SectionA.Chapter191,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection191.620,toreadasfollows:
191.620.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Department",thedepartmentofhealthandseniorservices;
3 (2)"Primarycarephysician",aphysicianlicensedandregisteredunderchapter
4334engagedingeneralorfamilypractice;
5 (3)"Ruralcounty",acountyinMissouriwithfewerthanthirty-fivethousand
6inhabitants.
7 2.Subjecttoappropriation,thedepartmentshallestablisharuralprimarycare
8physiciangrantprogramtoprovideincentivestoprimarycarephysicianstopractice
9andresideinruralcounties.Thedepartmentshallawardgrantstoeligibleprimary
10carephysiciansonthebasisofavailablefunds,withprioritygiventoprimarycare
11physicianspracticinginruralcountieshavingthegreatestneed.
12 3.Anyprimarycarephysicianwhobeginspracticeasaprimarycarephysician
13inaruralcountyafterAugust28,2022,whoresidesinsuchruralcounty,andwhois
14willingtoenterintoagrantagreementunderthetermsoutlinedinsubsection4ofthis
15sectionshallbeeligibletoreceiveagrantunderthissection.Thedepartmentshallpost
16onitswebsitetheeligibilitycriteriaoutlinedinthissection,thecontentsofthegrant
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17application,andtheproceduresandtimelinesbywhichprimarycarephysiciansmay
18applyforgrants.
19 4.Thedepartmentshallenterintoagrantagreementwitheachprimarycare
20physiciantowhomitawardsagrantunderthissection.Thegrantagreementshallbein
21writingandshallcontain:
22 (1)Aprovisionthattheprimarycarephysicianagreestoresideandpracticeasa
23primarycarephysicianinaruralcountyforacontinuousfive-yearperiodandthestate
24agreestopaytheprimarycarephysiciantenthousanddollarseachyearofsuchfive-
25yearperiod,withsuchperiodofresidenceandpracticetobeginimmediately;
26 (2)Aprovisionthatanyobligationsarisingoutoftheagreemententeredinto
27undersubdivision(1)ofthissubsectionarecontingentuponfundsbeingappropriated
28forgrantpayments;
29 (3)Aprovisionidentifyingtheruralcountywheretheprimarycarephysician
30willpracticeandreside;
31 (4)Astatementofthedamagestowhichthestateisentitledfortheprimarycare
32physician'sbreachofthegrantagreement;and
33 (5)Suchotherstatementsoftherightsandliabilitiesofthedepartmentandof
34theprimarycarephysiciannotinconsistentwiththissection.
35 5.Ifanindividualbreachesthewrittengrantagreementbyfailingeitherto
36beginthefive-yearperiodofresidenceandpracticeortocompletethefive-yearperiod
37ofresidenceandpractice,thestateshallbeentitledtorecoverfromtheindividualan
38amountequaltothesumof:
39 (1)Thetotaloftheamountspaidbythestatetotheindividualunderthegrant
40agreement;
41 (2)Anamountequaltoanydamagesincurredbythedepartmentasaresultof
42thebreach;and
43 (3)Anylegalfeesorassociatedcostsincurredbythedepartmentorthestatein
44thecollectionofdamages.
45 6.Thissectionshallnotbeconstruedtorequirethedepartmenttoenterinto
46grantagreementswithprimarycarephysicianswhoareeligibleforgrantsunderthis
47sectionifstatefundsarenotavailableforsuchpurpose.
48 7.(1)Thereisherebycreatedinthestatetreasurythe"RuralPrimaryCare
49PhysicianGrantProgramFund",whichshallconsistofmoneysappropriatedtoitby
50thegeneralassembly.Thestatetreasurershallbecustodianofthefund.Inaccordance
51withsections30.170and30.180,thestatetreasurermayapprovedisbursements.The
52fundshallbeadedicatedfundand,uponappropriation,moneysinthefundshallbe
HB1630	2 53usedsolelyforawardinggrantsandadministeringthegrantprogramdescribedinthis
54section.
55 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
56remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
57generalrevenuefund.
58 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
59otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
60creditedtothefund.
61 8.Thedepartmentmaypromulgaterulestoimplementtheprovisionsofthis
62section.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
63createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
64complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
65section536.028.Thissectionandchapter536arenonseverable,andifanyofthepowers
66vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
67effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
68thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
6928,2022,shallbeinvalidandvoid.
