Torepealsection442.403,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
restrictivecovenants.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section442.403,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection442.403,toreadasfollows:
442.403.1.Anyrestrictivecovenantrecitalsonproperty,realorpersonal,foundin
2anydeeds,plats,restrictions,covenants,orotherconveyancesofanytypeornature,filedfor
3recordatanytimeintheofficeoftherecorderofdeedsinanycounty[, whichrelate] that
4relatetotherace,color,religion,ornationaloriginofanyperson[,] shallbevoidand
5unenforceable[,] andshallbeignored,asifthesameneverexisted.
6 2.Anypersonorlegalentitywithaninterestinrealpropertyoranyagentofsuch
7personorentity,shallnotincuranyliabilitybyreasonofthemereexistenceofarestrictive
8covenantdescribedinsubsection1ofthissectioninanydocumentfiledforrecordbefore
9May3,1948,inanyrecorderofdeeds'office.
10 3.NodeedrecordedonorafterAugust28,2022,shallcontainareferencetothe
11specificportionofarestrictivecovenantpurportingtorestricttheownershiporuseof
12thepropertyasprohibitedundersubsection1ofthissection.Arecorderofdeedsmay
13refusetoacceptanydeedsubmittedforrecordingthatreferencesthespecificportionof
14anysuchrestrictivecovenant.Thepersonwhopreparesorsubmitsadeedforrecording
15hastheresponsibilityofensuringthatthespecificportionofsucharestrictivecovenant
16isnotspecificallyreferencedinthedeedpriortosuchdeedbeingsubmittedfor
17recording.Adeedmayincludeageneralprovisionthatstatesthatsuchdeedissubject
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18toanyandallcovenantsandrestrictionsofrecord;however,suchprovisionshallnot
19applytothespecificportionofarestrictivecovenantpurportingtorestrictthe
20ownershiporuseofthepropertyasprohibitedundersubsection1ofthissection.Any
21deedthatisrecordedafterAugust27,2022,thatmistakenlycontainssucharestrictive
22covenantshallneverthelessconstituteavalidtransferofrealproperty.
23 4.Anyrestrictivecovenantprohibitedundersubsection1ofthissectionmaybe
24releasedbytheownerofrealpropertysubjecttosuchcovenantbyrecordinga
25certificateofreleaseofprohibitedcovenants.Therealpropertyownermayrecorda
26certificateeitherpriortorecordingofadeedconveyingrealpropertytoapurchaseror
27whensuchrealpropertyownerdiscoversthatsuchprohibitedcovenantexistsand
28choosestoaffirmativelyreleasethesame.Acertificatemaybepreparedwithout
29assistanceofanattorneybutshallconformsubstantiallytothefollowingcertificateof
30releaseofprohibitedcovenantsform:
