesreceivedandexpended; 13 (7)Theeconomicactivitytaxesgeneratedwithintheredevelopmentareainthe 14calendaryearpriortotheapprovaloftheredevelopmentplan,toincludeaseparateentryfor 15thestatesalestaxrevenuebasefortheredevelopmentareaorthestateincometaxwithheldby 16employersonbehalfofexistingemployeesintheredevelopmentareapriortothe 17redevelopmentplan; 9.Anypoliticalsubdivisionthatfailstotimelysubmitacopyoftheannualfinancial 34statementtothestateauditorshallbesubjecttoafineoffivehundreddollarsperday. 35 10.Thestateauditorshallreportanyviolationofsubsection9ofthissectiontothe 36departmentofrevenue.Uponnotificationfromthestateauditor'sofficethatapolitical politicalsubdivisionthathasgrossrevenuesoflessthanfivethousand 64dollarsorthathasnotleviedorcollectedtaxesinthefiscalyearforwhichtheannual 65financialstatementwasnottimelyfiledshallnotbesubjecttothefineauthorizedinthis 66section. 67 13.Ifafailuretotimelysubmittheannualfinancialstatementistheresultof 68fraudorotherillegalconductbyanemployeeorofficerofthepoliticalsubdivision,the 69politicalsubdivisionshallnotbesubjecttoafineauthorizedunderthissectionifthe 70statementisfiledwithinthirtydaysofthediscoveryofthefraudorillegalconduct.Ifa 71fineisassessedandpaidpriortothefilingofthestatement,thedepartmentofrevenue 72shallrefundthefineuponnotificationfromthepoliticalsubdivision. 73 14.Ifapoliticalsubdivisionhasanoutstandingbalanceforfinesorpenaltiesat 74thetimeitfilesitsfirstannualfinancialstatementafterJanuary1,2023,thedirectorof 75revenueshallmakeaone-timedownwardadjustmenttosuchoutstandingbalanceinan 76amountthatreducestheoutstandingbalancebynolessthanninetypercent. 77 15.Thedirectorofrevenueshallhavetheauthoritytomakeaone-time 78downwardadjustmenttoanyoutstandingpenaltyimposedunderthissectionona 3.Tothelistshallbeattachedandinlikemannerprintedandpublishedanoticeof 11saidlandsandlotsstatingthatsaidlandandlotswillbesoldatpublicauctiontodischargethe 12taxes,penalty,interest,andcostsduethereonatthetimeofsaleinoradjacenttothe 13courthouseofsuchcounty,onthefourthMondayinAugustnextthereafter,commencingat 14teno'clockofsaiddayandcontinuingfromdaytodaythereafteruntilallareoffered.Such 15auctionmayalsobeconductedbyelectronicmedia,includingtheinternet,atthesame 16timeandatthediscretionofthecountycollector. 17 4.Thecountycollector,onorbeforethedayofsale,shallinsertatthefootofthelist 18onhisorherrecordacopyofthenoticeandcertifyonhisorherrecordimmediately 19followingthenoticethenameofthenewspaperofthecountyinwhichthenoticewasprinted 20andpublishedandthedatesofinsertionsthereofinthenewspaper. 21 5.Theexpenseofsuchprintingshallbepaidoutofthecountytreasuryandshallnot 22exceedtherateprovidedforinchapter493,relatingtolegalpublications,noticesand 23advertisements,andthecostofprintingattheratepaidbythecountyshallbetaxedaspartof 24thecostsofthesaleofanylandorlotcontainedinthelist. 25 6.Thecountycollectorshallcausetheaffidavitoftheprinter,editororpublisherof 26thenewspaperinwhichthelistofdelinquentlandsandnoticeofsalewaspublished,as 27providedbysection493.060,withthelistandnoticeattached,toberecordedintheofficeof 28therecorderofdeedsofthecounty,andtherecordershallnotchargeorreceiveanyfeesfor 29recordingthesame. 30 7.Thecountycollectormayhaveaseparatelistofsuchlands,withoutlegal 31descriptionsorthenamesoftherecordowners,printedinanewspaperofgeneralcirculation 38 (7)Anyvehicleoperatedbyanauthorizedemployeeofthedepartmentofcorrections 39who,aspartoftheemployee'sofficialduties,isrespondingtoariot,disturbance,hostage 40incident,escapeorothercriticalsituationwherethereisthethreatofseriousphysicalinjury 41ordeath,respondingtomutualaidcallfromanothercriminaljusticeagency,orin 42accompanyinganambulancewhichistransportinganoffendertoamedicalfacility; CCSSSSCSHCSHB1606 50 43 (8)Anyvehicledesignatedtoperformhazardoussubstanceemergencyfunctions 44establishedpursuanttotheprovisionsofsections260.500to260.550; 45 (9)Anyvehicleownedbythestatehighwaysandtransportationcommissionand 46operatedbyanauthorizedemployeeofthedepartmentoftransportationthatismarkedasa 47departmentoftransportationemergencyresponseormotoristassistancevehicle;or 48 (10)AnyvehicleownedandoperatedbythecivilsupportteamoftheMissouri 49NationalGuardwhileinresponsetoorduringoperationsinvolvingchemical,biological,or 50radioactivematerialsorinsupportofofficialrequestsfromthestateofMissouriinvolving 51unknownsubstances,hazardousmaterials,orasmayberequestedbytheappropriatestate 52agencyactingonbehalfofthegovernor. 53 5.(1)Thedriverofanyvehiclereferredtoinsubsection4ofthissectionshallnot 54soundthesirenthereonorhavethefrontredlightsorbluelightsonexceptwhensuchvehicle 55isrespondingtoanemergencycallorwheninpursuitofanactualorsuspectedlawviolator, 56orwhenrespondingto,butnotuponreturningfrom,afire. 57 (2)Thedriverofanemergencyvehiclemay: 58 (a)Parkorstandirrespectiveoftheprovisionsofsections304.014to304.025; 59 (b)Proceedpastaredorstopsignalorstopsign,butonlyafterslowingdownasmay 60benecessaryforsafeoperation; 61 (c)Exceedtheprimafaciespeedlimitsolongasthedriverdoesnotendangerlifeor 62property; 63 (d)Disregardregulationsgoverningdirectionofmovementorturninginspecified 64directions. 65 (3)Theexemptionsgrantedtoanemergencyvehiclepursuanttosubdivision(2)of 66thissubsectionshallapplyonlywhenthedriverofanysuchvehiclewhileinmotionsounds 67audiblesignalbybell,siren,orexhaustwhistleasmaybereasonablynecessary,andwhenthe 68vehicleisequippedwithatleastonelightedlampdisplayingaredlightorbluelightvisible 69undernormalatmosphericconditionsfromadistanceoffivehundredfeettothefrontofsuch 70vehicle. 71 6.Nopersonshallpurchaseanemergencylightasdescribedinthissectionwithout 72furnishingthesellerofsuchlightanaffidavitstatingthatthelightwillbeusedexclusivelyfor 73emergencyvehiclepurposes. 74 7.ViolationofthissectionshallbedeemedaclassAmisdemeanor. 442.130.1.Alldeedsorotherconveyancesoflands,orofanyestateorinterest 2therein,shallbesubscribedbythepartygrantingthesame,orbyhislawfulagent,andshallbe 3acknowledgedorprovedandcertifiedinthemannerhereinprescribed.
