Thisbillenactsprovisionsrelatingtorestrictionsonreal
property.
ZONINGREGULATIONSONHOME-BASEDWORKBYPOLITICALSUBDIVISIONS
(Sections64.008,65.710,and89.500,RSMo)
Thebillcreatesnewprovisionsgoverningtheregulationofhome-
basedwork,asdefinedinthebill,bycertainpolitical
subdivisions. Specifically,counties,municipalities, and
townshipsareprohibitedfromenactingazoningordinanceor
regulationthat:
(1)Prohibitsmailorderortelephonesalesforhome-basedwork;
(2)Prohibitsservicebyappointmentwithinthehomeoraccessory
structure;
(3)Prohibitsorrequiresstructuralmodificationstothehomeor
accessorystructure;
(4)Restrictsthehoursofoperationforhome-basedwork;or
(5)Restrictsstorageortheuseofequipmentthatdoesnot
produceeffectsoutsidethehomeoraccessorystructure.
Furthermore,anysuchzoningordinanceorregulationmaynot
explicitlyrestrictorprohibitaparticularoccupation.
Theseprovisionsdonotsupersedeanydeedrestriction,covenantor
agreementrestrictingtheuseoflandnoranymasterdeed,bylaw
orotherdocumentapplicabletoacommoninterestownership
community.
LOCALRESTRICTIONSONHOME-BASEDBUSINESSES(Section71.990)
Thisbillprovidesthatapoliticalsubdivisionshallnotprohibit
theoperationofano-impact,home-basedbusinessorrequirea
persontoapplyforanypermitorlicensetooperatesucha
business. However,apoliticalsubdivisionmayestablish
reasonableregulationsonsuchbusinessesthatarenarrowly
tailoredforthepurposeofprotectingpublichealthandensuring
thebusinessesarecompliantwithstateandfederallaw.
BUILDINGCODES(Section260.295)
Nobuildingcodeadoptedbyapoliticalsubdivisionshallprohibit theuseofrefrigerantsthatareapprovedforuseunderthefederal
CleanAirAct.
RESTRICTIVECOVENANTS-DISCRIMINATORY COVENANTS(Sections442.403)
ThisbillprohibitsdeedsrecordedonorafterAugust28,2022,
fromspecificallyreferencingrestrictionsrelatingtoaperson's
race,color,religion,ornationalorigin.
Thepersonpreparingorsubmittingadeedforrecordinghasthe
responsibility forensuringcompliancewiththisbill,and
recordersofdeedsmayrefusetoacceptdeedsthatareinviolation
ofthebill.Deedsinviolationofthisbillshallnevertheless
constituteavalidtransferofrealproperty.
Thebillprovidesthattheownerofrealpropertymayreleasethe
prohibitedcovenantsbyfilingacertificateofreleaseinaform
specifiedunderthebill.
RESTRICTIVECOVENANTS-RENEWABLEENERGY(Sections442.404andB)
Thisbillspecifiesthatnodeedrestriction,covenant,orsimilar
bindingagreementrunningwiththelandshalllimitorprohibitthe
installationofsolarpanelsorsolarcollectors,asdefinedinthe
bill,ontherooftopofanypropertyorstructure.
Ahomeowners'associationmayadoptreasonablerulesregardingthe
placementofsolarpanelsorsolarcollectorstotheextentthose
rulesdonotpreventtheinstallationofthedeviceoradversely
affectitsfunctioning,use,cost,orefficiency.
Theseprovisionsshallapplyonlywithregardtorooftopsthatare
owned,controlled,andmaintainedbytheowneroftheindividual
propertyorstructure.
TheseprovisionsshalltakeeffectJanuary1,2023(SectionB).

Thebilladdsvariousclericalprovisionsrelatedtodocument
recording,suchastherequirementthatagrantor'smaritalstatus
belistedinacertainplaceonadocumentpresentedtothe
recorderofdeeds.Additionally,thebilladdsaprovision
specifyingthatthecollectormustfilesuitwithintwoyearsin
thecircuitcourtagainstlandorlotsidentifiedbyacertaintype
ofcityasbeingvacanttoenforcethelienofthestateandthe city.Failureofthecollectortobringsuitwithintherequired
twoyearsdoesnotconstituteadefenseorbaranactionforthe
collectionoftaxes.Foreachpetitionfiled,thecollectormust
makealistdetailingeachparcelincludedinthesuitavailableto
thepublic.Thebillalsoprovidesaprocessforanypersonwho
hasarightorinterestinanyimprovednon-homesteadparcel.
Thebillprovidesthatthecitycollectormustmailnoticeto
peoplenamedinthepetitionashavingarightorinterestina
parcelorlottotheaddressmostlikelytoinformtheparties.
