COUNTYCORONERS(Sections50.327,58.095,and58.200,RSMo) Currently,araiseisauthorizedforcountycoronersincountiesof thesecondclassification. Thebillchangesittoapplytoall non-chartercounties. Thebillalsoprovidesthatthesalary commissionofanythirdclasscountymayamendthebasesalary schedulesasprovidedbylawforthecomputationofsalariesfor countyofficialstoincludeassessedvaluationfactorsinexcessof $300milliondollars,providedthatthepercentageofany adjustmentsmustbeequalforallcountyofficialsinthatcounty. Thebillalsoauthorizesacoronerwhoisactingassheriffper law,toreceiveasalaryequivalenttothesheriff’ssalarywhile actingassuch. COUNTYFINANCIALSTATEMENTS(Sections50.800,50.810,50.815,and 50.820) Allnon-chartercountiesarerequired,byJune30th,toprepareand publishinaqualifiednewspaperafinancialstatementforthe previousyear.Currently,theserequirementsonlyapplyto countiesofthefirstclassification. Thefinancialstatementmust includethename,office,andcurrentgrossannualsalaryofeach electedorappointedcountyofficial. Thecountyclerkorother officerresponsibleforthepreparationofthefinancialstatement mustpreservethedocumentsrelieduponinthemakingofthe financialstatementsandshallprovideanelectroniccopyfreeof chargetoanynewspaperrequestingacopyofthedata.The sectionspreviouslydealingwithcountyfinancialstatementsand theirpublicationforcountiesofthesecond,third,andfourth classifications arerepealed. COUNTYAUDITOR(Section55.160) Incountiesofthefirstandsecondclassification, thecounty auditorisauthorizedtohaveaccesstoandtheabilitytoaudit andexamineclaimsofeverykindandcharacterforwhichacounty officerhasafiduciaryduty. BOONECOUNTYSHERIFF(Section57.317) ExcludesthesheriffofBooneCountyfromthesalaryschedule containedinthissection. MARITALSTATUSREQUIREDONDEEDS(Sections59.310and442.130) Thisbillrequiresthatthemaritalstatusofallgrantorsona deedandotherdocumentspresentedforrecordingtorecordersof deedsarerequired. Therecordermustnotacceptanydocument unlesssuchinformationisprovided. PUBLICHEARINGNOTICEREQUIREMENTS (Sections67.457,67.461, 67.1421,67.1431,and67.1471) Thebillrequiresthegoverningbodyoftheapplicablecityor countytoprovidenoticeofpublichearingofNeighborhood ImprovementDistricts(NIDs)orCommunityImprovementDistricts (CIDs)regardingproceduresofthosedistrictsalsobegiventothe DepartmentofRevenue(DOR),whichshallpublishsuchinformation onitswebsite. Italsorequiresthegoverningbodyestablishing theNIDorCIDtosubmitcertaininformationtotheStateAuditor andDOR,andprohibitsanyNIDorCIDpropertyassessmentsfrom beingcollecteduntiltherequiredinformationissubmitted. HOMELESSNESSPROGRAMS(Section67.2300) Thebillprovidesthatstatefundsforhomelessnessmustbeused forcertainfacilities,includingparkingareas,camping facilities,andshort-termshelters,andmustcomplywithcertain requirementsasprovidedinthebill.Additionally,anypersonwho ownsoroperatesaprivatecampingfacilitypursuanttothisbill willbeimmunefromliabilityasprovidedinthebill.Statefunds otherwiseusedforpermanenthousingprojectswillbeusedto assistindividualswithsubstanceuse,mentalhealthtreatment,and otherserviceslikeshort-termhousing. TheDepartmentofEconomic Developmentmustawardcertainfundsasbonusesforpolitical subdivisionsthatreducethenumberofindividualswithdays unhoused,daysinjail,ordayshospitalized. Thisbillprovidesthatnopersonshallbepermittedtousestate- ownedlandsforunauthorizedsleeping,camping,orlong-term shelters. AnyviolationshallbeaClassCmisdemeanor;however thefirstoffenseshallbeawarningwithnocitation. Apoliticalsubdivisionshallnotadoptanypolicyunderwhichthe