170.348.1.Asusedinthissection,"publicschool"hasthesamedefinitionasin
2section160.011.
3 2.(1)Nopupilinanypublicschoolshallberequiredtoengageinanyformof
4mandatorygenderorsexualdiversitytrainingorcounseling.Anyorientationor
5requirementthatpresentsanyformofraceorsexstereotypingorabiasonthebasisof
6raceorsexisprohibited.
7 (2)Thissubsectionshallnotbeconstruedtoprohibitvoluntarycounseling.
8 3.(1)Noschoolorschoolemployeeshallcompelateacherorstudenttoadopt,
9affirm,adhereto,orprofessideasinviolationofTitleIVorTitleVIofthefederalCivil
10RightsActof1964,asamended,including,butnotlimitedto,thefollowing:
11 (a)Oneraceorsexisinherentlysuperiortoanotherraceorsex;
12 (b)Anindividual,byvirtueoftheindividual'sraceorsex,isinherentlyracist,
13sexist,oroppressive,whetherconsciouslyorunconsciously;
14 (c)Anindividualshouldbediscriminatedagainstorreceiveadversetreatment
15solelyorpartlybecauseoftheindividual'sraceorsex;
16 (d)Membersofoneraceorsexcannotandshouldnotattempttotreatothers
17withoutrespecttoraceorsex;

23psychologicaldistressonaccountoftheindividual'sraceorsex;or
24 (h)Meritocracyortraitssuchasastrongworkethicareracistorsexistorwere
25createdbymembersofaparticularracetooppressmembersofanotherrace.
26 (2)Thissubsectionshallnotbeconstruedtoprohibittheteachingofconcepts
27thatalignwiththeacademicperformancestandards,learningstandards,orthe
28statewideassessmentsystemasestablishedunderchapter160.
29 4.Ifanindividualholdingacertificateoflicensetoteachgrantedunderchapter
30168violatesthissection,thestateboardofeducationshallbegindisciplineproceedings
31againstsuchindividualundersection168.071.
32 5.(1)Ifthestateboardofeducationdeterminesthatapubliclyfundedlocal
33educationagencyoronlineprogramofinstructionhasviolatedthissection,theboard
34shallnotifytheentityofitsviolation.
35 (2)Ifsuchentityfailstocomplywiththissectionwithinthirtydaysofsuch
36notification,thestateboardofeducationshalldirectthedepartmentofelementaryand
37secondaryeducationtowithholdamaximumoftenpercentofthemonthlydistribution
38ofstateformulafundingtosuchentity.Aftertheboarddeterminesthatsuchentityisin
39compliancewiththissection,thedepartmentshallrestorethedistributionofthefunding
40toitsoriginalamountbeforethepercentageofthedistributionwaswithheld.
41 6.Thestateboardofeducationmaypromulgateallnecessaryrulesand
42regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
43termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
44sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
45provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
46536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
47pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
48arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
49andanyruleproposedoradoptedaftertheeffectivedateofthissectionshallbeinvalid
50andvoid.
SectionB.Becauseimmediateactionisnecessarytoprohibitdiscriminationin
2education,sectionAofthisactisdeemednecessaryfortheimmediatepreservationofthe
HCSHB1669 2 3publichealth,welfare,peace,andsafety,andisherebydeclaredtobeanemergencyactwithin
4themeaningoftheconstitution,andsectionAofthisactshallbeinfullforceandeffectupon
5itspassageandapproval.