Additionally,thecollectormustfilewiththecourtanaffidavit
ofcompliancewithallnoticerequirementsforsuitpriortoany
sheriff'ssale.Theaffidavitmustincludetheidentitiesofthe
partiestowhomnoticewasattempted. Nolaterthan120days
beforeasheriff'ssale,thecollectormustobtainatitleabstract
orreportonanyunredeemedparcelsand,nolaterthan20days
beforethesale,thecollectormustsendnoticeofthesaleto
lienholdersandinterestedpartiesasnotedonthetitleabstract.
Nolessthan40daysbeforethesale,ratherthanthecurrentlaw
of20daysbeforethesale,thecollectormustsendnoticeofthe
saletopartieshavinginterestintheparcelasdisclosedonthe
recordsoftheassessororotherwiseknowntothecollector.
Thebillprovidesthatthecitycollectorshallnotenterintoa
redemptioncontractwithrespecttoanyimprovedparcelnot
occupiedasahomestead. Onanannualbasis,thecitycollector
shallmakepubliclyavailablethenumberofparcelsunder
redemptioncontract.
Thecourtshallstaythesaleofanyparceltobesoldunder
foreclosureinanactionfortemporarypossessionofrealproperty
forrehabilitation, providedthatthepartythathasbroughtsuch
anactionhas,uponorderofthecourt,paidtothecircuitcourt
theprincipalamountofalllandtaxesthendueunderthe
foreclosurejudgmentpriortothedateofsale.Uponthegranting
byacourtoftemporarypossessionoftheproperty,thecourtwill
directpaymenttothecollectorofallprincipallandtaxespaidto
thecircuitcourt.Additionally,thecourtmustorderthe
permanentextinguishment ofpenaltiesandinterestarisingfrom
actionstocollectdelinquentlandtaxes.
Iftheowneroftheparcelmovesforrestorationofpossession,the
ownershallpayintothecircuitcourtalllandtaxamounts
currentlydue,includingallpenalties. Ifthecourtordersthe
propertyberestoredtotheowner,allfundspaidontheprincipal
landtaxesshallbereturnedtothepayerandallfundspaidtothe
circuitcourtbytheownershallbepaidouttothecollector.
Thebillprovidesthatnopersonshallbeeligibletobidatthe timeofthesheriff'ssaleunlessthepersonhas,nolaterthan10
daysbeforethesaledate,demonstratedtothecollectororsheriff
thatthepersonisnottheownerofanyparcelofrealestatein
thecitythatissubjecttodelinquenttaxesorfees.The
collectororsheriffmayrequireprospectivebidderstosubmitan
affidavitattestingtothebidrequirementsofthisbill.
Thisbillprovidesthat,withinsixmonthsafterthesheriffsells
theparcelofrealestate,thecourtmustsetahearingtoconfirm
orsetasidetheforeclosuresale.Thecourt'sjudgmentwill
includeaspecificfindingthatadequatenoticewasprovidedtoall
necessaryparties.
Ifthereareanysurplusfundsfromthesale,then10%ofthefunds
shallbedistributedtotheAffordableHousingTrustFundofthe
cityoritsequivalent. Thecitymayalso,byordinance,electto
allocateaportionofitsshareofthesaleproceedstowardsafund
forthepurposeofdefendingagainstclaimschallengingthe
sufficiencyofnotice.
Additionally,thebillprovidesthatthepurchasersoftheproperty
mustagreethat,intheeventoftheirfailuretoobtainan
occupancypermitpriortoanysubsequenttransferoftheproperty,
theyshallpay$5,000indamageswithoutproofoflossordamages,
exceptthesedamageswillnotconstitutealienontheproperty.
Ifthesaleisnotconfirmedwithinsixmonthsafterthesale,any
set-asideofthesale,atthediscretionofthecourtorcollector,
willincludeapenaltyof25%ofthebidamountovertheopening
bidamountandshallbepaidtotheAffordableHousingTrustFund
ofthecityoritsequivalent.
Thebillmodifiesprovisionsrelatingtotherecordingofa
sheriff'sdeed.Allsuchdeedsshallberecordedwiththerecorder
ofdeedswithintwomonthsafterthecourtconfirmsthesale,ifno
proceedingtosetasidetheconfirmationjudgmentisbeforethe
court.Thesheriff'sdeedwillbeprimafacieevidencethatthe
suitandallproceedingsmettherequirementsoflaw.
Thebillrepealstheprovisionthat,aftertwoyearsfromthedate
oftherecordingofthedeed,therewillbeapresumptionthatthe
suitandallproceedingsmettherequirementsoflawandnosuit
maybefiledtoattackthevalidityoftheclaim.
Lastly,allwritteninstrumentsconveyingrealestateorany
interestinrealestatemuststatethemaritalstatusofany
naturalpersonactingasgrantor,mortgagor,orotherparty
executingtheinstrument.