politicalsubdivisionprohibitstheenforcementofanyordinance prohibitingpubliccamping,sleeping,orobstructionofsidewalks. TheAttorneyGeneralshallhavethepowertobringacivilaction toenjointhepoliticalsubdivisionfromfailingtoenforceany ordinancesprohibitingpubliccamping,sleeping,orobstructionof sidewalks. Anypoliticalsubdivisionwithahigherper-capitahomelessness ratethanthestateaveragewillnotreceivefurtherstatefunding untiltheDepartmentdeterminesthepoliticalsubdivisionhasa lowerhomelessnessratethanthestateaverageoritenforces ordinancesprohibitingunauthorizedsleepingandcamping. Apoliticalsubdivisionmayallocateupto25%offundsitreceives fromthestatethroughgrantsforpublicsafetytothecreationof homelessoutreachteamsasprovidedinthebill.Theseprovisions willnotapplytosheltersfordomesticviolencevictims. TheprovisionsofthissectionwillbeeffectiveonJanuary1, 2023. LOCALGOVERNMENTEMPLOYEES'RETIREMENTSYSTEM(Section70.631) Currently,politicalsubdivisionslocatedinthirdclasscounties andCapeGirardeauCountymay,bymajorityvoteofthegoverning body,electtocovercertainemployeeclassesaspublicsafety personnelmembersintheLocalGovernmentEmployees'Retirement System(LAGERS). Thisbillremovesthisrestrictionandallowsany politicalsubdivisiontocoversuchemployeeclasses. PROPERTYREGULATIONS(Sections92.720,92.740,92.750,92.760, 92.765,92.770,92.775,92.810,92.815,92.817,92.825,92.835, 92.840,92.852,and92.855). ForanyimprovedparceloflandidentifiedasbeingvacantbySt. LouisCityoperatingundertheMunicipalLandReutilizationLaw, thecitycollectormust,withinnomorethantwoyearsafter delinquency,filesuitinthecircuitcourtagainstsuchlandsor lotstoenforcethelienofthestateandthecityasprovided undertheMunicipalLandReutilizationAct.Thefailureofthe collectortobringsuitwithintwoyearswillnotconstitutea defenseorbaranactionforthecollectionoftaxes. Currently,asuitfortheforeclosureofcertaintaxliensbegins byfilingapetitionwiththecircuitclerkandtheland utilizationauthority. Foreachpetitionfiled,thecitycollector mustmakeavailabletothepublicalistdetailingeachparcel includedinthesuit. Foranyimprovednonhomesteadparcel,anypersonhavinganyright, titleorinterestin,orlienupon,anyparcelofrealestatemay redeemtheparcelatanytimepriortothetimeoftheforeclosure saleoftherealestatebypayingallofthesumsdueasofthe dateofredemptiontothecitycollector,includingalldebtsowed tothecity. Thecitycollectormustmailanoticetothepeoplenamedinthe petitionashavinganinterestintheparcel,orpeopleotherwise knowntothecollector,attheaddressmostlikelytoinformthe partiesoftheproceedings. Thecitycollectormustfilewiththecourtanaffidavitof compliancewithallnoticerequirementsforthesuitpriortoany sheriff'ssale.Theaffidavitmustincludetheidentitiesofall partiestowhomnoticewasattemptedandbywhatmeans.For noticesreturnedundeliverable, thecollector'saffidavitmust certifywhatadditionalattemptwasmadeandbywhatmeans. Thereceiptofsurplusfundswillconstituteabartoanyclaimof right,titleorinterestin,orlienupontheparcelofrealestate bythefundrecipient. Currently,iftheparcelofrealestateis auctionedoffatasheriff'sforeclosuresaleforasumgreater thanthetotalamountnecessarytopayallthetaxbillsincluded inthejudgment,allproceedingsinthesuitshallbeordered dismissedastotaxesowned. Nolaterthan120dayspriortothesheriff'ssale,thecollector mustobtainatitleabstractorreportonanyunredeemedparcels, whichshallincludeallconveyances,liens,andchargesagainstthe realestate,andthenamesandmailingaddressesofanyinterested partiesandlienholders. Additionally,nolaterthan20daysprior