170.348.1.Asusedinthissection,"publicschool"hasthesamedefinitionasin
2section160.011.
3 2.(1)Nopupilinanypublicschoolshallberequiredtoengageinanyformof
4mandatorygenderorsexualdiversitytrainingorcounseling.Anyorientationor
5requirementthatpresentsanyformofraceorsexstereotypingorabiasonthebasisof
6raceorsexisprohibited.
7 (2)Thissubsectionshallnotbeconstruedtoprohibitvoluntarycounseling.
8 3.(1)Noteacher,administrator,orotheremployeeofaschooldistrictorpublic
9schoolshallrequireormakepartofacoursetheconceptthat:
10 (a)Oneraceorsexisinherentlysuperiortoanotherraceorsex;
11 (b)Anindividual,byvirtueoftheindividual'sraceorsex,isinherentlyracist,
12sexist,oroppressive,whetherconsciouslyorunconsciously;
13 (c)Anindividualshouldbediscriminatedagainstorreceiveadversetreatment
14solelyorpartlybecauseoftheindividual'sraceorsex;
15 (d)Membersofoneraceorsexcannotandshouldnotattempttotreatothers
16withoutrespecttoraceorsex;

20foractionscommittedinthepastbyothermembersofthesameraceorsex;
21 (g)Anindividualshouldfeeldiscomfort,guilt,anguish,oranyotherformof
22psychologicaldistressonaccountoftheindividual'sraceorsex;or
23 (h)Meritocracyortraitssuchasastrongworkethicareracistorsexistorwere
24createdbymembersofaparticularracetooppressmembersofanotherrace.
25 (2)Thissubsectionshallnotbeconstruedtoprohibittheteachingofconcepts
26thatalignwiththeacademicperformancestandards,learningstandards,orthe
27statewideassessmentsystemasestablishedunderchapter160.
28 4.Ifanindividualholdingacertificateoflicensetoteachgrantedunderchapter
29168violatesthissection,thestateboardofeducationshallbegindisciplineproceedings
30againstsuchindividualundersection168.071.
31 5.(1)Ifthestateboardofeducationdeterminesthatapubliclyfundedlocal
32educationagencyoronlineprogramofinstructionhasviolatedthissection,theboard
33shallnotifytheentityofitsviolation.
34 (2)Ifsuchentityfailstocomplywiththissectionwithinthirtydaysofsuch
35notification,thestateboardofeducationshalldirectthedepartmentofelementaryand
36secondaryeducationtowithholdamaximumoftenpercentofthemonthlydistribution
37ofstateformulafundingtosuchentity.Aftertheboarddeterminesthatsuchentityisin
38compliancewiththissection,thedepartmentshallrestorethedistributionofthefunding
39toitsoriginalamountbeforethepercentageofthedistributionwaswithheld.
40 6.Thestateboardofeducationmaypromulgateallnecessaryrulesand
41regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
42termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
43sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
44provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
45536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
46pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
47arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
48andanyruleproposedoradoptedaftertheeffectivedateofthissectionshallbeinvalid
49andvoid.
SectionB.Becauseimmediateactionisnecessarytoprohibitdiscriminationin
2education,sectionAofthisactisdeemednecessaryfortheimmediatepreservationofthe

4themeaningoftheconstitution,andsectionAofthisactshallbeinfullforceandeffectupon
5itspassageandapproval.