tothesheriff'ssale,thecollectormustsendnoticeofthesale totheinterestedpartieswhichshallincludethedate,time,and placeofthesaleandotherinformationasprovidedinthebill. Thebillalsomodifiestherequirementthatthecollectorshall sendnoticeofthesaletothepartieshavinginterestinthe parcelnolaterthan40dayspriortothesheriff'ssale,rather than20days.Thenoticemustbesenttotheaddressesmostlikely toinformthepartiesoftheproceedings. Finally,nolaterthan20dayspriortothesheriff'ssale,the sheriffmustpostawrittennoticeontheparcelinaconspicuous locationandattachedtoastructure. Thenoticemustdescribethe propertyandadvisethatitisthesubjectofdelinquentlandtax collectionproceedingsandthatitmaybesoldforthepaymentof delinquenttaxes.Thisnoticemustalsocontainotherinformation asprovidedinthebill.Thesheriffmustalsoattemptinperson noticenolaterthan20dayspriortothesaletoanypersonfound attheproperty. Thecitycollectorcannotenterintoaredemptioncontractwith respecttoanyimprovedparcelnotoccupiedasahomestead. Onan annualbasis,thecitycollectorwillmakepubliclyavailablethe numberofparcelsunderredemptioncontract. Thecourtmuststaythesaleofanyparceltobesoldunder foreclosureinanactionfortemporarypossessionofrealproperty forrehabilitation, providedthatthepartywhohasbroughtsuchan actionhas,uponorderofthecourt,paidtothecircuitcourtthe principalamountofalllandtaxesthendueundertheforeclosure judgmentpriortothedateofsale.Uponthegrantingbyacourt oftemporarypossessionoftheproperty,thecourtmustdirect paymenttothecollectorofallprincipallandtaxespaidtothe circuitcourt.Additionally,thecourtshallorderthepermanent extinguishment ofpenaltiesandinterestarisingfromactionsto collectdelinquentlandtaxes. Iftheowneroftheparcelmovesforrestorationofpossession,the ownermustpayintothecircuitcourtalllandtaxamounts currentlydue,includingallpenalties,interest,attorney'sfees, andcourtcostsretroactivetothedateofaccrual. Ifthecourt ordersthepropertyberestoredtotheowner,allfundspaidonthe principallandtaxesshallbereturnedtothepayerandallfunds paidtothecircuitcourtbytheownerwillbepaidouttothe collector. Nopersonwillbeeligibletobidatthetimeofthesheriff'ssale unlessthepersonhas,nolaterthan10daysbeforethesaledate, demonstratedtothecollectororsheriffthattheyarenotthe ownerofanyparcelofrealestateinthecitywhichissubjectto delinquenttaxesorfees.Thecollectororsheriffmayrequire prospectivebidderstosubmitanaffidavitattestingtothebid requirementsofthisbill. Withinsixmonthsafterthesheriffsellstheparcelofreal estate,thecourtmustsetahearingtoconfirmorsetasidethe foreclosuresale.Thecourt'sjudgmentmustincludeaspecific findingthatadequatenoticewasprovidedtoallnecessaryparties. Ifthereareanysurplusfundsfromthesalethen10%ofthefunds shallbedistributedtotheAffordableHousingTrustFundofthe cityoritsequivalent. Thecitymayalso,byordinance,electto allocateaportionofitsshareofthesaleproceedstowardsafund forthepurposeofdefendingagainstclaimschallengingthe sufficiencyofnotice. Thepurchasersofthepropertymustagreethatintheeventof theirfailuretoobtainanoccupancypermitpriortoanysubsequent transferoftheproperty,theywillpay$5,000indamageswithout proofoflossordamages,exceptthesedamagesshallnotconstitute alienontheproperty. Ifanypurchaserappliesforanoccupancy permitandinspectorsdonotinspecttheparcelin120days,the costoftheapplicationshallbededicatedtothesheriffforthe purposeofprovidingnoticetointerestedparties. Ifthesaleisnotconfirmedwithinsixmonthsafterthesale,any set-asideofthesalemayincludeapenaltyof25%ofthebid amountovertheopeningbidamountandshallbepaidtothe AffordableHousingTrustFundofthecityoritsequivalent. Provisionsrelatingtotherecordingofasheriff'sdeedare modified. Allsuchdeedsmustberecordedwiththerecorderof deedswithintwomonthsafterthecourtconfirmsthesale,ifno proceedingtosetasidetheconfirmationjudgmentisbeforethe court.Thesheriff'sdeedwillbeprimafacieevidencethatthe suitandallproceedingsmettherequirementsoflaw. Theprovisionisrepealedthataftertwoyearsfromthedateofthe recordingofthedeed,thereshallbeapresumptionthatthesuit andallproceedingsmettherequirementsoflawandnosuitmaybe filedtoattackthevalidityoftheclaim. REQUIREDANNUALFINANCIALSTATEMENTSTOAUDITOR(Section105.145) Thisbillchangesthelawsregardingtheconsequencestoa politicalsubdivisionforfailuretofileanannualfinancial statementwiththeStateAuditorasrequired,whichconsequenceis afine.Anypoliticalsubdivisionthathasgrossrevenuesofless than$5,000orthathasnotleviedataxisnotsubjecttothe fine.Ifapoliticalsubdivisionhasoutstandingfinesduewhen filingitsfirstannualfinancialstatementafterJanuary1,2023, theDirectorofRevenuewillmakeaone-timedownwardadjustmentof thetotalamountduebyatleast90%.Inaddition,theDirectorof theDepartmentofRevenuehastheauthoritytomakeaone-time downwardadjustmenttoanyfineheorshedeemsuncollectible. DELINQUENTPROPERTYTAXAUCTIONS(Sections140.170and140.190) Thisbillallowsacountycollectortoholdanauctionoflands withdelinquentpropertytaxesthroughelectronicmediaatthesame timeastheauctionisheldin-person. SALESTAXEXEMPTIONFORSOCCERTICKETS(Section144.051) BeginningJune1,2026,andendingJuly31,2026,asalestax exemptionisauthorizedforthesaleofticketstomatchesofthe 2026FIFAWorldCupsoccertournamentheldinJacksonCounty. TRANSPORTATION DEVELOPMENTDISTRICTS(Sections238.212and238.222) Thisbillrequiresnoticethatapetitionhasbeenfiledtocreate aTransportation DevelopmentDistrict(TDD)toalsobegiventothe DepartmentofRevenue(DOR),whichshallpublishtheinformationon itswebsite. Italsorequiresthegoverningbodyestablishinga TDDtosubmitcertaininformationtotheStateAuditorandDOR,and prohibitsanydistricttaxesfrombeingcollecteduntilthe requiredinformationissubmitted. POLITICALSUBDIVISIONBUILDINGCODES(Section260.295) Nobuildingcodeadoptedbyapoliticalsubdivisionmayprohibit theuseofrefrigerantsthatareapprovedforusebyfederallaw, providedanyrelatedequipmentisinstalledinaccordancewith federallaws.Anyprovisionsofabuildingcodethatviolatesthis sectionisnullandvoid. EMERGENCYVEHICLES(Section304.022) Countyandmunicipalparkrangervehiclesareaddedtothetypesof vehiclesthataredefinedas“emergencyvehicles”. PUBLICADMINISTRATORS (Section473.742) Thisbillprovidesthatifapublicadministratorisappointedby thecourtasbothaguardianandaconservatortothesamewardor protectee,itwillbeconsideredtwoletters. Uponmajority approvalofthecountysalarycommission,apublicadministrator maybepaidaccordingtotheassessedvaluationschedulesetforth inthebill.Ifthesalarycommissionelectstopayapublic administratoraccordingtothesalaryscheduleitcannotthereafter changetopayingthepublicadministratoraccordingtotheaverage numberofopenletters. BeginningJanuary1,2023,public administrators whosetermsstartonorafterthatdateshallbe deemedtohaveelectedtoreceiveasalaryasprovidedinthebill. CONDEMNATION(Section523.061) Asspecifiedinthisbill,ifajurytrialofexceptionsoccursand thecircuitjudgepresidingoverthecondemnationproceedinghas determinedthatahomesteadtakinghasoccurredorheritagevalue ispayable,thenthejudgemustapplytheprovisionsspecifiedin statutetoincreasethejuryverdictasappropriate.
